HomeMy WebLinkAboutOrdinance No. 1731 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE 30, 173 AN ORDIM'AACE OF THE BOARD OF TRUSTEES OF THE CITY OF AZUSA, ESTABLISHING THE RATE TO BE CHARGED BY TRP, CI'T'Y OF AZUSA FOR WATER AND WATIMR OM"WITIONS, AND PRESCRIBING RULES AND REGULATIONS CONCERNING THE USE OF WATMv AND FIXING A PENALTY FOR THE VIOLATION THEREOF, AND R&PRALING ALL FORM ORDINANCES IN CONFLICT WITHBTHIS ORDINANOM, The Board of Trustees of the City of Azusa do ordain as follows: Section 1. That the monthly rate to be charged and collected by the City of Azusa for the water supply from its water works to consumers, shall be as follows: DMSTIC RATE.. 1. Flat Rate: $.75 per 1000 cubic feet; rates to be adjusted by the Superintendent on said scale on basis of assumed consumption, but no charge shall be less than $.75. Tenement occupied by a single family, the minimum rate shall be 0,75. (A tenement shall be construed to mean W person or persons or family who are living together under the same roof, and boarding at one and the same table). 2. }dor stores of less than 360 square foot, not having bath, toilet, urinal, sink, or stationery wash -stand in use, the minimum monthly rate oh,611 be *,.50. 3. All places of business not above olassified, the minimum rate shell be x`.75. Where a person or persons reside in -a place of business, family rates shall be charged. 1. 4. The City of Azusa shall have the right and option Of installing a water motor for any consumer, whereupon meter rates will be charged as follows: Fox any quantity used, each month up to 3.000 cubic feet, x".50. Provided that, if the amount of any bill shall not be an exact multiple of five cents, such bill shall be reduced or increased to the nearest multiple of five cents, as the case may be. There shall be no charge less than fifty cents where a meter is used. That where a meter fails to register during any period, a charge shdll be made upon an. estimate based upon the reading of the preceding month, or where a meter has not been set for a month, then during such period as such meter shall have registered. IRRIGATIBG RAT'B. That the rate to be charged and collected by the City of Azusa; for all the water to be supplied hereafter by said City for irrigating purposes, is hereby fixed as follows: $.02 per miner's inch per hour, continuous flow, pro- vided however, that all water the City shall supply for ir- rigating purposes shall be supplied by said City only through and by the rental, for a limited period, of the water stook of the Azusa ttrIS&trL%g Company and owned by the City, each share of said water stook entitling the user thereof to the same amount of water as is provided for in the by-laws of said Azusa Tirtga+Lng Company, a corporation. The City of Azusa hereby declares that all water, which it now has or may reasonably acquire from its present water system, is needed for the present and future domestic supply for the inhabitants of the City of Azusa. Section 2. The charge for each tap or attachment made with its system of water works, shall be as follows: For each 1/2 inch corporation stop, using 1/2 -inch service pipe, $10.00. For sash .3f4 inch corporation stop, using 1-inoh service Pipe, 01£.0o. The City reserves the right, at any time{ without notice; to shut off the water in its mains or services, for the purpose of making repairs or extensions, or for other necessary purposes, and all persons having boilers on their premises are hereby cautioned against direct connection with the main. All pipes or extensions oonnoot.ing with the City mains afid laid by any person on any public street, place or alley, shall at ones become the Property of the City, and ouch person shall not have any jurisdiotion over them, nor may such pipes or extensions be removed by such person. And there shall be a stop cook in every attachment on the side walk, just inside of the curb, at a point to bo designated by said City, which said stop cook and its box shall be supplied by the City and shall be for its exclusive use and under its exclusive control. The City will not be responsible for damages to any buildings or their contents from any break beyond the street service box or meter; and water consumers are hereby required to provide, at their own expense, another stop cock to be placed at the first suitable point beyond the stop or meter of the City, trhen more than one service ripe is supplied from one attachment, there shall be as many protection stop cooks as there are service pipos. Section , No consumer of water from the City, or arq other person, shall under any circumstances run or convey by any means azU water from hie service on any lot or proporty, I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 i or ecrose any street or alley, or supply tooter to other persons or families, for which such other persona or families are not paying to the City the rate or rates prescribed by the City, and all water furnished to consumers in the City of Azusa shall be charged to the owner of the premises upon which the pater shall have been used, and the owner of said premises shall be held responsible for the payment of the water rates used upon the premises owned by him. I Provided that the water superintendent may permit more than one tenement or person to connect on to a aingle tap leading from the main with the proper stop cook at onoh point on any public street or alley as he may deem proper, and the City may contrast with each or with one for all in such osaes, each party so connected to pay not lose than $.50 per month, and in oase any one of each persons fail to pay the rate provided, one or all of such persona or tennnts in common shall be out off as may be deemed right by the water superin- tendent: A consumer, in the meaning of this ordinance, is one who has the privilege or. opportunoty to use voter from a pipe or service on the promises occupied by him or (by per- mission from the water superintendent) from some line or tap on property near him. And in all cases the city will assume that water has been used where,amg person or persons or tenanti in common have had the opportunity to use the same. and even though anoh person or persons may not have used any water during any month, they will not no entitled tc,any rebate from the regular rate provided in such oases unless they to ve notified the Water Superintendent in _writing to out off such service, and where it is not practical, to turn off said service or person, either owner or occupant, must provide a - 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 i line on the street or alley with service 000ks, so that such service may be out off, otherwise water will be charged to all said tenants in common or persons until the whole service Is out off. The Fater Superintendent shall out or cause to be out off the water in all oases where this Ordinanoe shall have been violated and it shall not be turned on again until all charges due the City, up to the time the water was shut off, including the penalty for delinquency, are paid. Section 4. All rates for water used in any month are due and payable on the third day of the succeeding month. All water rates are payable at the office of the City Auditor, and it not so paid by the 15th of the month, there shall be added ten per cent penalty for delin- quenoy, and the City Auditor shall give notice to the delin- quent by mailing to him a statement of the amount due and the penalty thereon. If the said water rate and the penalty for delin- quency is not paid within five days thereafter. the City Auditor ahall notify the Water Superintendent, who Ehall im- mediately, without further notice, shut, off the water from the premises of the delinquent, and the water shall nota gain be turned on ;for them, except upon the payment of the whole amount due to the City for water used up to the time the water is so shut off, Including the penalty for delinquenay. Section 5. The Water Superintendent or any other authorized officer of the.City shall be admitted at all reas- onable hours to all parts of the premises supplied with water to see that the regulations are obeyed and observed, 170 one except the Water Superintendent, or someone - 5 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 expressly authorized by him shall turn the water on or off from any building or premises. No person shall tap arw water main or in any manner whatever meddle or interfere with any part of said water works without written permission of the water Superintendent. Consumers shall prevent all waste of water and no water faucet or hydrant shall be allowed to remain out of re- pair, or water be allowed to ran therefrom when not in actual use for irrigation or domestic purposes. Section 6, Water rates will be charged for premises vacated in every instance until the City shall have been noti- fied by the owner or his agent in writing, filed with the Superintendent, of the disoontinuance of the use of water and to turn the water off. ,Section 7. All faucets, hydrants, hose, sprinklers, nozzles, irrigation heads or other continuous streams must be shut off promptly upon the alarm of fire, the water not again to be turned on until the fire is known to be extinguished, Section 8. Any parson, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon oonviotion in a Court of competent jurisdiction shall be fined not less than five, nor more than fifty, dollars, or be punished by imprisonment in the City Jail not exoeO ing twenty-five days or by both such fine and impris menta Section 9. .,The office of Water superintendent shall be and. is hereby created and all appointments to such office shall be made by Resolution of the Board of Trustees o4 the City of Azusa, duly passed at a regular meeting thereof, which said Resolution shall also fix the salary or compensation to be paid the appointee therein named and suah appointee shall hold office during the pleasure of said Board of Trustees. - 6 - y 1 Section 10. That such Water Superintendent before enter - 2 ing upon the duties of such office, shall take and subscribe 3 to the constitutional oath of office. 4 Section 11. That such !Vater Superintendent shall have, 5 subject ,to the control of the Board of Trustees, general charge, 6 supervision and control of the water works system of the City 7 of Azusa, and he shall read or cause to be read all the meters 8 on.the 25th, 26th and 27th days of each month and at such times 9 as may be renuired. 10 He shall have general supervision over all repairs, tappings 11 and additions to the system, and out off or c ause to be cut 12 off the water from any consumer upon the written report of the 13 City Agditor, or upon the violation of any of the provisions of 14 this Ordinance, and generally to do and perform every duty, as 15 Water Superintendent,.required by him by law or by any ordinance 16 of the City of Azusa or rule of the Board of Trustees. 17 It shall also be the duty of the Superintendent to keep all 18 accounts relating to the said water works system, and to make 19 out and deliver for collection to the City Auditor, on the 20 third day of each month, receipts with stubs numbered the same 21 as the receipts, for all unpaid water rates for the current 22 month; and charge him therewith. 23 Section 12. The City Auditor shall then proceed at once 24 to collect all such nater rates, and tf the same are not paid 25 by the 15th of the month, he shall thereupon add ten per cent 26 penalty for delinquency to all receipts then in his hands, and 27 j charge him therewith, and the City Auditor shall thereupon pro - 28 i coed as directed in Section 4 hereof. 29 It shall also be the duty of the City Auditor to pay over 30 to the City Treasurer on or before Saturday of each week all 31 water rates collected by him, taking the City Treasurer's re - 32 oeipt therefor, which he shall file with the City Clerk, and 1 and the City Auditor shall report the amount thereof, togethc 2 with the amount delingient, to the Board of Trustees at the 3 first regular meeting of said Board in each month after the 4 collections are closed. 5 Section 13. The City Treasurer shall keep all 6 moneys paid into the Treasury from the water rates An a sep- 7 arate fund, to be known as the tater Fund, anci'the said moneys 8 shall be used for no other purpose than said City Water system. 9 Section 14. Parties wishing water service, or the 10 discontinuance of the same, must sign the regular blanks pro - 11 vided by the Superintendent, giving the street number where 12 service is desired or is to be discontinued. 13 Where the prospective consumer is more ths. 150 14 feet distant from the nearest main or service pipe on the 15 street or alley next to the property to be connected or where 16 there is difficulty in getting service to said consumer$ a con - 17 tract must be entered into for extra compensation to the City 18 of Azusa, and the Superintendent shall recommend such extra 19 compa•nsation after he shall have made an examination of the 20 case. 21 Section 15. Ordinance 104, entitled"An Ordinance 22 establishing water rates to be charged by the City of Azusa, 23 and prescribing rules and regulations concerning the use of 24 water and fixing a penalty for the violation thereof. and 25 repealing all ordinances, or parts of ordinances, in conflict 26 therewith*; and Ordinance 115, entitled "An Ordinance establish - 27 Ing water rates to be charged by the City of Azusa and pre -- 28 scribing rules and regulations concerning the use of water arb 29 fixing a penalty for the violation thereof,"etc; are hereby 30 repealed; and all other ordinances or p parts of ordinances in 31 conflict with this ordinance are hereby repealed. 32 -8- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 Section. 16, The City Clerk shall certify to the passage of this ordinance, and shall cause the same to be published once in the,,pomotropio", a weekly newspaper of general eireulation, published and circulated in the City of Azusa, and the same shall take effect and be in full force thirty days from and after its said passage.
