HomeMy WebLinkAboutResolution No. 94-R570 0 RESOLUTION NO. 94—x57 A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AZUSA AND THE BOARD MEMBERS OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA APPROVING AN AMENDMENT TO DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF AZ A AND R.E. BLEWETT COMPANIES, INC. TO AS GN DISPOSITION AND DEVELOPMENT AGREEME TO AZUSA HERITAGE, A CALIFORNIA L ITED PARTNERSHIP HE CITY COUNCIL OF THE CITY OF AZUSA A THE BOARD MEMBERS OF TH REDEVELOPMENT AGENCY OF THE CIT OF AZUSA DO HEREBY RESOLV AS FOLLOWS: SECTI 1. The City Council of the City of zusa and the Board Members of the Redevelopment ency of the City of Azusa hereby j tly find, determine and declare that: A. The Rede elopment Agency of the City Azusa ("Agency") is engaged in activities necessary to execute a d implement the Redevelo ent Plan for the Central Business District Redevelopment Project "Project"); and B. In order to imp ent the Redeve pment Plan, the Agency proposes to amend an existing Disposition and De elopment Ag ement between the Agency and R.E. Blewett Companies, Inc., a California rporation, o provide for the assumption of such agreement by Azusa Heritage, a California 'iced p nership, with R.E. Blewett Companies, Inc., a California Corporation, as Gener Part r, and Tone Yee Investments & Developments, A California General Partnership, as " i d Partner; and C. The Agency and Azusa ge ("Developer") have negotiated the terms of the Amendment; and D. The proposed Ame men, conta s all the provisions, terms, conditions, and obligations required by state and ocal law; and E. The Developer ha agreed to acquir\therofpeirty and develop that Property as described in the Amendm t, in accordancepurposes and objectives of the Redevelopment Plan; and F. The Agency s previously prepared, andthe Council has reviewed and considered, a summary s ting forth an explanation of why the s of the Property will assist in the elimination of bli t, with reference to all supporting facts a materials relied upon in making this explanatio and G. The AItr-1 cy has previously prepared, and the City Court has reviewed and considered, a sum setting forth the cost of the Amendment to the Age y, the estimated value of the inter to be conveyed determined at the highest uses peNt er the Redevelopment P n and at the use and with the conditions, covenants, and costs required by the ale and the purchase price or sum of the lease paymene said summary avai ble for public inspection in accordance with the Califmunity Redevelonme the/ Law: and H. fthe Agency and City have found the Amendment to be exempt pursuant to SeNion 15303 of isle 14 of the California Code of Regulations; and 0 0 1. Pursuant to provisions of the California Community Redevelopment Law, the Agency and the City Council held a duly noticed joint public hearing on the proposed sale of the Property and on the proposed Agreement; and J. The redevelopment of the Property pursuant to the proposed Amendment Vin the best interests of the City and in accord with the public purposes and provisions of a licable State and local laws. SECTION 2. The City and Agency hereby find and determi that the proposed Amendment satisfies the categorical exemption found in Section 15303 f Title 14 of the Code of Califorr�a Regulations, adopted pursuant to the California Enviro ental Quality Act. SECTI 3. The City hereby finds and determines tha the sale of the Property will assist in the el imt tion of blight. SECTION 4. e City hereby finds and determine hat the consideration for sale of the Property is not less than a fair reuse value of the land th the use and with the covenants and conditions and developme costs authorized by the sa or lease. SECTION 5. The sa\subntia Property the Agency to the Developer and the Amendment which establishesand con tions for the sale and development of such property, are hereby approved lly th form presented to the Board and City Council, together with such minor chanbe proved by the City Administrator and the City Attorney. SECTION 6. The City Adminis ator hereby authorized to execute said Agreement on behalf of the City and to take all ac on neces ry to carry out said Agreement. SECTION 7.
