HomeMy WebLinkAboutOrdinance No. 115U 1 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Ordinance No. An ordinance establishing water rates to be Charged by the City of Azusa,and prescribing rules and regulations concerning the use of water and fixing a penalty for the violation thereof and repea ing ordinance number 104 of the City of Azusa and all ordinances sand parts of ordinances in conflict with this ordinance. The Board of Trustees of the City of Azusa do ordain as follows: Section 1: That the Monthly rates to be charged and collected by the City of Azusa for water supplied from its water works to con- sumers shall be as follows: 1Flat rate:. $.75 per 1000 cubic feet; rates to be adjusted by the Superintendent on said scale on basis of assumed consumption,but no charge shall be less than $.75. Tenement occupied by a single family the minimum rate shall be. ( A tenement shall be construed to mean any person or persons or family who are living together under the same roof,and boarding at one and the same table. 2: For stores of less than 360 square feet not having bath,toilet, urinal, sink,or stationary wash stand in use,the minimum Monthly rate shall be 4.50 3:All places of business not above classified the minimum rate shall be $.75. Where a person or persons reside in a place of bus. iness family rates shall be charged. 4: The City of Azusa shall have the right and option of installing a water meter for any consumer,whereupon meter rates will be charg as follows: For any quantity used each Month up to 1000 cubic feet $.50 For each 100 cubic feet or fraction thereof over the first 1000 cubic feet $.04 Provided that If the amount of any bill shall not be an exact multiple of five cents,such bill shall be reduced or increased to the next nearest multiple of five cents as the case may be. There shall be no charge less than fifty cents where a meter is used. That where a meter fails to register during any period, a charge shall be made upon an estimate based upon the reading of th preceding Month,or where a meter has not been set for a Month,then during such period as such meter shall have registered. I Section 2: The charge for each tap or attachment made with its 2 system of water works,shall be as follows: 3 I 4 I For each 1%2 inch corporation stop using 1/2 inch service pipe 5 It '10.00 6 I For each 5/8 inch corporation stop using 3/4: inch service pipe 7 $10.00 8 For each 3/4 inch corporation stop using 1 inch service p&pe 9 ,12.00 10 The City reserves the right,at any time without notice,to shut 11 off the water in its mains or services,for the purpose of raking 12 repairs or extensions,or for other necessary purposes,and all 13 persons having boilers on their premises are hereby cautioned 14 against direct connection with the rain. 15 All pipes or extensions connecting with the City mains and laid 16 by any person on any public street,place or alley shall at once 17 become the property of the C1_ty and such person shall not have 18 any jurisdiction over them nor nay such pipes or extensions be 19 renoved.by such person. 20 And there shall be a stop cock in every attachment on the side - 21 walk just inside of the curie at a. point to be designated by said 22 City,which said stop cock and its box shall be supplied by the 23 City and shall be for its exclusive use and under its exclusive 24 control. 25 The City will not be responsible for damages to any buildings 26 or their contents from any break beyond the street service box 27 or meter; And water consumers are hereby required to provide at 28 their own expense another stop cock to be placed at the first 29 suitable point beyond the stop or meter of the Oity. 30 -When more than one service pipe is supplied from one attachment, 31 there shall be as many protection stop cocks as there are servic 32 pipes. 2, i l 2 3 4 5 11 7 0 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 3: No consumer of water from the City,or any other person shall under any circumstances run or convey by any means any water from his service on any lot or proper.ty,or across any street or alley or supply water to other persons or families for which such other person or family is not paying to the City the rate or rates prescribed by the City,and all water furnished to consumers in.the City of Azusa, shall be charged to the owner dithe premises upon which the water shall have been used,and the owner of said premise shall be held responsible for the payment of the water rates used upon the premises owned by him. Provided that the water Supedintendent may permit more than one tenement or person to connect onto a single tap leading from the main with the proper stop cocks at such point on any Public Street or alleys as he may deem proper,and the City may contract with each or with one for all in such cases,each party so connect- ed to pay not less than $.50 per Konth,and in case any one of such persons fail to pay the rate provided one or all of such persons or tenants in co:mon shall be cut off as may be deemed riLht by the Viater Superintendent. A consuner,in the Meaning of this o.rdinance,is one who has the privilege or opportunity to use water from a pipe or service on the premises occupied by hilt or( by permission from the water Superintendent) from some lite or tap on property near him. And in all cases the City will assume that water has been used where any person or persons or tenants in common have had the opportunity to use the same,and even though such person or per T ay not have used any water during any Month,they will not be entitled to any rebate from the regular rate provided in such cases unless they have notified the Water Superintendent in writ- ing to cut off such service,and where it is not practical to turn off sijd service or person,either owner or occupant must provide a line on the street or alley with service cocks so that such service may be cut off,otherwise water will be charged to all 3. L 1. said tenants in common or persons until the whole service is cut 2 off. 3 The Water Superintendent shall cut or cause to be cut off the 4 water in all cases where this ordinance shall have been violated 5 and it shall not be turned on again until all charges due the 6 I City up to the time the water was shut off including the penalty 7 for delinquency and the further sura of one dollar are paid. 8 SECTION. 4: 911 rates for water used in any month are due and 9 payable on the third day of the succeeding Month. 10 All water rates are payable at the office of the Collector of 11 Revenues; and if not so paid by the 10th, of the Month there shall 12 be added ten per cent penalty for delinquency,a.nd tho collector of 13 Revenues shall give notice to the delinquent by nailing to him a 14 I statement of the amount due and the penalty thereon. 15 If the said water rate and the penalty for delinquency is not 16 paid within five days thereafter,the Collector of Revenues shall 17 notify the Water Superintendent who shall immed.iately,without 18 further notice,shut off the water from the premises of the delin- 19 quent,and the water shall not again be turned on for then,or any 20 subsequent occupant,except upon the payment of the whole amount 21 I due to the City for Water used up to the time the water is so 22 shut off,including the penalty for delinquency,and the further 23 sun of one dollar. 24 SECTION 5s The ti7ater Superintendent or any other authorized Offic, 25 of the City shall be admitted at all reasonable hours to all part 26 of the premises supplied with water to see that the regulations 27 are obeyed and o3served. 28 No one except the water Superintendent or someone expressly auth 29 oriaed by'hixi shall turn the water on or off from any building or 30 premises. No person shall tan a^y water nain,or in any Manner 31 whatever meddle or interfere with any part of said water works 32 without written permission of the Water Superintendent. 4. 1 Consumers shall prevent all waste of water and no water faucet 2 or hydrant shall be allowed to remain out of repair,or water be 3 allowed to run therefrom when not in actual use for irrigation or 4 domestic purposes. 5 SECTION 6: Water rates will be charged for premises vacated in 6 every instance until the City shall 'lave been notified by the 7 owner or his Agent in writing,filed with the Superintendent,o£ 8 the discontinuance of the use of water and to turn the water off. 9 SECTION 7: All faucets,nydrants,hose,sprinklers,nozzles,irrigatio 10 heads or other continuous streams must be shut off promptly upon 11 the alarm of fire,the water not again to be turned on until the 12 fire is known to be extinguished. 13 SECTION 8: Any person,firm or corporation violating any of the 14 provisions of this ordinance shall be deemed guilty of a misd,- 15 meanor and upon conviction in a Court of competent jurisdiction 16 shall be fined not less than five or more than fifty dollars,or 17 be punished by imprisonment in the City Jail not eaeeeding twenty- 18 five days,or by both such fine and imprisonment. 19 SECTION 9: The Office of '.Rater Superintendent shall be and is her 20 by created and all appointments to such office shall be made by 21 resolution of the Board of Trustees of the City of Azusa,duly 22 1,passed at a regular meeting thereof which said resolution shall 23 also fix the salary or compensation to be paid the appointee 24 therein named and such appointee shall hold office during the 25 pleasure of said Board of Trustees. 26 SECTION 10: That such water Superintendent before entering upon 27 the discharge of the duties of such office shall take and subscri 28 to the constitutional oath of office. 29 SECTION 11: That such Water Superintendent shall have subject to 30 the control of the Board of Trustees,general charge,supervision 31 and control of the water works system of the City of Azusa and he 4 32 shall read or cause to be read all the meters on the 25th,26th or 5. 1 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 27th. days of each Month and at such times as may be required. He shall have general supervision over all repairs,tappings and additions to the system,and cut off or cause to be out off the water from any consumer upon the written report of the collector of Revenues or upon the violation of any of the provisions of thi ordinance,and '-generally to do and per.fora every dut; as Water Superintendent,required of him by Law or any ordinance of the City of Azusa or rule of the Board of Trustees. It shall also be the duty of the Superintendent to keep all accounts relating to the said water works system and to make out and deliver for collection to the Collector of Revenues on the third day of each Month,receipts,with stubs numbered the same as the receipts,for all unpaid water rates for the current Month,and charge him therewith. at once SECTION 12: The Collector of Revenues shall then proceedAto colle all.such water rates; and if the same are not paid by the 10th. of the Month,he shall report the same to the Superintendent,who shall thereupon add ten per cent penalty for delinquency to all receipts then in the hands of the collector oB Revenues and charg him therewith. And the collector of Revenues shall thereupon pro- ceed as directed in section 4 hereof. It shall also be the duty of the Collector of Revenues to pay over to the City TreasBEer on or before Saturday of each week all water rates collected by him,taking the City Treasurers receipt therefor,which he shall file with the City Clerk and the Collector of Revenues shall report the amount thereof,together with the amount delinquent,to the Board of Trustees at the first regular meeting of said Board in each Month SECTION 13: The City Treasurer shall keep all moneys paid into the Treaau ry from the water rates in a separate fund to be known as the Water Fund. 6. 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 14: Parties wishing water sr or the discontinuance of the same must sign the regular blanks,provided by the Superin- is to be tendent,giving the Street number where service is desired orAdis- each continued. A charge of $.25Awi11 be made for cutting on or cuttin off the water service which said charge shall be added to the next bill of the consumer. Where the prospective consumer is more than 150 feet distant the nearest main -or service pipe on the Street or alley next to the property to be connected or where there is difficulty in getting service to said consumer a contract must be entered into for extra compensation to the City of Azusa,and the Superintendent shall recommend such extra compensation after he shall have made an ex- aminA9ion of the case. SECTION 15: Ordinance number 104 entitled" An ordinance establish, ing water rates to be charged by the City of Azusa,and prescribin, rules and regulationd concerning the use of water and fixing a penalty for the violation thereof,and repealing all ordinances or parts of ordinances in conflict therewith" and all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 16: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once in the Pomotropic,a weekly Newspaper of general circulation published an circulated in the City of Azusa,and thereupon and thereafter the dame shall be in full force and effect.
