RESOLUTION NO. 98—R27
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY
OF AZUSA APPROVING A LICENSE AGREEMENT WITH PIMA
CORPORATION, DBA ADVANCED CONSTRUCTION
WHEREAS, the Agency desires to permit Pima Construction, dba Advanced Construction
("Advanced") to use that certain Agency owned real property located at 444 N. Azusa Avenue (the
"Property") to store certain construction equipment and materials while Advanced constructs certain
improvements to the downtown area between Fifth and Ninth Streets (the "Project"), pursuant to that certain
License Agreement substantially in the form attached hereto as Exhibit A (the "Agreement"); and
WHEREAS, it can be seen with certainty that the use of the Property for such storage
purposes will not cause any significant environmental effects; and
WHEREAS, Azusa Municipal Code requires all storage lots to be paved; and
WHEREAS, pursuant to Section 88-30 of the Azusa Municipal Code, various land use
requirements may be superceded by an agreement with the Agency; and
WHEREAS, the Agency Board finds that the Project will significantly benefit economic
development in the downtown area, and, therefore, desires to supercede the aforementioned paving
requirement as set forth in the Agreement.
NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The above Recitals are hereby incorporated and adopted by this reference.
SECTION 2. The Agency finds and determines that the construction of the
Improvements described in the Agreement is exempt from environmental review pursuant to provisions of
the California Environmental Quality Act (California Public Resources Code Section 21000, et seMc .) in that
it has been determined with certainty that the use of the Property for the storage of construction equipment
and materials will not have the possibility of creating any significant environmental effects.
SECTION 3. The Agency hereby approves the Agreement in the form attached hereto as
Exhibit A. The Agency's Chairperson is hereby authorized and directed to execute the Agreement on behalf
of the Agency, and execute such other documents and instruments as may be reasonably necessary to
administer and implement the actions described in the Agreement.
SECTION 4. The Agency's Executive Director is authorized, with the concurrence of
Agency Counsel, to make minor, nonsubstantive technical and clarifying changes to the Agreement, without
the need for formal Agency Board approval.
SECTION 5. Agency staff is hereby directed to file with the Los Angeles County Clerk's
Office, within five (5) days from the execution of this Resolution, a Notice of Exemption pursuant to the
ADOPTED this 20ih day ofAvril •' 1998.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted at a meeting of the
Redevelopment Agency of the City of Azusa, at a regular meeting thereof, held on the 20' day of April ,
1998, by the following vote of the Agency Board of Directors.
