HomeMy WebLinkAboutResolution No. 4150 0 RESOLUTION NO. 415 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA AUTHORIZING THE REMOVAL OF HAZARDOUS WASTES AND CONTAMINATED SOIL FROM CERTAIN AGENCY PROPERTY AND AWARDING A CONTRACT FOR SUCH WORK THE BOARD OF DIRECTORS OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Board of Directors of the Redevelopment Agency of the City of Azusa does hereby find, determine and declare that: A. The Agency recently purchased property for a road on a site adjacent to 521 East Foothill Boulevard within the City of Azusa. A contract was let to Sully -Miller Construction Company for the construction of the roadway improvements. B. On November 4, 1987, the contractor in the course of constructing the roadway discovered that the subsurface cistern, which was thought to have only contained water at one time, actually contained hazardous substances which during the course of demolition leaked out of the cistern and contaminated a portion of the surrounding soil. During demolition the top of the cistern was destroyed leaving the hazardous substances within the cistern exposed to the atmosphere. C. The uncovering and partial destruction of the cistern and exposure of the hazardous substances, has created an immediate threat to the lives, health and property of persons in the community. The early rainy season could cause the open cistern to fill with water and wash out the hazardous substances, allowing their disposition onto other land, thus creating significant health hazards and a significant risk of liability to the Agency. The continued exposure of the hazardous substances to the atmosphere also creates a significant risk of health hazards as gasses could form within the cistern, leave its confines and drift over populated areas. Additionally, the leakage of hazardous substances from the damaged cistern could effect groundwater depending upon geologic conditions which are unknown at this time. D. The Agency is not required to comply with the specific bidding procedures of Sections 20160, et seq., of the Public Contracts Code pursuant to the authority set forth in Section 20688.2 0 0 of the Public Contracts Code. The Agency has, however, complied with those provisions in that it has solicited four bids from qualified contractors based upon plans and specifica- tions and will accept the lowest responsible bidder to perform the work. E. Based upon the above facts, the public interest and necessity demand the immediate expenditure of public money to clean up the hazardous substances in the cistern in order to safeguard life, health and property of the community. SECTION 2. The Board of Directors of the Redevelopment Agency of the City of Azusa hereby accepts the bid of Hekimian and Associates, Inc.and authorizes the Mayor to execute an agreement with said contractor for the clean up of the hazardous waste from the cistern in an amount not to exceed $15,000. SECTION 3. The Secretary shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 16th day of November , 1987.
