FOOTHILL BLVD, AZOBA, CALIFORNIA BDOSWOOD 4-1104 • 6 RESOLUTION NO. 3098 A RFSOLUTION OF THY: CITY COUNCIL OF THF CITY OF AZUSA, IAS ANGELES COUNTY, CALIFORNIA APPROVING CERTAIN CONTRACT DATED OCTOBTM 19 1954 BETWEEN RAr,IOND E. FITZGERALD AND MARY FITZGrRALD RELATIVE TO THE ACQUISITION BY THE CITY OF AZUSA FROU RAMIOND E. = 1,1ARY FITZGFRALD OF PORTIONS OF LOT 4 OF BLOCK "A", SUBDIVISION No. 1 OF THr LANDS OF AZUSA LAND AND WATER COMPANY. WHEREAS, it is necessary that certain street improvements be made at and near the intersection of Orange Avenue and Paramount, in said City; and !-:HF.REAS, it is necessary that the following described lands be acquired by the City for that purpose, namely The southerly 40 feet of a portion of ?lock A of Lot 4 of Subdivision No. 1 of lands of Azusa Land and Water Company, except therefrom that portion lying within the Westerly 350 feet of said Lot 4, and the easterly 35 feet of that portion of the vacated one-half of Orange Avenue abutting on said Lot 4 on the east as shown on plat recorded in Book 70, Pages 65 and 66, Miecellaneous Records in the office of the County Recorder of Los Angeles County, and WHEREAS, the said. Raymond E. and Pilary Fitzgerald have signed a contract deeding said property to the City, upon certain conditions as outilned in said contract; and WHEREAS, the City Council has examined the said contract and are acquainted with the details thereof and have approved the same; THEREFORE, the City Council of the City of Azusa does resolve that that certain contract hereinbefore referred to be, and the same is, hereby approved and the Mayor is hereby authorized and directed to sign said contract for and on behalf of the City of Azusa and the City Clerk shall attest the same and place the seal of the City thereon. AZO,M CALIFORNIA EDOEWOOD 4.1204 . 6 The undersigned, Raymond E. and Mary Fitzgerald, are presently owners of the following described premises, to -wit; The southerly 40 feet of a portion of Block A of Lot 4 of Subdivision No. 1 of lands of Azusa Land and Water Company, except therefrom that portion lying within the Westerly 350 feet of said Lot,4,.and the easterly 35 feet of that portion of the vacated one-half of Orange Avenue abutting on said Lot 4 on the east as shown on plat.reoorded th Hook 70, Pages 65 and 66, Miscellaneous Records in the office of the County Recorder of Loa Angeles County. That the South portion of said Lot 4 extends into Paramount Avenue in the City of Azusa, and it is the desire of the City of Azusa to widen said Paramount Avenue at that place so as to bring the front of said Lot 4 in line with the other properties along said street. The said parties, namely Raymond E. and Mary Fitzgerald, agree to give to the City the South 40 feet of said Lot 4 by a Quit Claim Deed and the City of Azusa, in oonsiderat- ion of conveyance of said 40 feet to the City, agrees to move the house now on said lot onto a new foundation on said lot as designated by Raymond E. and bury Fitzgerald, and the City further agrees as follows, to -wit; 1. To brick the south front of said lot in the same manner that a part thereof is at present bricked. 2. To place ourbs on Orange Avenue the full length of said Lot 4 on the East. 3. To leave the building on the new foundation in as good condition as it presently is. 4. To fill one of the cesspools,namely the one under the house, when the same has been moved, and agrees further to install leaching lines for the effluent from the existing tank. 5. The City further agrees to pay the sum of $60.00 for paint for the building on said promises. 6. The City further agrees to pave the driveway and to replace concrete walks. 7. In the event that there shall be :any damage from drainage or storm waters on the West slope of Orange Avenue within a period of three years from the date of this Agreement, the City agrees to Install a concrete block retaining wall. All of the work to be done on the part of the City of Azusa shall be paid for by the City, and shall be done without any cost to said Raymond E. and Mary Fitzgerald.
