HomeMy WebLinkAboutResolution No. 598RESOLUTION NO. 598 RESOLUTION OF THE AZUSA COMMUNITY REDEVELOPMENT AGENCY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR REDEVELOPMENT PURPOSES AND ALL USES APPURTENANT THERETO (PARCEL 8608-22-13; LUDWIG) THE AZUSA COMMUNITY REDEVELOPMENT AGENCY DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The Azusa Community Redevelopment Agency ("Agency") finds, determines and declares: (a) That the pubic interest, convenience and necessity require the acquisition by said Agency of the fee interest in and to certain hereinafter described real property ("Property") for redevelopment purposes and all uses appurtenant thereto; and (b) That the project is planned or located in the manner that will be most compatible with the greatest public good and least private injury; and (c) That the Property is necessary for the project, to wit: The Casden/CoastFed CBD -1 Project, consisting of a minimum 135 -unit condominium -style luxury apartment complex; (d) That the taking of the Property is necessary to such use and is authorized by Section 19, Article I of the California Constitution, Section 16 of Article XVI of the California Constitution, Section 33000 et seq. of the California Health and Safety Code, and Sections 1240.010 through 1240.050 et seg. of the California Code of Civil Procedure and all other applicable laws; and (e) That the offer to purchase required to be made by California Government Code Section 7267.2 has been made to the owner of the Property. SECTION 2. The Agency hereby declares that it is the intention of said Agency to acquire said Property in its name in accordance with the provision of the laws of the State of California with reference to condemnation procedures. SECTION 3. That if any of the Property has been appropriated to some public use, the public use to which it is to be applied and taken under this proceeding is a more necessary and paramount public use. SECTION 4. The Property is located in the City of Azusa, County of Los Angeles, State of California, and is more particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference and made a part hereof. Maps showing the general location of the property sought to be acquired in this proceeding are marked Exhibit "B" and Exhibit "C" attached hereto and incorporated herein by reference and made a part thereof. SECTION 5. The Agency Attorney and the firm of Burke, Williams & Sorensen, as special counsel, are authorized and directed to prepare, institute, and prosecute in the name of the Agency such proceedings in the proper court having jurisdiction thereof as may be necessary for the acquisition of the Property described in Section 4 hereof. Said attorneys are also authorized and directed to obtain an Order of Court granting to said Agency the right of immediate possession and occupancy of, said Property. The zone allows most retail, commercial and office/professional uses, while it prohibits automotive and industrial uses without exception. The following excerpt from the ordinance best describes the intent: r" 19.27.010 SCOPE. The CBD zone is intended to serve the needs of the downtown area by allowing maximum ground coverage and expanding floor space and building height limitations for the purpose of concentrating the maximum variety of facilities for dispensing of commodities and rendering of services to the entire City. Residential uses in a mixed occupancy are permitted and encouraged in this zone. The areas for which this classification is intended are generally already developed and, in some instances, facing obsolescence and deterioration. The provisions of this classification are intended to encourage redevelopment of the land to its highest and best use. (Ord. 1035/2 (part), 1972: prior code/9223). PRESENT USE AND OCCUPANCY: The subject property is owner occupied; operating as `Commercial Sewing Machine Company'. It has a small retail lobby for walk-in business as well as a service shop ' operated in the rear of the building. Mr. James Todd owns both the business and the real estate. HIGHEST AND BEST USE "As if Vacant": While zoning and access are considered adequate for independent development, the subject parcel's size and shape relationship is somewhat irregular. It would, however, be sufficient to serve a number of retail/commercial users. Visibility and traffic counts from San Gabriel Avenue indicate that the site has good potential for small office development. Although parking is limited on the major frontage, a 20 ft. wide public alley on the north boundary increases access to any onsite parking which would be established. Therefore, the Highest and Best Use for the 5,250 sf, trapezoidal parcel is office/retail development consistent with the underlying CBD zone. The subject property is presently improved with a single family residence converted for use as "The Commercial Sewing Machine Company" . It was built in 1910 and contains 340 sf of building area. Although a potential source of income for the property's owner, the improvements are nearing the end of their economic life. While renovation is a possibility, costs incurred may exceed a reasonable limit for 46 . NAHUE & COMPAt. INC. 63 HIGHEST AND BEST USE "As Improved (Cont.): this type of structure. When the value of the land overtakes the value of the improvements, economic obsolescence becomes a factor. A market study of comparably improved uses indicated that properties like the subject are purchased regularly for investment purposes, and often left in their respective interim uses until such a time that development is feasible. "As Improved", the highest and best use is for the existing interim use for an estimated period of twelve months. PHYSICAL DESCRIPTION: Land Shape: Topography: Size: Area Content: Trapezoidal Level land at the normal elevation above street grade. 60 ft. x 140 ft. x 15 ft. x 147 ft. 5,250 sf, 0.12± acres Access: Access is available via a 20 ft. wide public alley which borders the north and west elevations. Utilities: All utilities are available and connected to the site. Easements: A title report furnished indicates a right of way for utilities which does not adversely affect the site value. Please see the title report in the Addenda section of this report for details. Soils, Drainage & Toxic Waste: A soils report was not provided for the purposes of appraisal, however, a storage shed on the west portion of the property appeared to contain oils, paints, etc. which may be toxic in nature. No information was provided by the ownership in this matter. No soil conditions were apparent that might affect value. Normal drainage is to the east elevation. • NAHUE & COMPANY, INC. The proposed project contemplates approximately 141 multi -family residential units. Before this project proceeds, however, a number of tasks must be accomplished. For instance, the Agency must conduct soils tests to determine that the site will accommodate_ the proposed development and that no soils contamination exists. The Agency will need your cooperation to ensure a quick decision on the project. Most of you will be principally concerned with the Agency's process of acquisition and relocation. We would like to start a formal dialogue with you regarding the property acquisition, process and your relocation rights and benefits. Initially, the Agency has scheduled a group meeting to discuss the project and its implications for the affected owners and tenants.
