RESOLUTION NO. 97-R29
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF AZUSA APPROVING AN AGREEMENT FOR
CONSTRUCTION OF FENCING AND WALL BETWEEN THE
AGENCY, THE AZUSA UNIFIED SCHOOL DISTRICT, R. E.
BLEWETT, INC., AND ZUKUN JU
WHEREAS, the Agency, the Azusa Unified School District ("District"), R.E. Blewett, Inc.
(`Blewett"), and Zukun Ju ("JU") propose to enter into that certain Agreement entitled "Agreement
for the Reconstruction of Fencing and Wall" ("Agreement"), substantially in the form attached
hereto as Exhibit A; and
WHEREAS, the Agreement provides for the expenditure of the Agency's low and moderate
income housing funds (Health and Safety Code Section 33334.2) for construction of certain fencing,
block wall and other improvements (collectively, "Improvements"), as more particularly described
therein, adjacent to the Azusa Heritage Residential Project ("Project"), an Agency -assisted low and
moderate income housing project; and
WHEREAS, the Project is located outside the Agency's Redevelopment Project Areas, but
the Agency has determined that the provision of the Improvements will be of benefit to the Project
and the Agency's Project Areas; and
WHEREAS, it can be seen with certainty that the construction of the Improvements
described in the Agreement will not cause any significant environmental effects.
NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The above Recitals are hereby incorporated and adopted by this reference.
SECTION 2. The Agency finds and determines that the construction of the Improvements
described in the Agreement is exempt from environmental review pursuant to provisions of the
California Environmental Quality Act (California Public Resources Code Section 21000, et SeMc .)
Under the "common sense" exception, in that it can be seen with certainty that the construction of
the fencing and wall will not have the possibility of creating any significant environmental effects.
SECTION 3. The Agency hereby approves the Agreement in the form attached hereto as
Exhibit A. The Agency's Chairperson is hereby authorized and directed to execute the Agreement
on behalf of the Agency, and execute such other documents and instruments as may be reasonably
necessary to administer and implement the actions described in the Agreement.
SECTION 4. The Agency's Executive director is authorized, with the concurrence of
Agency Counsel, to make minor, nonsubstantive technical and clarifying changes to the Agreement,
without the need for formal Agency governing board approval.
SECTION 5. Agency staff is hereby directed to file with the Los Angeles County Clerk's
Office, within five (5) days from the execution of this Resolution, a Notice of Exemption pursuant
to the Agency's CEQA Guidelines.
