HomeMy WebLinkAboutResolution No. 599i RESOLUTION NO. 599 RESOLUTION OF THE AZUSA COMMUNITY REDEVELOPMENT AGENCY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR REDEVELOPMENT PURPOSES AND ALL USES APPURTENANT THERETO (PARCELS 8608-22-17 & 18; REMINGTON/HERBERT) THE AZUSA COMMUNITY REDEVELOPMENT AGENCY DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The Azusa Community Redevelopment Agency ("Agency") finds, determines and declares: (a) That the pubic interest, convenience and necessity require the acquisition by said Agency of the fee interest in and to certain hereinafter described real property ("Property") for redevelopment purposes and all uses appurtenant thereto; and (b) That the project is planned or located in the manner that will be most compatible with the greatest public good and least private injury; and (c) That the Property is necessary for the project, to wit: The Casden/CoastFed CBD -1 Project, consisting of a minimum 135 -unit condominium -style luxury apartment complex; (d) That the taking of the Property is necessary to such use and is authorized by Section 19, Article I of the California Constitution, Section 16 of Article XVI of the California Constitution, Section 33000 et seg. of the California Health and Safety Code, and Sections 1240.010 through 1240.050 et seu. of the California Code of Civil Procedure and all other applicable laws; and (e) That the offer to purchase required to be made by California Government Code Section 7267.2 has been made to the owner of the Property. SECTION 2. The Agency hereby declares that it is the intention of said Agency to acquire said Property in its name in accordance with the provision of the laws of the State of California with reference to condemnation procedures. SECTION 3. That if any of the Property has been appropriated to some public use, the public use to which it is to be applied and taken under this proceeding is a more necessary and paramount public use. SECTION 4. The Property is located in the City of Azusa, County of Los Angeles, State of California, and is more particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference and made a part hereof. Maps showing the general location of the property sought to be acquired in this proceeding are marked Exhibit "B" and Exhibit "C" attached hereto and incorporated herein by reference and made a part thereof. SECTION 5. The Agency Attorney and the firm of Burke, Williams & Sorensen, as special counsel, are authorized and directed to prepare, institute, and prosecute in the name of the Agency such proceedings in the proper court having jurisdiction thereof as may be necessary for the acquisition of the Property described in Section 4 hereof. Said attorneys are also authorized and directed to obtain an Order of Court granting to said Agency the right of immediate possession and occupancy of said Property. ZONING: Li The subject property is currently zoned CBD, Central Business District, the provisions of which zone are contained in the Addenda section of this report. The zone allows most retail, commercial and office/professional uses, while it prohibits automotive and industrial uses without exception. The following excerpt from the ordinance best describes the intent: 19.27.010 SCOPE. The CBD zone is intended to serve the needs of the downtown area by allowing maximum ground coverage and expanding floor space and building height limitations for the purpose of concentrating the maximum variety of facilities for dispensing of commodities and rendering of services to the entire City. Residential uses in a mixed occupancy are permitted and encouraged in this zone. The areas for which this classification is intended are generally already developed and, in some instances, facing obsolescence and deterioration. The provisions of this classification are intended to encourage redevelopment of the land to its highest and best use. (Ord. 1035/2 (part), 1972: prior code/9223). A In Section 19.27.030, "Uses Prohibited", Item 1- indicates that Automotive repair uses, such as the improvements on the north one half of the subject are "prohibited without exception." Because the use preceded the zone, it is allowed to continue. It is, however, considered to be a legally nonconforming use, implications of which are discussed further under "Highest and Best Use". The two retail businesses, Azusa Glass and I & R Realtors and Tax Service, are legally conforming under the aforementioned ordinance. PRESENT USE AND OCCUPANCY: qM sm The subject property is improved with a one story concrete block structure containing 3,983 sf of building area. There are three tenants on the property: "Azusa Glass Shop", "I & R Realty & Tax Service" and 'Bob's Bug -In". Each is detailed individually for clarification purposes. Azusa Glass Shop: This business occupies approximately 1,845 sf of building area, 625 sf of which is the retail lobby, the balance serving as a work/storage area. The situs for this portion is 713 1/2 N. San Gabriel Avenue. The business is operated by Mr. Paul Remington, one of two co-owners of the subject property. Mr. Remington has been at this location for sixteen (16) years. A "book" rent of $800 per month is the rental rate. DONAHUE & COMPANY 82 PRESENT USE AND OCCUPANCY (Cont.): 1 & R Realty & Tax Service: Mr. Angel Raygoza leases 625 sf of retail space for his business. He pays $400 per month and all expenses except water, insurance and exterior maintenance and repair. He is in the third year of a five year lease which commenced February 8, 1986. Bob's Bug -In: Mr. Robert McClintock is the lessee having executed a five year lease on December 20, 1987. He pays $400 per month for 1,500± sf of building area, modified gross. The lessor pays for insurance, water and exterior maintenance and repair while the lessee is responsible for all other expenses. Mr. McClintock builds fiberglass dune buggies. HIGHEST AND BEST USE "As if Vacant": The 7,000 sf site has excellent visibility from San Gabriel Avenue, as well as a limited amount from Foothill Boulevard. Access from the public alley which adjoins the west elevation of the lot is more than adequate. The CBD zoning is liberal enough to allow for a number of retail and commercial uses. Traffic counts along San Gabriel Avenue indicate amounts which are conducive to retail development. Therefore, considering the legal, physical and economic ramifications, the Highest and Best Use for the subject property, "As if Vacant" is for a retail development consistent with the environs and physical characteristics of the site. HIGHEST AND BEST USE "As Improved": The subject property is improved with a 3,983± sf mixed use concrete block building. It has fifty (50) ft. of linear frontage along San Gabriel Avenue, one of the major roadways in Azusa. Public records indicate that the improvements were built in two pans: the automotive shop in 1947 and the retail/glass shop in 1953. As improved, the subject serves the needs of its three tenants while providing a reasonable economic return to the owners with a minimum amount of expenses. Although the automotive use is prohibited by the underlying zone, its existence is not currently threatened by any moratorium or pending abatement. The remaining economic life of the structure is sufficient in length so as not to require rehabilitation at this time. The building has been well maintained, with a new roof and paint in recent years. Considering the aforementioned data, Highest and Best Use for the 3,983 sf mixed use structure is "As Improved". Area Content: 7,000 sf; 0.16± acres Access: Vehicular access is via a 20 ft. wide public alley which adjoins the west boundary. Pedestrian access is also available from San Gabriel Avenue. 0 Utilities: All utilities are available and connected to the site. Easements: A title report was provided for the purposes of this appraisal, a copy of which is included in the Addenda section of this report. A utility easement therein has no adverse affect on value. Soils, Drainage & Toxic Waste: No soils report was provided; no abnormal conditions were apparent on the site. Normal drainage is to the east elevation. Per the ownership, no hazardous materials have been transported to or from nor are any stored at the site. Improvements The subject property is improved with a one story concrete block structure of mixed use and age. Approximately 1,250 sf of the property is retail frontage with the balance being utilized for various shop purposes. Please refer to 'Present Use and Occupancy" for a detailed breakdown of usages, building area and tenancy. Built in about 1950±, the property is in average condition and constructed of average quality materials. It appears to have been well maintained, with new paint and a new roof in the last four years. Proposals from Owner Participants are due by Friday, November 14, 1986, at 12:00 p.m. As stated in the RFP, a pre -proposal conference will be held on October 3, 1986 at 9:00 a.m. to discuss the requirements of the RFP and your rights as an owner participant. As a preliminary expression of your participatory interest, enclosed is a one-page statement of interest in participation along with a copy of the "Rules Governing Participation and Re - Entry Preferences for Property Owners, Operators of Businesses, and Tenants". The proposed project contemplates approximately 141 multi -family residential units. Before this project proceeds, however, a number of tasks must be accomplished.
