Present at roll call: Councilmen: Howard, Martin, Meier, Chenoweth, Durrell, City Attorney and City Clerk. IN THE MATTER OF ACQUISITION AND IMPROVEMENT DISTRICT NO. 1 OF THE CITY OF AZUSA. I 6y 24 7:30 P.M. `^- The hour of 7:30 o'clock, P. M. of Tuesday, the 13th day ' of March, 1928, having arrived, the Mayor announced that the City Council would now continue with the hearing in the matter of Acquisition and Improvement District No. 1 of the City of Azusa. The City Council as a Committee of the whole and the Superintendent of Work heretofore appointed in the matter of Acquisition and Improvement District No. 1 of the City of Azusa reported that the protests and objections heretofore filed in the above entitled matter were made by the owners of less than one-half (1/2) of the area of the property included within the entire assessment district, as proposed. It was then moved as follows, by Councilman Martin: That objections in writing going to the doing of the work as an entirety, described in said Resolution of Intention, and to the ordering of the same, have not .been made by the owners of one-half (1/2) or more of the area of the property included within the entire assessment district, as proposed in said Resolution of Intention. This City Council finds that the owners of more than one-half (1/2) of the area of the property included tithin said district have not so in writing made objections going to the entirety of the things therein proposed to be done, and that this City Council shall now proceed with the hearing. The motion was seconded by Councilman Meier, and carried by the following vote: ' AYES: Councilmen: Howard, Martin, Meier, Chenoweth, Durrell. NOES: None. ABSENT: None. The Mayor then announced that the fact was that the owners of more than one-half (1/2) of the area of the property included within the entire assessment district, as proposed in said Resolution of Intention, have not made objections in writing going to the ordering of the things therein proposed to be done, as an entirety, and that the City Council would now proceed with the further hearings in said matter. The Mayor then asked if any objections had been made to the extent of the assessment district, as proposed in said Resolution of Intention, and in the specifications for said work. The Clerk reported that such objections had been filed. The Mayor thenasked if anyone present had any objections to the extent of the assessment district, or desired to make any objections to the boundaries thereof, whereupon Messrs Lavin, Strang, Metcalf, Dilley and others spoke in objection to the boundaries. Thereupon, after fullhearing of the matter in which full ' opportunity was given to anyone desiring to make objections to the extent of the assessment district, as proposed, the hearing in the matter was concluded and the Mayor then asked the Clerk if any objections had been made to the zones into which said Assessment District is to be divided, as proposed in said Resolution of Intention, and as shown in the specifications therein referred to. The Clerk reported that such objections had been filed with him. The Mayor then asked if anyone present had any objections to the zones into which said assessment district is to be divided as proposed in said Resolution of Intention, and as shown in the specifications therein referred to, or desired to make any objections to the same,whereupon Messrs. Strang, Dilley and several others spoke in objection to the zones. 244 co MINUTES OF REGULAR ADJOURNED MEETING HELD MARCH 13, 1928. 7:30 P.M Thereupon, after full hearing of the matter in which full opportunity was given to anyone desiring to make objections to the zones into which said assessment district is to be divided, the hearing in the matter of said zones was concluded, and the Mayor then asked the Clerk if any objections had been made to the percentages to be raised from each of said zones, as the same are set forth in said Resolution of Intention. The Clerk reported thdt such objections had been filed with nim. The Mayor then asked if any persons present desired to make any objections to the percentages to be raised from each of said zones, as the same are set forth in said Resolution of Intention, or desired to make any objections to the same. No one objected. Thereupon, after full hearing of the matter in which full opportunity was given to anyone desiring to make objections to the percentages to be raised from each of said zones,as the same are set forth in said Resolution of Intention, the hearing of the matter of percentages was concluded. Thereupon, the Mayor asked if any property owner whose property is included within the assessment district for the proposed improvement, or any other person whose rights are affected, had presented written objections to the grade or grades to which any or all of the improvements are proposed to be constructed. The Clerk reported that such objections had been filed. The Mayor then asked if any persons present desired to make any objections to the grade or grades to which any or all of the improvements are proposed to be constructed,a s set forth in the Resolution of Intention and the plans, profiles and specifications for the said work, whereupon Mr. Dilley spoke concerning the grades. Thereupon, after full hearing in the matter in which full opportunity was given to anyone desiring to make objections to the grade or grades to which any or all of the improvements are propnsed to be constructed, as set forth in said Resolution of Intention, and the plans, profiles and specifications for the said ' work, the hearing in the matter of the grades was concluded. Thereupon, Paul E. Kressly was duly sworn and gave testimony as to the public necessity, benefit and convenience of the things proposed to be done in said Resolution of Intention, and that the location of the improvement in the manner proposed was located in the manner which would be most compatible to the greatest public good and with the least private injury and that the lands contained within the assessment district are benefited by the proposed improvement, and that the lands contained within each zone of the assessment district are equally benefited by the improvement, and that the percentages to be raised in each such zpne does best reflect the benefits to be derived by the parcels of land included therein, and that the grade or grades to which the said improvement and any or all of the same are proposed to be constructed are the suitable and proper grades for the said im- provement, and that no warrant exists for objections to the same; and that no damage of any kind can or will result to any property owner or any other persons whose rights are affected by reason of the construction of the improvement to the grade or grades proposed in said Resolution of Intention. Thereupon, the following Resolution was introduced by Councilman Meier; Resolution No. 1073, in the Matter of Acquisition and Improvement District No. 1 of the City of Azusa - Resolution ' passing upon protests and objections, which Resolution was passed and adopted by the following vote, to -wit: AYES: Councilman: Martin, Meier, Chenoweth, Durrell. Councilman Dhenoweth, introduced the following Resolution: Resolution No. 1074, in the Matter of Acquisi- tion and Improvement District No. 1 of the City of Azusa - Resolution Ordering Improvement, which Resolution was passed and adopted by the following vote, to -wit: 247 7:30 P.M. AYES: Councilmen: Martin, Meier, Chenoweth, Durrell. I NOES: Councilman: Howard. ABSENT: Councilmen: None. Moved by Councilman Chenoweth, seconded by Councilman Martin, that the meeting adjourn.
