AJ ORDINANCE GRAIITING P—MMISSION TO THE PACIFIC ELECTRIC RAILWAY COI.°,i'ANY TO CONSTRUCT A RAILROAD TRACK OVER AND ACROSS A PORTION OF NINTH STF.EET, AND A T,7EIVY FOOT ALLEY BETWEEN AZUSA AND AL&ME DA STREW3. -000- The Board of Trustees of the iity of Azusa do ordain as follows: Section 1. That the right and privilege is hereby grated to the Pacific Electric Railway Company, its successors or assigns, to construct and maintain a single spur track and to operate the same with electricity, over and across a portion of Ninth Street, and a twenty foot alley between Azusa and Alameda Streets, described by center line as follows: Beginning at a point in the center line of Pacific Electric Railway Company's east bound track of the ::;onrovia -Glendora Line, distant 5.75 feet south and 38.02 feet west of the intersection of center line of Ninth Street and Alameda Street; thence south westerly along the arc of a 100 foot radius curve to the left, a distance of 17.45 feet; thence along the are of a 175 foot radian curve to the left a distance of 64.90 feet to a point in the south line of Ninth Street, distant 65.78 feet west from the southwest corner of said Ninth and Alameda Streets; thence contin- uing along are of said 175 feet radius curve, across Lots 1, 2, 3 and 4 of Block 20of Town of Azusa, a distance of 120 feet to a point in the west line of Lot 4, distant 90.80 feet south of northwest corner of Lot 1; thence continuing along are of said curve a distance of 59.45 feet to a point in the center line of a 20 foot alley in Block 20 of said Town of Azusa; thence south along said center line of alley, a distance of 208 feet, more or less, to an intersection with the southwesterly prolongation of the southeasterly line of Lot 13 of said Block 20. Provided, however, that said railroad shall be constructed and at all times maintained in accordance with and subject to all and every of the terms and conditions of this franchise, and not -1- otherwise. and provided farther, that said railroad cos..pany shall within ten days after the publication of this ordinance, file with the Board of Trustees of the City of Azusa a written acceptance of this ordinance and an agreement to conform to and abide by all the provisions of this ordinance. Section 2. That all work done in constructing sail railroad crossing and in maintaining same shall by done in a workmanlike manner and to the satisfaction of the Board of Trustees and Supe rin- tendent of Streets of said City of Azusa, and in accepting this grant said railroad company agrees to keep such railroad crossing in complete repair and to the grade of said street and so as not to interfere with traffic over the same. Section 3. That said Pacific Electric Railway Company, by accepting this 3yrart, agrees to pay to the City of Azusa all costs occasioned to the City of Azusa by the adoption and publi- cation of this ordinance, so that the same may conform to the re- quirements of law. Section 4. That the failure of said grantee, the Paeific Electric Railway Company, its successors and assigns, to conform to and comply with the provisions and conditions hereby imposed by the terms of this ordinance within thirty -(30) days after notice served upon said company by said City of $zusa, shall be deemed sufficient cause for said City of Azusa to revoke this permit. Section 5. The City Clerk shall certify to the passage of this ordinance and caase�the saline to be published once in the "The Pomotropic" a weekly newspaper of gedneral cir- (3th culation, published and circulated in said City a 1I erelfter same shall take effect and be in force.
