HomeMy WebLinkAboutResolution No. 93-R160 RESOLUTION NO. 93-R16 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA RECERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT/ENVIRONMENTAL IMPACT STATEMENT AND APPROVING THE NEGATIVE DECLARATION FOR THE PROPOSED DDA WITH HLC CORP. THE BOARD OF DIRECTORS OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SECTION 1. The Board of Directors of the Redevelopment Agency of the City of Azusa does hereby find, determine, and declare as follows: A. On or about September 18, 1978, the City Council of the City of Azusa adopted the Redevelopment Plan for the Azusa Central Business District Redevelopment Project (the "Project"); and B. On or about September 18, 1978, the Board of Directors of The Redevelopment Agency of the City of Azusa ("Agency") certified and approved the Final Environmental Impact Report for the Project pursuant to the California Environmental Quality Act of 1970, Public Resources Code §21000 et sea. ("CEQA") and the National Environmental Protection Act of 1969, 16 U.S.C. Sections 840 et seq. ('NEPA"). Subsequent Environmental Impact Reports ('BIR") were prepared for amendments to the Project EIR and were certified and approved by the Board on or about July 2, 1979, July 21, 1981, November 28, 1983, December 17, 1984, and November 7, 1988. C. The Agency subsequently initiated a proposal to redevelop certain parcels (the "Site") within the Project Area (the "Project") for a 141 unit residential project and the Agency was determined to be the 'lead agency" for the Project; and D. The proposed redevelopment of the Site contained features or impacts which required important revisions to the previously approved EIRs or new, significant environmental impacts not previously considered in the previous EIRs on the Project; and E. The Agency prepared an Initial Study of the environmental impacts of the Project, caused to be prepared a Draft Environmental Impact Report ("DEIR") and a Final Environmental Impact Report/Environmental Impact Statement ("final EIA/EIS") in accordance with the provisions of CEQA, State and local CEQA Guidelines and NEPA; and F. The DEIR for the Project was made available for public review and 0 0 comment in accordance with CEQA, NEPA and other applicable law. SECTION 2. The Agency hereby certifies that the information contained in the final EIR/EIS, including but not limited to all comments on the DEIR and the responses thereto, was reviewed, considered, and certified by the members of the Agency by Resolution No. 472 adopted on July 5, 1988. SECTION 3. The proposed project has been reduced in scope to include 41 single- family dwelling units. Consequently, the environmental impacts have been reduced in many cases. The Agency has reviewed the previous EIS/EIR and has completed an Initial Study to determine any new or increased environmental effects caused by the revised project. SECTION 4. The final EIR/EIS and the Initial Study/Negative Declaration have identified the following significant effects but in response to each significant effect so identified, the Project has been altered to avoid or substantially lessen the environmental effects as set forth in the FEIR and the Negative Declaration as summarized below: A. Soils, Geology and Topography. The Project does not contemplate development activity that would substantially alter topographic features. The mitigation measures to enhance seismic safety as described on pages 53-64 of the CBD Redevelopment Project EIR shall be implemented. B. Air OualitX. Air Quality impacts associated with the proposed Project will not differ substantially from those addressed on pages 52-56 of the CBD Redevelopment Project EIR, which concluded that there would be no significant adverse effect on air quality. The Project is expected to generate an incremental increase in air pollutants. The mitigation measures to improve air quality as set forth on page 64 of the CBD Redevelopment Project EIR shall be implemented. C. Hydrology. The project will have no flood hazard or water quality impacts. The measures to reduce existing dam inundation potential identified on pages 62-63 of the CBD Redevelopment Project EIR shall be implemented. D. Biota. The Project will involve no significant impact on biota and therefore 2 RESO/HLC RECERT/3/15/93 0 0 no mitigation measures are required. E. Traffic and Circulation. No adverse impacts were expected to result from the previously proposed 141 unit apartment project. By reducing the units from 141 to 41, the Initial Study/Negative Declaration determined that traffic impacts would be further reduced to a level of insignificance. F. Cultural Resources. Although there is low potential for the existence of cultural resources at the project Site, the mitigation measures identified on Page 62 of the CBD Redevelopment Project EIR will be implemented if cultural remains are uncovered during grading. G. Noise. The Project has been changed or altered to avoid or substantially lessen the potential effects on noise by requiring the following: (1) To provide an acceptable noise environment for residential and nonresidential uses, one or more of the following options should be exercised: (a) Increase distance from noise sources. (b) Use of sound attenuating construction materials. (c) Construction of noise screening walls; (2) Site preparation and construction activities should be limited to the daylight hours between 7:00 a.m. - 7:00 p.m. Construction equipment should be properly and adequately mufflered. Pumps, compressors, and generators should be kept away from existing residential areas, and construction traffic should be routed away from existing residential areas as much as possible. H. Land Use. The Project does not require amendment of the General Plan and the Redevelopment Plan to allow new permitted residential uses within the Project Area. I. Public Services and Utilities. The Project will increase incrementally the demand for public services and utilities, and will require the relocation of existing utility lines. 3 RESO/HLC RECERT/3/15/93 0 0 The Project has been changed or altered to avoid or substantially lessen the effects on public services and utilities by requiring the following: (1) All new development will comply with current fire codes and City ordinance requirements. (2) Adequate security design measures should be required for all new development based upon Police Department recommendation. (3) School District impact can be mitigated by the payment of developer fees pursuant to Government Code Section 53080 and 65995. (4) Appropriate procedures for the relocation and protection of utility lines shall be established through ongoing coordination with affected utility agencies. (5) A 24 -inch storm drain will be constructed as part of the Project to provide adequate drainage. SECTION 4. The Agency finds that the mitigating changes which will be incorporated into the Project and discussed above will avoid or substantially lessen the significant effects identified in the final EIR. SECTION 5. In view of the foregoing, the Board of Directors of the Redevelopment Agency of the City of Azusa hereby re -certifies that the final EIR/EIS for the Project has been completed in accordance with the provisions of CEQA and applicable state and local guidelines, and hereby certifies and approves the Negative Declaration for the Project. The Secretary is hereby directed to file a Notice of Determination in the manner required by law. 4 RESO/HLC RECERT/3/15/93 0 0 SECTION 6. The Secretary shall certify the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 19th day of April 1993.
