HomeMy WebLinkAboutOrdinance No. 143ORDINANCE NO._, -V AN;ORDINA1ZCE ESTABLISHING THE SALARY OF THE CITY RECORDER OF THE CITY OF AZUSA'AND ESTABLISHING FEES TO BE CHARGED BY SUCH RECORDER. The Board of Trustees of the City of Azusa do ordain as follows: Section 1. That the salary of the City RO.corder of the City of Azusa be and the same is hereby fixed at the sum of per month, payable at the same time and in the same manner as other salaries of the City officials of the City of Azusa are paid and such salary shall be in full compensation for all services rendered by such Recorder. Section 2. That the said Redorder shall charge and collect the following; fees for the following services, to -wit: For all services to be performed by him before trial, in a civil action and in all cases where judgment is rendered by default or confessi>4, s including execution and satisfaction of judgment, two dollars; and for j the trial and all proceedings subsequent thereto, including all affidavits, swearing witnesses and jury, and the entry of judgment and C issue of execution thereon, three dollars. For taking bail after commitment by anotner magistrate, fifty cents. For certificate and transmitting tpanscript and papers on appeal, one dollar. For copies of papers on docket, per folio, ten cents. For issuing a search warrant, to be paid by the party demanding the same, fifty cents. For celebrating a marriage, and returning a certificate thereof to the county recorder, three dollars. For taking an acknowledgment of any instrument, for the first name, fifty cents; for each additional name, twenty-five cents. For taking depositions, per folio, fifteen cents. For administering an oath, and certifying the same, twenty-five cents. For issuing a commission to take testimony, fifty cents. I I I e 1 For all services connected with the posting of estrays, one dollar. section 3. That said Recorder must demand the payment of all fees in advance, section 4. That said Recorder shall, on them day of each month, file with the City Clerk of the City of Azusa a statement show- ing the title of each action filed before him, the amount of fees chargeable against.- each actioni and the amount collected thereon during the preceding month in each action pending in his Court, the fihe collected in criminal actions during the preceding month and the final disposal of each criminal action finally disposed of during the preceding month; which statement shall be presented to the Board of Trustees of the City of Azusa at its first meeting on each month and shall, on the first Monday of each month, pay to the City Treasurer all moneys collected by him in his official capacity. section 5. That said City Recorder be and he is hereby required to execute, to the City of Azusa, an official bond in the penal sum of $500.00. That said bond shall be joint and several in form and shall be signed by at least two sureties who shall justify by making affidavit that he is a free holder, resident of the City of Azusa, California, and is worth the principal sum named in the bond, over and above all of his just debts and liabilities, exempt from execution. Said bond shall be conditioned that the principal therein will well and truly perform all the duties of the office of the City Recorder of the City of Azusa, and of all the offices for which the said principal, by reason of his said office is ex officio incumbent, provided,also, that the said Board of Trustees may accept, as sole and sufficient surety on such bond, any corporation entitled to execute such bond under the laws of the State of California. That said bond shall be subject to the approval of the Board of Trustees of said City and, after being so appointed, shall be filed with the President of the Board of Trustees of said city, section 6. That the appointee for such office shall present his bond to the President of the Board of Trustees within five (5) days after receiving notice of his appointment to such office, -2- Section 7. The City Clerk shall attest to the adoption of this ordinance and shall cause the same to be published once in the Pomotropic,.a weekly newspaper printed, published and circulated in the City of Azusa, and the same shall become effective at the expiration of thirty days from the date of the final adoption thereof. The foregoing ordinance was duly adopted at a regular meeting of the Board of Tvnstees of the City of Azusa held on the X'� day of 1913, by the affirmative vote of at least three trustees of said city, to -wit: Ayes.
