Z S AN ORDINANCE ESTABLISHING WATER RATES TO BE CHARGED BY THE CITY 1 OF AZUSA AND PRESCRIBING RULES AND REGULATIONS CONCERNING THE 2 USE OF VATER AND FIXING A PENAL'T'Y FOR THE VIOLATION THEREOF, 3 AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES.IN CONFLICT 4 HEREWITH. 6 8 7 e 9 10 11 19 20 21 22 23 24 26 26 27 28 29 30 31 32 The Board of Trustees of the City of Azusa do ordain as follows: SECTION 1. That the monthly rates to be charged and collected. by the City of Azusa for water supplied from its water works to consumers shall be as follows: 1. Tenement occupied by a single family, ........ $.7.5 (A tenement shall be construed to mean am person or persons or family who are living together undo the same roof, and boarding at one and the same table 2. For butcher shops,stores,warehouses,public halls, photograph galleries, offices, blacksmith shops, fruit packing houses, carpenter shops,sh.oe- maker shops,tailor shops, doctors' offices,dentists' offices, lavyers' offices, saloons and for every other purpose not above ofU hereinafter mentioned, where no family resides ............................. (where a person or persons reside in a place of business, family rates charged.) 3. For restaurants and. eating houses,........ Provided, that the City shall have the right, and option of supplying a water meter for any consumer, V&ereupon meter rates will be char; ed as follows: For any quantity used each month up to 1000 cubic feet)........................ ............... .. For the next 100 cubic feet, or fractional part thereof over the first 1000 cubic feet,........ For each 100 cubic feet or fractionxi thereof over the first 2000 cubic feet, ................... 4. There shall be no charge less than $.75. .75 L. 50 .75 .07 .05 23 other person, shall under any circumstances run or convey by anv 24 means any water from his service on any lot or property, or 25 across any street or alley or supply water to other persons or 29 families for which he is not paying the rate or rates prescribed 27 by said. City; and all water furnished to consumers in the City 28 of Azusa shall be charged to the owner of the premises upon 29 which the water shall have been used, and the owner of said 3o premises shall be held responsible for the payment, of the 31 water rates for the water used upon the premises owned by him. 82 Provided that the water superintendent may permit more than one tenement or person to connect, on to a single tap lead- -2- �__._ i SECTION 2. The City shall charge, and collect in advance, 1 for each tap or attachment made with its system of water works, 2 as follows: 3 Fo each 1/2 -inch corporation stop using 4 '� 1 2 -inch service pipe ........................ $10.00 B For each 5/8 -inch corporation stop using 3/4 -inch service pipe ......................... 10.00 a For. each 3/4 -inch corporation stop using 7 1 -inch service pipe, ......................... 12.00 e And there shall be a stop cock in every attachment on 9 the sidewalk just, inside of the curb at, a point to be desig- 10 nated by said City, which said stop rock and its box shall be 11 supplied by the City and shall be for its exclusive use and 12 under its exclusive control. 13 The City will not be responsible for damages to any v .v w �p 14 buildings or their contents from any break beyond the street �m 15 service bog or meter ;and water consumers are hereby required z6xe 16 to provide at their own expense another stop cock to be placed 17 at the first suitable point beyond the stop or meter of the 19 City. 19 When more than one service pipe is supplied from one 20 attachment, there shall be as many protection stop cocks as 2 there is service pipes. 22 SECTION 3. No consumer of water from the City, or any 23 other person, shall under any circumstances run or convey by anv 24 means any water from his service on any lot or property, or 25 across any street or alley or supply water to other persons or 29 families for which he is not paying the rate or rates prescribed 27 by said. A consumer, in the meaning of this Ordinance, is one who has the privilege or opportunity to use water from a pipe or service on the premises occupied by him or( by permission from the Vater Superintendent) from some line or tap on property near him. And in all cases the City will assume that water has been used where any person or persons or tenants in commpn have had the opportunity to use the same, and even thou -h such person or persons may not have used any water during any month, they will not be entitled to any rebate from the regular rate provided in such cases unless they have notified the City Clerk in writing to cut off such service, and where it is not practical to turn off said service or person, either owner or occupant must provide a line on the street or alley with service cocks so that such service may be cut off., otherwise water will be charged to all said tenants in common or persons until the whole service is cut off. 'The beater Superintendent shall cut or cause the water to be cut off in all cases where this Ordinance has been violated and it shall not be turned on attain until all charges due the City up to the time the water was shut off including the pen- alty for delinquency and the further sum of one dollar are paid. SECTION 4. All water rates are payable at the office of the Collector of Revenues; and if not so paid by the 10th of the month,there shall be added ten per cent. penalty for delinquency, and the Collector of Revenues shall give notice to the delinquent by mailing to him a statement of the amount due and the penalty ikx thereon. If the said water rate and penalty for delinquency is not paid within five days thereafter, the Collector of Revenues shall notify the water superintendent who shall immediately, without further notice, shut off the water from the premises of the delinquent, and the water shall not again be turned on for thein, or aq! subsequent occupant, except upon the payment of the whole amount due to the City for water used up to the time the water is so shut off, including the penalty for delinquency, and the further sum of one dollar. SECTION 5. The Water Superintendent or any other author- ized officer of the City shall be admitted at, all reasonable hours to all parts of the premises supplied with water to see that, the regulations are observed. No one except the Water Superintendent or someone expressly authorized by him shall turn the water on or off from any building or. premises. No person shall tap any water main, or in any manner whatever meddle or interfere with any part of the said water works without written permission of the Water Superintendent. Consumers shall prevent all waste of water and no water faucet or hydrant shall be allowed to remain out, of repair, or water be allowed to run therefrom when not in actual use for irrigation or domestic purposes. SECTION 6. Water rates will be charged for premises . vacated in every instance until the City shall have been notified by the ovmer or his agent in writing, filed with the City Clerk, of the discontinuance of the use of water and to -d- - _. 1 / I turn the water off. 2 SECTION 7. All faucets, hydrants, hose, sprinklers, 3 nozzles, irrigation heads or other continuous streams must be 4 shut off promptly upon the alarm of fire, the water not again to 6 be turned on until the fire is know to be extinguished. 6 SECTION 8. Any person, firm or corporation violating 7 any of the provisions of this Ordinance shall be deemed guilty of 8 a misderrc anor and upon conviction in a Court of competent 9 jurisdiction shall be fined. not, less than five or more than 10 fifty dollars, or by imprisonment in the.City Jail not exceed - 11 ing twenty-five days, or by both such fine and inprizonment. 12 SECTION 9. The office of Water Superintondent shall be 13 and is hereby created and all appointments to such office " �A a 14 shall be made by resolution of the. Board of Trustees of said O 15 City of Azusa, duly passed at a regular meeting thereof, which 86 18 said resolution shall also fix the salary or compensation to I -A 71 17 be paid the appointee therein named, and such appointee shall 18 hold office during the pleasure of said Board of Trustees. 19 SECTION 10. That such Water Superintendent before 20 entering upon the discharge of the duties of such office shall 21 take and subscribe to the constitutional oath of office. 22 SECTION 11. That such Water Superintendent shall have, 23 subject to the control of the Board of Trustees, general charge, 24 supervision and control of the water works system of the City 45 of Azusa, and he shall read or cause to be read all the meters on the 25th, 26th and 27th days of each month ani, at, such times as 26 may be required, and raport the readings to the City Clerk. He 27 28 shall have general supervision over all .repairs, tappings and 29 additions to the system, and cut, off or cause to be cut off so the water from any consumer upon the written report of the 31 Collector of Revenues or upon the violation of any of the 82 provisions of this Ordinance, and upon so doing report the same -5- 1 2 3 4 6 8 7 e 9 to 11 12 13 14 16 16 17 18 19 20 21 22 23 24 26 26 27 28 29 30 31 32 to the City Clerk and generally to do and perform every duty, as Water Superintendent,required of him by law or any Ordinance of said Citir or the Board of Trustees. t, SECTION 12. It shall be the duty of the City Clerk to keep all accounts relating to said water works system and make out and deliver for collection to the Collector of Revenues on the third day of each month, receipts with stubs numbered the same as the receipts, for all unpaid water rates for the current month,and charge him therewith. SECTION 13. The Collector of Revenues do all then pro - teed at once to collect all such water rates; and if the same are not paid by the 10th o Lthe month, he shall report the sane to the City Clerk, who shall thereupon add ten per cent pen- alty for delinquency to all receipts then in the hands of the Collector of Revenues and charge him therewith. And the Collector of Revenues shall thereupon proceed as directed in Section 4 hereof. It shall also be the duty of the Collector of Revenues to pay over to the City Treasurer on or before Saturday of each week all water rates collected by him, taking the -City Treasurer's receipt therefor, which he shall file with the City Clerk and the Collector of Revenues shall report the amount thereof, together with the amount delinquent, to the Board of Trustees at, the first regular meeting of said Board in each month. SECTION 14. The City Treasurer shall keep all moneys paid into the treasury from the water rates in a separate fund to be known as -the Water Fund. SECTION 15. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 16.
