HomeMy WebLinkAboutResolution No. 98-R17RESOLUTION NO. 98—R17 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA APPROVING AN EMERGENCY CONTRACT TO REPAIR AGENCY PROPERTY LOCATED AT 613-615 NORTH AZUSA AVENUE WHEREAS, the Agency owns certain real property located at 613-615 North Azusa Avenue and which contains structures that need immediate roof replacement due to recent El Nino storms and proposes to suspend formal bidding procedures and enter into a roof replacement agreement with Blue Sky Roofing substantially in the form attached hereto as Exhibit A; and WHEREAS, the Pproperty is located within the Agency's Redevelopment Project Areas, and will be of benefit to the Project and the Agency's Project Areas; and WHEREAS, it can be seen with certainty that the construction of the Improvements described in the Agreement will not cause any significant environmental effects. WHEREAS, pursuant to Public Contracts Code Section 22050, the City Council may by a 4/5 vote declare this an emergency and thereby waive formal public bidding; and NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF AZUSA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The above Recitals are hereby incorporated and adopted by this reference. SECTION 2. The Agency finds and determines that the construction of the Improvements described in the Agreement is exempt from environmental review pursuant to provisions of the California Environmental Quality Act (California Public Resources Code Section 21000, et sec.), as a Class 1 Categorized Exemption. SECTION 3. The Agency hereby waives formal bidding, bid bond and labor and material bond and hereby approves the Contract Agreement in the form attached hereto as Exhibit A. The Agency's Chairperson is hereby authorized and directed to execute the Agreement on behalf of the Agency, and execute such other documents and instruments as may be reasonably necessary to administer and implement the actions described in the Agreement. In addition, the Agency has received no less than three written competitive bids as required by local regulation. SECTION 4. The Agency's Executive director is authorized, with the concurrence of Agency Counsel, to make minor, nonsubstantive technical and clarifying changes to the Agreement, without the need for formal Agency governing board approval. SECTION 5. Agency staff is hereby directed to file with the Los Angeles County Clerk's Office, within five (5) days from the execution of this Resolution, a Notice of Exemption pursuant to the Agency's CEQA Guidelines. �1 APPROVED ASD AD(PTED this 16 day of Marg11998.
