OB -06-12 A RESOLUTION OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE AZUSA REDEVELOPMENT AGENCY TRANSMITTING THE CITY VENTURES DISPOSITION AND DEVELOPMENT AGREEMENT TO THE STATE OF CALIFORNIA DEPARTMENT OF FINANCE WHEREAS, on June 6, 2011, the Governing Board of the Redevelopment Agency for the City of Azusa ("Agency") approved a Disposition and Development Agreement ("Agreement") with City Ventures, LLC ("City Ventures") to develop the residential property on the northeast comer of 91h Street and Alameda Avenue ("Property"); and WHEREAS, on January 11, 2012, the City of Azusa Planning Commission approved a Tentative Tract Map and Design Review application to allow the construction of 14 dwelling units and, shortly thereafter, City Ventures and the Agency entered into escrow to transfer the Property pursuant to the terms of sale in the Agreement; and WHEREAS, pursuant to Health and Safety Code sections 34172 and 34173, the Agency was dissolved as of February 1, 2012 and the City of Azusa became the successor agency to the Agency ("Successor Agency"); and WHEREAS, pursuant to Health and Safety Code section 34179(a), the Oversight Board is the Successor Agency's oversight board and is responsible for approving certain actions of the Successor Agency pursuant to State law; and WHEREAS, because of the pending dissolution of redevelopment statewide, the Successor Agency has been unable to secure title insurance for the sale of the Property without the approval of the Oversight Board and the Department of Finance; and WHEREAS, at the request of the Successor Agency's title insurance company the Successor Agency has requested that the Oversight Board approve the transmittal of the Agreement to the State of California Department of Finance. NOW, THEREFORE, THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE AZUSA REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AND FIND AS FOLLOWS: Section 1. Recitals. The Recitals set forth above are true and correct and are incorporated into this Resolution by this reference. Section 2. CEOA Compliance, The City, as lead agency, previously determined that the Project constitutes a "project" under the California Environmental Quality Act ("CEQA") but that the Project is exempt from environmental review under CEQA pursuant to Public Resources Code Section 21084 and Title 14 of the California Code of Regulations Section 15332 because the Project is in -fill development (1) consistent with the applicable City general plan designation and all applicable City general plan policies, as well as with the applicable general zoning designation and regulations; (2) occurring with City limits on a project site of no more than 5 acres substantially surrounded by urban uses; (3) the project site has no value as habitat for endangered, rare or threatened species; (4) approval of the project will not result in any significant effects relating to traffic, noise, air quality or water quality; and (5) the site can be adequately served by all required utilities and public services. Section 3. Approval of Agreement Transfer. The Oversight approves the transmittal of the City Ventures Disposition and Development A State of California Department of Finance. Section 4. Severability. If any provision of this Resolution or the application of any such provision to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution that can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The Oversight Board declares that the Oversight Board would have adopted this Resolution irrespective of the invalidity of any particular portion of this Resolution. Section 5. Certification. The City Clerk of the City of Azusa, acting the Oversight Board as its Secretary, shall certify to the adoption of this Resolution. Section 6. Effective Date. Pursuant to Health and Safety Code section 34179(h), all actions taken by the Oversight Board may be reviewed by the State of California Department of Finance, and, therefore, this Resolution shall not be effective for three (3) business days, pending a request for review by the State of California Department of Finance.
