' WHEREAS, The Board of Trustees of the City of Azusa, Cal- ifornia, at a regular meeting thereof, held on the 22nd day of August, 1910, by a vote of two-thirds of all its members duly passed and adopted a resolution determining that the public j interest and necessity demanded the acquisition, construction and completion by said City of Azusa of a certain municipal improvement, to wit, street work , as follows: That that portion of the roadway of Azusa Avenue in said City of Azusa from the city limits on the north to the city limits on the south including all intersections of streets (excepting such portions of said street and intersections as y are required by law to be kept in order or repair by any person or company having railroad tracks thereon) be improved by the construction of oiled macadam and oiled pavements, Stutters and culverts in accordance with the plans and profile on file in the office of the City Engineer, and specifications for the con- struction of oil macadam and oil pavements and gutters and cul- verts on file in the office of the City Clerk of the City of Azusa, said specifications being "City Engineer's Special Spec- ifications Number 1OU" except that said street shall be macad- amized for the 4idth of eight feet only along each side of the center lire thereof, and shall have seven -foot shoulders, as specified in said specifications instead of the Whole width of said roadway, but that between the south line of 9th Street and the north line of Sixth Street said roadway shall be oil macad- amized for eight feet on each side of the center and oil pave- ments for the rest of the width; That that portion of the roadway of Centre Street in said City of Azusa from the city limits on the west to the city 1 1 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 -2- limits on the east'inclgd.ing all intersections of streets (excepting such portions of said street and intersections as are .required by law to be kept in order or repair by any person or company having railroad tracks.thereon) be improved by the construction of oiled macadam and oiled pavements and culverts in accordance with the plans and profile on file in the office of the City Engineer, and specifications for the construction of oil macadam and oil pavements and culverts on file in the office of the City Clerk of the City of Azusa, said specifica- tions being "City Engineer's Special Specifications Number 1001" except that said street shall be macadamized f or the width of eight feet only along each side of the center line thereof, and shall have seven -foot shoulders, as specified in said specifications instead of the whole width of said road- way, but that between the east line of San Gabriel Avenue and the west line of. Dalton Avenue said roadway shall be oil maead- amize6 for eight feet on each side of the center and oil pave- ments for the rest of the width; And that the estimated cost of said municipal improvement was Forty Thousand- Dollars, and that such cosi, was anu "is, — too great to be paid out of the ordinary annual income and rev- enues of said City, and WHEREAS said resolution was approved by the Executive of said City, to wit, the President of said Board. of Trusteesr on said 22nd day of August, 1910, at said meeting of said Board, andwas duly published on the 26th day of August, 1910, in THE PUMIOTRUPIC, a weekly newspaper of general circulation pub- lished and circulated in said City of Azusa; 1910, and said ordinance was thereia)on duly pub- lished once a week for two weeks in THS POMOTRUPIC, a weekly nevwspap er of general circulation, published less than six days a week in said City of Azusa; and WHEREAS, Such special election was duly held on the 20th day of October, 191U, as provided by said ordinance calling the same and by law for holding municipal elections in said City; and the proposition of incurring a bonded in- debtedness of Forty Thousand Dollars for the purpose of acquiring, constructing and completing by said City of Azusa of a certain municipal improvement, to wit, street work, received more than two-thirds of the votes of all the voters voting at such special election; and WHEREAS, All and singular the provisions of the Act of the Legislature of the State of California entitled "An Act authorizing the inenrring of indebtedness by cities, towns and municipal corporations for municipal improvements and regulat- ing the acquisition, construction or completion theraof," which became a law February NO, 1901, together with all am enMents thereto and the law and ordinances of said City have been fully complied with so as to authorize the issue of said bonds; NUW, TH REFORE, The Board of Trustees of the City of Azusa do ordain as follows: Section l: That bonds of the said City of Azusa in the sun of Forty Thousand Dollars be issued in accordance with the provisions of the Act of the Legislature of the 0tate of California entitled "An Act authorizing the incurring of in- debtedness by cities, tovms and municipal corporations for municipal improvements and regulating the acquisition, con- struction or completion thereof," which became a lava February 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24- 26 426 27 28 29 30 31 32 25th, 1901, and the Amendments thereto, and with the ordinan-. ces of said City; that said bonds shall be eighty in number and shall be issued in the denomination of Five Hundred Dollars each, and the principal and interest thereof shall be payable in lawful money of the United States: They shall be dated December 15th, 1910, and bear interest at the rate of six per cent per annum, payable semi-annually on the 15th of December and the 15th of June of every year. Said eighty bonds shall be payable in -the manner follow- ing: One -fortieth part of the whole amount of such indebtednary shall be paid Deceiaber 15th, 1911, and one -fortieth part of the whole amount of such indebtedness each and every year thereafter at the City Treasury of said City, together with the interest on all sums unpaid at such date, and said bonds shall be substantially in the following form, to .Jit: No........... (year of maturity) the City of .Azusa, California, iaill pay to the bearer at the office of the City Treasurer of the City of Azusa the sum of Five Hundred Dollars, aith interest at the rate of six per cent per annum, payable semi-annually on the 15th day of Decelaber and the 15th i day of June, of aaeh year, as ppecified in the interest eou:ons hereto attached, at the office of the City Treasurer, u7:on the presentation and. surrender of said interest, coupons. IT IS FUTIHER CR'RTMED that all the requirements of law and of the ordinances of the City of Azusa hate boon fully coilplied with by the proper officers for the issuing of this bond; that this issue of bonds has been duly authorized by the vote of two-thirds of all the voters voting on the question of such issue, at a special election duly and .regularly called and held in said. City on the 20th day of October, 1910, and that the total maount of this issue together with all indebtedness of said City does not in the aggregate exceed fifteen per cent of the assessed value of all the real and personal property of the said City of Azusa, nor does it exceed. the limit prescribed by the Constitution and Laws of the Mate of California. That the President of the Board of Trustees of the City of Azusa, being the Executive of the municipality, ann the City Treasurer of said City are hereby authorized and diracted to sign all the bonds herein provided for, and the City Clerk is hereby authorized and directed to countersign the smne and to affix the corporate seal of the City of Azusa thereto, and the City Treasurer of said City is hereby withorized and directed to sign the inter,st cou;ons of said bonds, and said bonds shall be d -livered by said City Clerk to said City Treas- urer in such amounts as the Board of Trustees of said City may from time to time determine. Section 3.
