HomeMy WebLinkAboutResolution No. 20 0 RESOLUTION NO. 2 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE AZUSA PUBLIC FINANCING AUTHORITY APPROVING AND ADOPTING A CONFLICT OF INTEREST CODE PURSUANT TO THE PROVISIONS OF THE POLITICAL REFORM ACT OF 1974, TITLE 9 OF THE GOVERNMENT CODE. WHEREAS, the Political Reform Act of 1974, Government Code Section 81000 et seq. (the "Act'), containing provisions relating to conflicts of interest which potentially affect all officers, employees and consultants of the Azusa Public Financing Authority (the "Authority'), and requires all public agencies to adopt and promulgate a Conflict of Interest Code; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Azusa Public Financing Authority as follows: Section 1. The Conflict of Interest Code of the City of Azusa (the "City"), as amended, as attached hereto as Appendix A and incorporated herein by this reference, and as may be amended, modified and revised in the future by the City, is hereby approved as the Conflict of Interest Code of the Authority. Exhibit "A" of the Conflict of Interest Code of the Authority is hereby amended to add the following designated positions as shown on Appendix B attached hereto and incorporated herein by reference. Section 2. The Secretary shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 2nd day of January , 19 90. Adoption of Conflict of Interest Code The Fair Political Practices Commission has adopted a regulation, 2 California Administrative Code section 18730, which contains the terms of a standard conflict of interest code, which can be incorporated by reference, and which may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act (Government Code sections 81000, et seq.) after public notice and hearings. Therefore, the terms of 2 Cal. Administrative Code section 18730, and any amendments to it duly adopted by the Fair Political Practices Commission, along with the attached exhibits "A" and "B" in which officials and employees are designated and disclosure categories are set forth, are hereby incorporated by reference and constitute the Conflict of Interest Code of the City of Azusa. SECTION 200. Purpose It is the purpose of this code to provide for the disclosure of financial interests of designated employees which may be materially affected by their official actions, and, in appropriate circumstances, to provide that designated employees should be disqualified from acting in order that conflicts of interest may be avoided. SECTION 300. Designated Position The positions listed in Exhibit "A" are designated positions. Officers and employees holding those positions are designated employees and are deemed to make, or participate in the making of, decisions which may foreseeably have a material effect on financial interests. SECTION 400. Disclosure Statements Designated positions are assigned to the disclosure, category set forth on Exhibit "B." The disclosure category specifies which kinds of financial interests are reportable. Designated employees shall file an annual statement disclosing that employee's or official's interest in investments, business positions, interests in real property and sources of income designated as reportable under the category to which the employee's or official's position is assigned on Exhibit "B". SECTION 500. Place, Time, and Manner of Filing (a) All designated employees or officials required to submit a statement of financial interests shall file the original with the City Clerk's office. (b) The City Clerk's office shall make and retain a copy of the statement. (c) A designated employee or official required to submit an initial statement of financial interest shall submit the statement within 30 days after the effective date of this Code. (d) All persons appointed, promoted or transferred to designated positions shall file initial statements not more than 30 days after assuming office. -3- 0 0 (e) Annual statements shall be filed not later than March 30 by all designated employees. Such statements shall cover the period of the preceding calendar year. (f) The first statement of financial interests shall report the designated employee's reportable investments and interests in real property as those investments and interests in real property exist as of the effective date of this code or the date the designated employee assumed office, whichever is later. Income and business positions need not be reported on the first statement. (g) Every designated employee who leaves office shall file, within 30 days of leaving office, a statement disclosing reportable investments, business positions, interests in real property and income held or received at any time during the period between the closing date of the last statement required to be filed and the date of leaving office. (h) A designated employee who resigns the position within 30 days and following initial appointment is not deemed to assume or leave office, provided that during the period between the appointment and resignation the individual does not make, participate in making, or use the position to influence any decision of the City or any agency of the City or receive or become entitled to receive any form of payment by virtue of being appointed to the position. (i) Disclosure statements shall be made on forms supplied by the City Clerk's office.
