HomeMy WebLinkAboutOrdinance No. 1321 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE NO.L3j AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF AZUSA,PROVIDING FOR THE REGULATION OF LODGING+; houses,HOTELS,SL.F.EPING-APARTMENTS AND ROOMS,AND PROQ VIDING A PENALTY FOR THE VIOLATION THEREOF. The Board of Trustees of the City of Azusa do Ord- uin as follows: Section I. Every person who owns,leases,lets,or hires, to any person or persons,any room or apartment in any buildin house or any other structure,within the 81ty of Azusa,County of Los Angeles,State of California,for the purpose of a lodgi or sleeping apartment,which room or apartment contains less than five hundred cubic feet of space,in the clear,for each person so occupying such room or apartment,shall be deemed gu ty of a misdemtanor,and shall,upon conviction thereof,be pun- ished by a fine of not less than ten ($IO.00)or more than ninety 090.00) dollars,or by imprisonment in the City Jail of the said City of Azusa,not to exceed ninety (90) days,or by both such fine and imprisonment. , Section 2. Any person or persons found sleeping or lod- ging,or who hires or uses for the purposes of sleeping in,or lodging in,any room or apartmen�,which contains less.than fiva hundred (500) cubic feet of space,in the clear,for each perso so occupying such room or apartment,shall be deemed guilty of a misdemeanor,and shall,upon convietion,be punished by a fine of not less than five ($5.00) dollars,or more than fifty($50. dollars.or by both such fine and imprisonment. Section 3. It shall be the duty of the City Marshal of the City of Azusa,or such other persons to whom the police powers of the City of Azusa shall have been delegated,to exa- mine into any violation of any of the provisions of this Ord- inance,and to arrest any person guilty of any such violation. 1 2 3 4 Fi 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 39 (2) person,firm or corporation for whom issued,the location or place of business where said business is carried on . The City Clerk shall deliver said license to the City Tax and License Collector for collection and take a receipt therefor. And it shall be the duty of the City Tax and License CollectorMA to collect the same and pay the same over to the City Treasurer of the City Of Azusa. Section 3. The rate of license for conducting,managing or carrying on a..billiard,bagatelle or pool room in the City of Azusa shall be $75.00 per annum,payable quarterly in advance, for each billiard,bagatelle or pool room or combination thereof containing Eight (8) billiard,bagatelle or pool tables or less, and for each and every billiard,bagatelle or pool table in ex - coos of Eight (8) in number,the license shall be $10.00 per annum per table,payable in the manner herein above provided. And such billiard,bagatelle or pool room shall be kept closed on Sundays and from eleven thirty o'clock P.W.until six o'clock in the morning on all other days,and minors under Eigh- teen (I8) years of age shall not be allowed to be present or frequent any such billiard,bagatelle or pool room;and no licen- se shall be issued under this Ordinance by the City Clerk un- til the Board of Trustees shall have first issued a permit the- refor,and the said Board of Trustees shall have the right to grant or refuse such permit under this Ordinance in its discrei- tion.A separate license.must be obtained for each branch estab- liehment or separate place of business. Section 4. Upon the revocation of the license,no part of the .7 17 it money in the hands of the City shall be returned and all such 1 >^ 18 license fees shall be forfeited to the City. All ordinances or parts of Ordinances in �3 23 conflict herewith are hereby repealed. 24 Section 7. The City Clerk shall certify to the tbra 7- 25 adoption of this Ordinance and shall cause the same to be 26 ! published in the °Pomot topic " a weekly newspaper published 'a7 27 j and circulated in said City of Azusa and hereby designated 28 i for that purpose,and thirty (30) days after said publication i 29 i the same shall take effect and be in full force. 30 I 30 The foregoing Ordinance was adopted at a regular meeting r1 31 of the Board of Trustees ____ .____ _____ __ ________ of the 322 3 .I City of Azusa. held on the 1 -12e - City of ,I912,by,the II 1 2 3 4 5 6 7 8 9 10 11 12. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 I�` (4) has become dangerous to health or life,or is unfit for human habitation because of defects in drainage,plumbing,ventilatien, or construction of the same,or by reason of the existence of a nuisance on the premises which is dangerous to the health or life of the occupants of khsxkKii1x of such buildings or rooms, the said Committee an Sanitary and Police may issue an order requiring all persons therein to vacate any such buildings or any part thereef,and the reason for such order shall be stated theroin.Said Committee shall casuse such order to be affixed conspicuously in the building or part thereof ordered to be vac- ated,and to be served personally an the owner,lessee,agent,occu- pant or any person conducting,operating,having charge,control er management thereef.If any such person cannot be found in the City of Azusa or does not reside thereim or evades or resists service,then such order may be served upon such person by dep- ositing a copy thereof in the posteffice in the City of Azusa, postage prepaid properly enclosed,sealed,and addressed to such person at his last known place of business or residence.Such building or part thereof shall be vacated within ten days after such order shall have been posted and served or mailed as herein provided,or within such shorter tims,not less than twenty-four (24) hours,as in such order may be specified;but said Committee may revoke such order whenever it shall satisfactorly appear to said Committee that the danger from said building,reoms or parts thereof has ceased to exist,or that said building or rooms. has been repaired so as to be habitable,and so as to conform to all laws,ordinances and regulations then in force. It shall be unlawful for any person,firm at or corporation to fail or refuse to comply with.any order of the Committee on Sanitary and Police made or given in pursuance or under authorit Of the provisions of this section. It shall be unlawful for any persen,firm or corporation to occupy or to cause or permit to be ii (5) ! 1 occupied,any building,room or portion thereof which has been or -1 2 dared closed or vacated under the provisions of this section 3 1 until after such order has been revoked as herein provided. 4 Section I2. It shall be unlawful for any %tam person,firm 5 or corporation to fail,refuse or neglect to comply Ratk promptly i 6 with any notice,order or direction of the Sanitary and Police 7 I Committee,issued by virtu of this ordinance. 8 ( Section I3.Every person,firm or corporation violating any 9 of the provisions of this ordinance shall be deemed guilty of a I 10 misdomeaner,and upon conviction thereof in any court having jur- 11. isdiction thereof shall be punishable,where not otherevrise spec - 12 �j cifically provided for in this ordinance,by a fine of not less 13 iI than five ($5.00) dollarsnaa nor more than three Hundred ( 300.0 ) 14 ( dollars or by imprisonment in the City Jail of the City of Azusa, 15 for a period of not less than five (5) days nor more than nine - 16 ty (90) days or by both such fine and imprisonment. i 17 Ij Section I4. All ordinances or parts of ordinances in con - 18 flict with the provisions of this ordinance are hereby repealed. I 19 i Section I5.
