HomeMy WebLinkAboutResolution No. 5170 0 RESOLUTION NO. 517 A RESOLUTION OF THE CITY OF AZUSA REDEVELOPMENT AGENCY CERTIFYING AS TO ITS REVIEW OF THE FINAL ENVIRONMENTAL IMPACT REPORT WITH RESPECT TO THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AREA AND WEST END REDEVELOPMENT PROJECT AREA MERGER AND MAKING CERTAIN FINDINGS WHEREAS, the Planning Commission of the City of Azusa have reviewed and considered the Draft Environmental Impact Report prepared on the Central Business District Redevelopment Project Area and West End Redevelopment Project Area Merger; and WHEREAS, the Azusa Redevelopment Agency (the "Agency") has reviewed and considered the Final Environmental Impact Report ("Final Environmental Impact Report") for the Central Business District Redevelopment Project Area and West End Redevelopment Project Area Merger (the "Project"); and WHEREAS, pursuant to notice duly given, the Agency and the City Council of the City of Azusa have held a full and fair public hearing on the Redevelopment Plans for the Project Areas proposed to be merged and the Final Environmental Impact Report prepared thereon. NOW, THEREFORE, BE IT RESOLVED BY THE AZUSA REDEVELOPMENT AGENCY AS FOLLOWS: SECTION 1. A full and fair public hearing having been held on the Draft Environmental Impact Report on the Central Business District Redevelopment Project Area and West End Redevelopment Project Area Merger and the Agency having considered all comments received thereon, which comments and responses thereto are contained in the Final Environmental Impact Report, said Final Environmental Impact Report is hereby approved and adopted as the Final Environmental Impact Report for the Central Business District Redevelopment Project Area and West End Redevelopment Project Area Merger. SECTION 2. The Agency hereby certifies that the Final Environmental Impact Report for the adoption of the Merger as determined herein has been completed in compliance with the California Environmental Quality Act of 1970 ("CEQA") and the state and local environmental guidelines and regulations, and that it has reviewed and considered the Final Environmental Impact Report and the information contained therein in connection with the proposed Merger. SECTION 3. The Agency hereby finds with respect to the adverse environmental impacts detailed in the Final Environmental Impact Report: (a) That the adverse environmental impacts associated with the merger of the respective Redevelopment Plans for the redevelopment project areas proposed to be merged have been considered and recognized by the Agency. FJN/RES0305 • • (b) That comments and responses made during the public hearing of the Agency and City Council have been considered and recognized by the Agency and will be incorporated into the Final Environmental Impact Report. (c) That based on the information set forth in the Final Environmental Impact Report, the Agency finds and determines that measures to mitigate certain impacts related to geology and soil, air quality, drainage, vegetation and wildlife, noise, light and glare, land use, population and housing, traffic, public services, energy, utilities and cultural resources exist and are included in the Final Environmental Impact Report. (d) That as to certain adverse impacts associated with traffic and circulation, energy consump- tion and noise levels, the Agency finds and determines that specific economic, social and other considerations as documented in the Preliminary Report for the Central Business District Redevelopment Project Area and West End Redevelopment Project Area Merger, make infeasible the project alternatives identified in the Final Environmental Impact Report (Draft Environmental Impact Report Section 7.0). SECTION 4. The Agency hereby finds and determines that all potential impacts on the environment cannot be entirely or feasibly eliminated. The Agency hereby finds that the beneficial economic and social effects of the Project override such potential adverse impacts. SECTION 5. The Agency hereby finds and determines that measures have been incorporated into the amended Redevelopment Plans which will mitigate or avoid any significant environmental effects thereof that can feasibly be mitigated or avoided. SECTION 6. Since the preparation and certification of the Environmental Impact Reports for the Central Business District Redevelopment Plan and the West End Redevelopment Plan, subsequent changes have not been proposed in either Project Area, nor will substantial changes occur with respect to the circumstances under which the Project is undertaken, which will require important revisions of the previous Environment Impact Reports, due to the involvement of new significant environmental impacts which were not considered in the previous Environmental Impact Reports. Therefore, pursuant to the provisions of CEQA and, specifically, 14 California Administrative Code Sections 15162 and 15180, a Subsequent Environmental Impact Report is not required and the previous Environmental Impact Reports are adequate and sufficient to comply with the requirements of CEQA. SECTION 7. The Executive Director of the Agency, in cooperation with the City Clerk of the City of Azusa, is hereby authorized and directed to file with the County Clerk -2- FJN/RES0305 Ll of the County of Los Angeles, a Notice of Determination, pursuant to 14 California Administrative Code Section 15085(h). SECTION 8. This resolution shall take effect immediately upon its adoption. PASSED, APPROVED AND ADOPTED this 24thday of October 1988. EucVne F.
