HomeMy WebLinkAboutResolution No. 03-R220 0 RESOLUTION NO. 03—x22 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF AZUSA APPROVING A PURCHASE AND SALE AGREEMENT FOR THE PURCHASE OF CERTAIN REAL PROPERTY GENERALLY LOCATED AT 638 NORTH AZUSA AVENUE WHEREAS, the Community Redevelopment Agency ("Agency") of the City of Azusa ("Azusa") is engaged in activities necessary to execute and implement the redevelopment plan ("Redevelopment Plan") for the Azusa Central Business District Redevelopment Project Area ("Project Area"); and WHEREAS, George J. Padilla and Maria G. Padilla, husband and wife, ("Owners") are the current owners of that certain real property generally located at 638 North Azusa Avenue in the City ("Property") which is more particularly described on the attached Exhibit A; and WHEREAS, the Property is located within the Project Area; and WHEREAS, the Owners desire to sell and convey the Property to Agency for a purchase price of Nine Hundred Ninety Nine Thousand Seven Hundred Fifty Dollars ($99,750) ("Purchase Price"); and WHEREAS, the Agency and Owners have negotiated the terns and conditions of a purchase and sale agreement ("Agreement") for the sale and conveyance of the Property from the Owners to the Agency, a copy of which is attached hereto as Exhibit R; and WHEREAS, pursuant to CRL, Section 33391, the Agency desires to acquire the Property from the Owners for general redevelopment purposes; and WHEREAS, the Agency, as the responsible agency under the California Environmental Quality Act ("CEQA") has determined that the acquisition of the Property from the Owners is exempt from any further review under CEQA, State CEQA Guidelines and the Agency's Local CEQA Guidelines pursuant to California Public Resources Code Section 15061(b)(3) because Agency staff has detemmined that there is no possibility that such acquisition will have a significant effect on the environment; and WHEREAS, pursuant to the foregoing, the Agency staff has determined that a Notice of Exemption for the conveyance of the Property should be filed pursuant to Section 15062 of CEQA, Stale CEQA Guidelines and the Agency's Local CEQA Guidelines. THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF AZUSA DOES RESOLVE AS FOLLOWS: SFCTION 1. The Agency hereby (i) authorizes the purchase and acquisition of the Property from the Owners for the Purchase Price, and (ii) approves the Agreement in substantially the same form attached hereto as Exhibit R. SECTION 2. The Agency hereby authorizes the Agency's Executive Director (with the concurrence of Agency Counsel) to execute and deliver on behalf of the Agency the Agreement and such other documents and instruments as may be necessary or convenient in the furtherance of the actions authorized by this Resolution. SECTION 3. The Agency Secretary is hereby directed to (i) file a copy of the executed Agreement with the City Clerk at City Hall, and (ii) to file a Notice of Exemption with the Los Angeles County Clerk's Office within three (3) days from the adoption of this Resolution. R V PUDAKC VA655439 0 0 SECTION 4. Agency Staff is hereby directed to do all that is necessary to effectuate the intent of the Agreement and consummate the purchase of the Property. SFCTION i. The Agency Secretary shall certify the adoption of this Resolution.
