HomeMy WebLinkAboutResolution No. 15RESOLUTION NO. 15 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA AUTHORIZING TRANSMISSION OF THE PROPOSED FIRST AMENDMENT TO THE REDE- VELOPMENT PLAN FOR THE AZUSA CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT TO THE FISCAL REVIEW COMMITTEE WHEREAS, the Redevelopment Agency of the City of Azusa has prepared a proposed First Amendment to the Redevelopment Plan for the Azusa Central Business District Redevelopment Project; and WHEREAS, the County of Los Angeles may call for the creation of a fiscal review committee with respect to the proposed Amend- ment to the Azusa Central Business District Redevelopment Plan, pursuant to Section 33353 of the California Community Redevelop- ment Law (Health and Safety Code Section 33000 et seq.); and WHEREAS, pursuant to Section 33353.4 of the California Com- munity Redevelopment Law the Agency shall send said proposed Amendment to the Redevelopment Plan to the representative of Los Angeles County to such fiscal. review committee. NOW, THEREFORE, the Redevelopment Agency of the City of Azusa does hereby resolve as follows: The Executive Director of the Redevelopment Agency is hereby authorized and directed to transmit the proposed First Amendment to the Redevelopment Plan for the Azusa Central Business District Redevelopment Project to the representative of Los Angeles County on the fiscal review committee,. if such a committee is created with respect to said proposed Amendment to the Redevelopment Plan. PASSED, APPROVED AND ADOPTED THIS 23rd DAY OF April , 1979. ;. ��_ ( r/ ATTEST: r. fi LE PROPOSED FIRST AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE /-A AZUSA CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT April, 1979 REDEVELOPMENT AGENCY OF THE CITY OF AZUSA AZUSA, CALIFORNIA PROPOSED FIRST AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE AZUSA CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT The Redevelopment Plan for the Azusa Central Business District Redevelopment Project is hereby amended as herein- after set forth: AMENDMENT NO. 1 Section 200, PROJECT AREA BOUNDARY, is hereby amended by adding after the legal description of Area 3, the legal descriptions of Areas 4 through 10 inclusive, as set forth in the Description of Areas 4 through 110C attached hereto and incorporated her as Exhibit "A". AMENDMENT NO. 2 Section 405, Residential, the first full paragraph thereof, is hereby amended to read in its entirety as follows: The area shown on the Map for Residential uses shall be used for medium to high density residential uses which conform with. the General Commercial and Central Business District uses adjacent to such areas; pro- vided however that Areas 4 through 8 inclusive shall be used for low to high density residential uses. AMENDMENT NO. 3 Section 415, Limitation on the Number of Buildings, is hereby amended to read in its entirety_as follows: The approximate number of buildings in the Project area shall not exceed 800. 0 0 AMENDMENT NO. 4 Section 416, Approximate Number of Dwelling Units, is hereby amended to read in its entirety as follows: The number of dwelling units in the Project area shall not exceed approximately 1500. AMENDMENT NO. Section 502, Tax Increments, the third from last full paragraph thereof in the adopted Redevelopment Plan, is hereby amended to read in its entirety as follows: The number of dollars of taxes, exclusive of the amount of such taxes attributable to Areas 4 through 8 inclusive, which may be divided -and allocated to the Agency pursuant to California Health and Safety Code Section 33670 shall not exceed Nineteen Million Four Hundred Thousand Dollars ($19,400,000) except by amend- ment of this Redevelopment Plan. The number of dollars of taxes, including the amount of taxes attributable to Areas 4 through 8 inclusive, which may be divided and allocated to the Agency pursuant to California Health and Safety Code Section 33670 shall not exceed Sixty Million Dollars ($60,000,000) except by amendment of this Redevelopment Plan. AMENDMENT NO. 6 Section 502, Tax Increments, is hereby amended by adding as the last full paragraph thereof, the following provi- sion: The Agency does not intend to use taxes allocated to the Agency pursuant to this Section 502 which are attributable to Areas 4 through 8 inclusive of the Pro- ject area to finance or refinance the Redevelopment Project. The Agency shall take such actions as are nec- cessary or appropriate to relinquish the amount of such taxes attributable to Areas 4 through 8 inclusive to the affected taxing agencies. Notwithstanding the foregoing provision, the relinquishment by the Agency of the amount of taxes attributable to Areas 4 through 8 inclusive shall be subordinate to any pledge of tax increments from the Redevelopment Project to pay any portion of the principal and/or interest of any bond or bonds issued or sold by the Agency. The Agency shall in good faith diligently attempt to market such bond or bonds in a manner such that sufficient tax increments remain available, after -2- 0 0 the first pledge of tax increments to the bond holders, to reimburse the appropriate affected taxing agencies the amount of taxes attributable to Areas 4 through 8 inclusive. AMENDMENT NO. 7 Section 500, METHODS FOR FINANCING THE PROJECT, is hereby amended by adding thereto Section 504, Mort a e Revenue Bonds: Use of Certain Funds, as hereinafter set fort : D. IS 504] Mortgage Revenue Bonds: Use of Certain Funds The Agency is empowered under the Redevelopment Law and the provisions of this Redevelopment Plan to issue revenue bonds for the purpose of financing certain residential con- struction. All funds derived by the Agency from financing residential construction within Areas 4 through 8 inclusive of the Project area which are in excess of the Agency's costs of implementing such financing, shall be used by the Agency for the purposes of increasing and improving the City's supply of housing for persons and families of low or moderate income and very low income households. In carrying out the purposes of this Section, the Agency may exercise any or all of its powers, including the following: 1. Acquire land or building sites. 2. Improve land or building sites with on- site or offsite improvements. 3. Donate land to private or public persons or entities. 4. Construct buildings or structures. 5. Acquire buildings or structures. 6. Rehabilitate buildings or structures. 7. Provide subsidies to or for the benefit of persons or families of very low, low, or moderate income. 8. Develop plans, pay principal and interest on bonds, loans, advances or other indebt- edness, or pay financing or carrying charges. -3- 0 0 The Agency may use the funds referred to in this Section to meet, in whole or in part, the provisions of Sections 332 and 333 of this Redevelopment Plan. AMENDMENT NO. 8 The Redevelopment Plan Map adopted on September 18, 1978 by Ordinance No. 2062 is hereby deleted and the Redevel- opment Plan Map attached hereto and incorporated herein as Exhibit "B" is hereby substituted in lieu thereof. -4- EXHIBIT "A" 0 DESCRIPTION OF AREAS 4 THROUGH 10 INCLUSIVE AREA 4 .. That portion of Lot 56 of said Subdivision No. 2 of Azusa Land and Water Co. in the City of Azusa, County of Los Angeles, State of California, as per map recorded in Book 43, Page 94 of Maps. in the Office of the County Recorder of said County described as follows:. Beginning at the intersection of the Westerly lot line of said Lot 56 and Tenth Street, 60 feet wide; thence East 650 feet along the Northerly right-of-way of said Tenth Street to a point; thence North 160 27' 45" West a distance of 932.02 feet to a point on the Northerly right-of-way of Sierra !Jadre Boulevard, 100 feet wide; thence Northeasterly along the Southerly right-of-way of said Sierra ?cadre Boulevard, 430.18 feet to a curve that is concave Northeasterly and having a radius of 25.00 feet; thence along said curve South- easterly 36.07 feet through an are of 820 34' 00" to a line which is the most Westerly line of Vernon Avenue,•100 feet wide; thence South 290 37' 42" East 905.62 feet to a'curve concave Southwesterly having a radius -.of 460.53 feet; thence along said curve Southwesterly 180.20 feet through an are of 220 37' 43" to a curve concave South- westerly having a radius of 25.00 feet; thence along said curve Southwesterly 42.31 feet through an are of 960 57' 38" to a line which is the most Northern rigbt-of-way line of Tenth Street; thence West along said right -of -wap line 662.83 feet to the point of beginning. AREA 5 All of Tract 20894 in the City of Azusa, County of Los Angeles, State of California, as per map recorded in Book 903, Pages 75-80 of Maps in the Office of the County Recorder of said County described as follows: Beginning at the Southeast corner of Lot 24, Tract 20894, as recorded in Book 903, Pages 75-80 of Official Naps of Los Angeles County Recorder; thence North 00 33' 04" East 885.83 feet to the Southeast corner of Lot 1, Tract 20894; thence North 400 29' 16" West a distance of 79.77 feet to the Southerly right-of-way of Sierra Madre Boulevard, 100 feet wide; thence Southeast along the 0 0 Southerly right-of-way of said Sierra Madre Boulevard 486.33 feet to a curve concave Southwesterly having a radius of 25.00 feet; thence along said curve Southwesterly 40.05 feet through an arc of 910 46' 39" to a line which is the most Easterly line of Vernon Avenue, 100 feet wide; thence South 290 37' 541, East a distance of 729 feet, more or less, to a curve that is concave Southeasterly and having a radius of 25.00 feet; thence along said curve 36.96 feet through an arc of 840 42' 32" to a line which is the most Northerly.. right-of-way line of Tenth Street; thence along said.
