HomeMy WebLinkAboutResolution No. 597q1 6 RESOLUTION NO. 597 RESOLUTION OF THE AZUSA COMMUNITY REDEVELOPMENT AGENCY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR REDEVELOPMENT PURPOSES AND ALL USES APPURTENANT THERETO (PARCELS 8605-22-1 TO 4; SHAW/GONZALES) THE AZUSA COMMUNITY REDEVELOPMENT AGENCY DOES HEREBY MINE AND RESOLVE AS FOLLOWS: SECTION 1. The Azusa Community Redevelopment Agency ("Agency") finds, determines and declares: (a) That the pubic interest, convenience and necessity require the acquisition by said Agency of the fee interest in and to certain hereinafter described real property ("Property") for redevelopment purposes and all uses appurtenant thereto; and (b) That the project is planned or located in the manner that will be most compatible with the greatest public good and least private injury; and (c) That the Property is necessary for the project, to wit: The Casden/CoastFed CBD -1 Project, consisting of a minimum 135 -unit condominium -style luxury apartment complex; (d) That the taking of the Property is necessary to such use and is authorized by Section 19, Article I of the California Constitution, Section 16 of Article XVI of the California Constitution, Section 33000 et sea. of the California Health and Safety Code, and Sections 1240.010 through 1240.050 et sec. of the California Code of Civil Procedure and all other applicable laws; and (e) That the offer to purchase required to be made by California Government Code Section 7267.2 has been made to the owner of the Property. SECTION 2. The Agency hereby declares that it is the intention of said Agency to acquire said Property in its name in accordance with the provision of the laws of the State of California with reference to condemnation procedures. SECTION 3. That if any of the Property has been appropriated to some public use, the public use to which it is to be applied and taken under this proceeding is a more necessary and paramount public use. SECTION 4. The Property is located in the City of Azusa, County of Los Angeles, State of California, and is more particularly described in Exhibit "A" which is attached hereto and incorporated herein by reference and made a part hereof. A map showing the general location of the property sought to be acquired in this proceeding is marked Exhibit "B" attached hereto and incorporated herein by reference and made a part thereof. SECTION 5. The Agency Attorney and the firm of Burke, Williams & Sorensen, as special counsel, and are authorized and directed to prepare, institute, and prosecute in the name of the Agency such proceedings in the proper court having jurisdiction thereof as may be necessary for the acquisition of the Property described in Section 4 hereof. The present CBD zone prohibits automotive service stations, and although the subject's improvements preceded the zone ordinance, the economic life of the nonconforming use has been shortened. Although no moratorium or abatement has been placed on the property by the City of Azusa, the use is not consistent with the ?� desired pattern of development as outlined in the zone ordinance. Modernization necessary to elongate the economic life of the improvements has not been done and no intention of such a renovation was revealed to the appraiser. The improvements do, however, create an annual income to the landowner which in the interim does represent a temporary form of the site's highest and best use. The projected economic life of the improvements is at best estimated at two years, at which time a more financiallv feasible alternative would be recommended. PHYSICAL DESCRIPTION: Land Shape: Rectangular Topography: Level land at the normal elevation above street grade Size: 140 ft. x 150 ft. Area Content: 21,000 sf; 0.48± acres Access: This corner site has access from three of the four elevations. The east boundary fronts San Gabriel Avenue, a one way, southbound right of way 100 ft. in width. The south boundary fronts Foothill Boulevard, a rwo way street also 100 ft. wide. The third method of access is via a 20 ft. wide public alley which shirts the west property line. Utilities: All utilities are available and connected to the site. DONAHUE & COMPANY. The affect on value is discussed further in the Highest and Best Use analysis and valuation sections of this appraisal. oils, Drainage & Toxic Waste: tri Improvements A soils report was not provided to the appraiser for the Purpose of this appraisal. The subject property, having been utilized as a service station for the past 23± years, is to be considered suspect in the matter of hydrocarbon toxic wastes. No responsibility is assumed by the appraiser for the existence of such, nor for the estimation of costs of removal and/or dis osal thereof. The subject property is improved with a full service automotive service station known as `Khalaf Exxon`. There are three service bays and two pumping islands; one full service and one self serve. Public records indicate that the improvements were built in 1966 and that the building area is 1,608 square feet. Measurements taken onsite affirm this figure. The ranch style station has a stone fascia on a metal butler building. In addition to the three service bays the main structure also contains two rest rooms, a lobby, an office and a battery/supplies storage area. Please refer to the Plot Plan for specific dimensions and lavout. The station dispenses three ivpes of gasoline from sir pumps and a total of eight nozzles. These dispensers appear to be new. Each of the two canopies measures 26 ft. x 35 ft. with an 11 ft. 6 in. clearance. The cement pads underneath the two canopies measure 27 ft. x 23 ft. The public hearing considers the proposal to construct 135 residential units on the site west of San Gabriel Avenue. Shaw 9932 Live Oak Temple City, CA 91780 City Of Azusa Subject: Proposed Meeting With Agency, Exxon, Property Owners Dear Mr. and Mrs. Shaw: The Agency contacted Bob Smith with Exxon to schedule a joint meeting to resolve certain issues related to the property acquisition. -However, Bob Smith prefers to defer a meeting until the relevant corporate officials at Exxon can review the leasehold situation. As you realize, Exxon is a key player in resolving the complicated situation and their involvement is essential. Exxon's response time appears to be rather deliberate so it is unknown when a meeting can be scheduled. In addition, the other affected property owner has not contacted us making a comprehensive settlement impossible. Because time is of the essence for the Agency and because the hearing was already continued for two weeks, it is necessary to maintain the July 3rd hearing date. The Agency apologizes for the scheduling, but regardless of the outcome on July 3rd, we will continue to negotiate in good faith with all of the parties involved.
