HomeMy WebLinkAboutResolution No. 1833RESOLUTION NO. 1633 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AUTHORIZING AN EXCEPTION OR VARIANCE UNDER SECTION 16 OF ORDINANCE NO. 342 IN FAVOR OF EGGLESTONE & ROOT, SUCCESSORS OF VOSBURG BROTHERS, INCORPORATED, APPLICABLE TO A PORTION OF LOT 71 SUBDIVISION NO. 2 AZUSA LAND AND WATER COMPANY. The City Council of the City of Azusa does resolve as follows: WHEREAS Vosburg Brothers, Incorporated, owners of that portion of Lot 71 Subdivision No. 2 Azusa Land and Water Company, which lies North of a prolongation of the South line of Second Street in said City, consisting of 30 acres more or less, has made verified application to the City Planning Commission requesting an exception or variance under Section 16 of Ordinance No. 342 of the City of Azusa, known as the Zoning Ordinance, so as to permit the erection, construction, maintenance and operation of a storage and repair yard for contractors' equipment, supplies and apparatus, the granting of which said application has been recommended to the City Council by said City Planning Commission, and WHEREAS it has been made to appear to said City Council that the aforedescribed property is sparsely improved; that notice has been given to interested parties as to the pendency of this proceeding; that no further or other notice is necessary; that Egglestone & Root, assignees of Vosburg Brothers, Incorporated, to the property hereinbefore mentioned, have in writing assured the City Council of the City of Azusa and the owners of property surrounding and adjacent to the property hereinbefore mentioned that they will take all necessary steps to prevent dust from originating on their said property :so that adjoining property or business will not be interfered with by reason of the granting of this variance; and that the granting of said application and the permit therefor are necessary for the preservation and enjoyment of the substan- tial rights of petitioner and are not materially detrimental to the public welfare or injurious to the property or improvements in the zone or district in which the aforedescribed property lies or injurious to the property or improvements in other zones or districts: NOW THEREFORE BE IT RESOLVED that the aforesaid application for exception or variance be and the same is hereby granted and that an exception or variance be and the same is hereby made in favor of Egglestone & Root, assignees of Vosburg Brothers, Incorporated, or their successors in interest or title, and in favor of any other owner or owners of aforedescribed property, as to said property, under Section 16 of said Zoning Ordinance, so as to permit the erection, construction, mainten- ance and operation of a storage and repair yard for contractors' equipment, supplies, and apparatus, on and in aforedescribed property, subject however to the following terms and conditions: (A) Said exception or variance is and shall be revocable by the City Council of the City of Azusa and said Council reserves the right to revoke said exception or variance at any time, and any'person or persons.by acting under said exception or vafiance thereby accept the reser- vation of right in the City Council to revoke same at any time. (B) Any and all activities carried on or things done under and by virtue of said exception or variance shall be carried on and done in a good, workmanlike, peaceable and lawful manner, and shall not at any time or in any way constitute a public or private nuisance or be harmful or injurious to the peace or welfare of the City of Azusa or of any of its residents, citizens, property owners, or to any property of any of the same. BE IT FURTHER RESOLVED that the Mayor of said City shall sign this Resolution and the City Clerk shall attest same and certify to the passage and adoption thereof.
