HomeMy WebLinkAboutResolution No. 26RESOLUTION NO. 26 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA, CALIFORNIA, APPROVING AN AGREEMENT ESTABLISHING CITY -AGENCY RELATIONSHIPS WHEREAS, the Redevelopment Agency of the City of Azusa, desires to establish certain relationships with the City of Azusa; NOW, THEREFORE, IT IS HEREBY RESOLVED by the Redevelopment Agency of the City of Azusa, that the Agreement entitled: "Agreement Between the City of Azusa and the Redevelopment Agency of the City of Azusa, Establishing Certain City -Agency Relationships" is hereby approved and the Chairman of the Agency is authorized to sign said Agreement on behalf of the Agency. Directors: None RESOLUTION NO. 6832 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA APPROVING AN AGREEMENT ESTABLISHING CITY-AZUSA RELATIONSHIPS WHEREAS, the City of Azusa desires to establish certain City - Agency relationships with the Redevelopment Agency of the City of Azusa; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Azusa that the Agreement entitled: "Agreement Between the City of Azusa and the Redevelopment Agency of the City of Azusa Establishing Certain City -Agency Relationships" is hereby approved and the Mayor .is authorized to sign said Agreement on behalf of the City. Other Services Upon the request of the Agency Members, the City shall, either directly or by outside contract, provide such other services as the Agency Members may determine to be necessary in carrying out the Agency's redevelopment purposes. II. COMPENSATION BY AGENCY FOR SERVICES PROVIDED A. Staff Services and Facilities Charges for staff services (including payroll, overhead, and necessary supplies), and facilities (including duplicating and vehicle use) shall be billed to the Agency quarterly. It is agreed that such charges shall have commenced on September 18 , 197 8 B. Other Services Charges for other services shall be individually billed upon completion of each such service. C. Accountin4 Records On the basis of procedures established by the City Administra- tor, the City shall determine the costs and maintain adequate accounting records to substantiate charges billed to the Agency under this Agreement. III. SPECIAL CITY FUNDS In addition to the staff facilities and other services provided under this Agreement, the City will establish a Redevelopment Agency Administrative Fund with money appropriated by the City Council to the -Agency as a loan to be used and repaid upon such terms and con- ditions as the City Council may provide. If appropriate, the City will also establish a Redevelopment Revolving Fund. . IV. METHOD OF PAYMENT The Agency has many potential sources of revenues, most of which are available only for limited or special' --purposes. Once funds become available from which the Agency may pay accrued costs for services provided under this Agreement, then such accrued costs shall be paid in a time and manner consistent with the needs of the Agency. Consistent with the Agency's needs, all or part of the accrued costs for staff services and facilities may be paid by the Agency from money appropriated by the City Council to the Redevelopment Agency Administrative Fund. Indebtedness incurred by the Agency under this Agreement, in- cluding amounts loaned to the Agency through the Redevelopment Agency Administrative Fund, the Redevelopment Revolving Fund, or from any other City source, shall accrue simple interest at the rate of six percent per annum until paid. If no funds become available to the Agency costs incurred under this Agreement, then such and shall be deemed a grant to the Agency. -2- to pay the City for costs need not be paid, f AGREEMENT BETWEEN THE CITY OF AZUSA AND THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA, ESTABLISHING CERTAIN CITY -AGENCY RELATIONSHIPS THIS AGREEMENT is made this 20th day of August , 1979, by and between the CITY OF AZUSA, CALIFORNIA, (hereinafter referred to as the "City") and the REDEVELOPMENT AGENCY OF THE CITY OF AZUSA, (hereinafter referred to as the "Agency"). WHEREAS, pursuant to the California Community Redevelopment Law (Health and Safety Code, Section 33000 et seq.) the City Council of the City of Azusa, on May 7, 1973, by Ordinance No. 1055, de- clared that there was a need for a redevelopment agency to function in the City; and WHEREAS, the City Council by Ordinance No. 1055 declared it- self to be the Agency, and such City Council members are serving as Agency members; and WHEREAS, the Agency is and shall remain as a separate public body, corporate and politic, exercising governmental functions and. performing a public function of the City; and WHEREAS, the Agency desires to use the staff and facilities of the City, and to provide for reimbursement of the City's costs in providing such staff and facilities. NOW, THEREFORE, it is agreed between the parties hereto as follows: I. SERVICES'TO BE PROVIDED A. Administrative Staff The City, its officers and employees shall provide administra- tive staff services for the Agency in carrying out the Agency's redevelopment activities. The Agency members have adopted and will adopt Bylaws and other regulations to carry into effect the powers, purposes and functions of the Agency and to establish the policies of the Agency.members for the guidance of City staff in providing services to the Agency. The Agency's Bylaws designate the City Clerk as Secretary, the City Administrator as the Executive Director, and;�the,-City`Tieasurer- as Treasurer. Such officers shall serve the City and the Agency in a dual capacity. The City Administrator/Executive Director shall determine and establish the procedures to be followed in the requesting and ren- dering of staff services to the Agency. No City officer or employee shall be paid extra compensation for any work performed for the Agency unless such compensation is expressly authorized and provided for by the City Council. B. Facilities The Agency shall have access to and use of the facilities of the departments and offices of the City. The principal office of the Agency shall be located in the City Hall of the City of Azusa. The City shall provide to the Agency such space for business offices and meeting rooms as the City Administrator/Executive Director may determine to be neces- sary. Such space shall include the use of the Council Chambers of the City Hall for Agency business meetings.
