RESOLUTION NO. 189
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
REDEVELOPMENT AGENCY OF THE CITY OF AZUSA
DENYING THE APPLICATION OF GNS PETROLEUM, FOR
USE OF CERTAIN PROPERTY WITHIN THE AZUSA WEST
END REDEVELOPMENT PROJECT AREA AS A FACILITY
FOR STORAGE AND DISTRIBUTION OF USED MOTOR OIL
WHEREAS, Section 331 of the Redevelopment Plan of
the Azusa West End Redevelopment Project (hereinafter
"Redevelopment Plan") and other applicable law provide that
all real property in the Project Area shall be subject to
the controls and requirements of the Redevelopment Plan and
that no real property shall be developed, rehabilitated, or
otherwise changed after the date of the adoption of the
Redevelopment Plan, except with the approval of the Agency
and in conformance with the provisions of the Plan; and
WHEREAS, Section 333 of the Redevelopment Plan and
other applicable law provide that no use or structure shall
be permitted in any part of the Project Area which would be
incompatible with the surrounding areas, structures or uses
because of appearance, traffic, smoke, glare, noise, odor or
similar factors; and
WHEREAS, GNS Petroleum as the lessee and Metro
Steel Inc. as the lessor have applied to the Agency for
approval to use certain property located within the Azusa
West End Redevelopment Project Area generally located on the
northwest corner of Gladstone Street and Irwindale Avenue,
and more particularly described on Exhibit "A" attached
hereto and incorporated herein by reference (hereinafter
"Subject Property") as a facility for storage and
distribution of used motor oil.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
DIRECTORS OF THE AZUSA REDEVELOPMENT AGENCY AS FOLLOWS:
SECTION 1. The Board of Directors of the Azusa
Redevelopment Agency hereby finds, determines and declares
that:
A. The proposed use of Subject Property as a
facility for storage and distribution of used
motor oil is not compatible with the heavy
industrial usage sought by the Redevelopment
Plan in Section 314 in that the facility would
only have a maximum of five employees present
which is inconsistent with the Plan's purpose
of eliminating social and economic blight by
developing labor intensive industries in the
area be they of heavy industrial or light
industrial character;
B. The use of the Subject Property as a facility
for storage and distribution of used motor oil
is incompatible with the surrounding areas and
uses because of appearance, traffic, noise,
odor and similar factors. The facility would
most likely generate a substantial amount
truck traffic carrying oil and potententially
hazardous substances. The facility would be
unsightly even for an industrial area because
it will consist of oil storage tanks and a
trailer. The facility would also smell bad
given the nature of the products stored
there. These effects would have a serious
adverse effect upon the Agency's ability to
encourage labor intensive and research and
development uses within the Project Area in
that employers would not be comfortable in
locating labor intensive uses in an area close
to a facility such as the GNS facility which
would generate noise, odor, truck traffic and
unsightly conditions. The site is also a
major entry -way to the West End Project Area
and will set the tone for future development
within the area, and, thus, the GNS facility
at this location would adversely affect the
Agency's ability to attract the labor
intensive industries that the Redevelopment
Plan contemplates for this area;
C. The problems with the use as proposed cannot
be alleviated by conditioning the project.
SECTION 2. The Board of Directors of the Azusa
Redevelopment Agency based upon the findings set forth in
Section 1 of this Resolution hereby denies the application
of GNS Petroleum for use of the Subject Property facility
for storage and distribution of used motor oil.
SECTION 3. The Secretary shall certify the
adoption of this resolution.
