HomeMy WebLinkAboutResolution No. 702RESOLUTION NO. 702 RESOLUTION OF THE AZUSA COMMUNITY REDEVELOPMENT AGENCY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR REDEVELOPMENT PURPOSES AND ALL USES APPURTENANT THERETO (SANTA FE AVENUE BETWEEN AZUSA AND SAN GABRIEL AVENUES) THE AZUSA COMMUNITY REDEVELOPMENT AGENCY DOES DETERMINE AND RESOLVE AS FOLLOWS: HEREBY SECTION 1. The Azusa Community Redevelopment Agency ("Agency") finds, determines and declares: (a) That the public interest, convenience and necessity require the acquisition by said Agency of the fee interest in and to certain hereinafter described real property ("property") for redevelopment purposes and all uses appurtenant thereto; and (b) That the project is planned or located in the manner that will be most compatible with the greatest public good and least private injury; and (c) That the Property is necessary for the project, to wit: The DeRosa/Centennial Square CBD -1 Project, consisting of approximately a 52,000 square foot retail and office center. (d) That the taking of the Property is necessary to such use and is authorized by Section 19, Article I of the California Constitution, Section 16 of Article XVI of the California Constitution, Section 33000 et sea. of the California Health and Safety Code, and Sections 1240.010 through 1240.050 et sea. of the California Code of Civil Procedure and all other applicable laws; and (e) That the offer to purchase required to be made by California Government Code Section 7267.2 has been made by the owner of the Property. SECTION 2. The Agency hereby declares that it is the intention of said Agency to acquire said Property in its name in accordance with the provision of the laws of the State of California with reference to condemnation procedures. SECTION 3. That if any of the Property has been appropriated to some public use, the public use to which it is to be applied and taken under this proceeding is a more necessary and paramount public use. SECTION 4. The property is located in the City of Azusa, County of Los Angeles, State of California, and is more particularly described in Exhibit "A" which is attached hereto. A Map showing the general location of the property sought to be acquired in this proceeding is marked Exhibit "B" and attached hereto and incorporated herein by reference and made a part thereof. SECTION 5. The Agency Attorney and the firm of Burke, Williams & Sorensen, as special counsel, and are authorized and directed to prepare, institute, and prosecute in the name of the Agency such proceedings in the proper court having jurisdiction thereof as may be necessary for the acquisition of the Property described in Se Aon 4 hereof. Said atorneys are also authorized and directed to obtain an Order of Court granting to said Agency the right of immediate possession and occupancy of said Property. SECTION 6. The Secretary shall certify to the adoption of this Resolution. SECTION 7. This Resolution shall be effective immediately upon its adoption. APPROVED AND ADOPTED THIS 16th day of April , 1990. Article 4. Measure of Compensation for Property Taken. 1263,320 (a) The fair market value of the property taken is the highest price on the date of valuation that would be agreed to by a seller, being willing to sell but under no particular or urgent necessity for so doing, nor obliged to sell, and a buyer, being ready, willing, and able to buy but under no particular necessity for so doing, each dealing with the other with full knowledge of all the uses and purposes for which the property is reasonably adaptable and available. (b) The fair market value of the property taken for which there is no relevant market is its value on the date of valuation as determined by any method of valuation that is just and equitable. Mr. Robb Steel 2- March 22, 1989 1263.330 Exclusions from fair market value The fair market value of the property taken shall not include any increase or decrease in the value of the property that is attributable to any of the following: (a) The project for which the property is taken. (b) The eminent domain proceeding in which the property is taken. (c) Any preliminary actions of the plaintiff relating to the taking of the property. Please note that, according to part (a) as bolded above, no project can be considered in the valuation of real property. The Centennial Square project, which causes the aforementioned abandonment, creates undue influence in this matter. Short of this project, there is no reasonable probability of the street section being vacated, as would the parcel's vacation eliminate a source of access for those who benefit from its presence. The vacation of the street is also without consequence to the AT & SF property abutting the street. The AT & SF property enjoys an alternate form of public access which is considered to be adequate.
