2 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY
OF AZUSA LICENSING AND REGULATING CERTAIN KINDS OF
3 BUSINESS CARRIED ON IN SAID CITY AND FIXING A PENALTY
FOR THE VIOLATION THEREOF, AND REPEALING ORDINANCES
4 NO. 130 AND NO. 180 OF SAID CITY AND ALL OTHER ORDINANCES
AND PARTS OF ORDINANCES OF SAID CITY IN CONFLICT HERE -
5 WITH.
6 11 The Board of Trustees of the City of Azusa do ordain
7 Has follows:
e Section 1. It shall be unlawful for any person; wheth-
9 er as principal or agent, owner or employee, either for himself
10 or any other person, or for any body corporate or otherwise, or
11 as an officer of any corporation, to commence or carry on with -
12 in the corporate limits of the City of Azusa any business trade,
13 calling, profession, or occupation in this Ordinance specified
14 without having first procured a license from said City so to do,
16 and each and every day or fractional part of a day that said busi-
16 ness, trade, calling, profession or occupation in this Ordinance.

for himself or for'any other person or persons or for any body
coporate or otherwise, commence or carry on such business, trade,
calling, profession or occupation aforesaid, without first having
procured such license, shall, for each violation of the Ordinance
be deemed guilty of a misdemeanor, and upon conviction thereof
shall be fined not more than One Hundred (Y100.00) Dollars nor
less than Three (52.00) Dollars, or imprisoned for a term not ex-
ceeding fifty (50) days in the City Jail of the City of Azusa, or
shall be punished by both such fine and imprisonment, in the
discretion of the court, and the amount of suchlicense shall be
eemed a debt due to said. City of Azusa, and such person shall be
iable to an action in the name of the City of. Azusa in any court
f competent jurisdiction, for the amount of the license of such
usiness, trade, calling, profession or occupation, as he

shall or they may have engaged' in, with costs of suit; and in ad-
dition thereto, a penalty of Twenty-five ($25.00) Dollars must be
added to the judgment as costs 'Lo be collected from the defendant
or defendants.
Section 2. It shall be the duty of the City Clerk to
prepare and issue a license under this Ordinance for every person
liable to pay a license thereunder, duly signed by the President of
the Board of 'Trustees, and the City Clerk and attested with the
city seal, and to state in each license the amount thereof, the
period of time covered thereby, the name of the person, firm or
corporation for whom issued, the business, trade, calling, pro-
fession or occupation licensed, and the location or place of busi-
ness where such business, trade, calling, profession or occupation
is to be carried on, and the City Clerk shall deliver such license
to the City Tax and License Collector for collection, taking his
receipt for the same, and the City Clerk shall report to the Board
of Trustees at.its first meeting in each month, the amount of such
licenses so delivered to the City Tax and License Collector during
the previous month.
In no case shall any mistake by the City Clerk in stat-
ing the amount of a license prevent or prejudice the collection
for the City of what shall be actually due, with all costs, against
anyone for carrying on said business without a license, or refusing
to pay the license fees specified herein.
Section 3. The City Tax and License Collector shall,
proceed at once to collect such licenses and shall on or before
the first Monday in each month deliver to the City Clerk all license
remaining unpaid for the previous month, and also a list of all
persons whom he believes not to be on the license list, and who
should be charged with the payment of license; and he shall pay
over to the City Treasurer all licenses collected by him in said
month, taking the City Treasurer's receipt therefor in duplicate,
one of which receipts he shall file with the City Clerk and said
City Tax and License Collector shall report the amount of licenses
collected by him, together with the amount delinquent, to the Board
of Trustees at its first meeting in each month.
It shall be the duty of the City Clerk, immediately after
the. unpaid delinquent licenses have been delivered to him, to add
the penalty on the same hereinafter provided for.
Section 4. All licenses shall be paid in advance in the
legal currency of the United States, at the office of. the City Tax
and License Collector. A separate license must be obtained for
each branch establishment or separate place of business in which the
trate, calling profession or occupation is carried on, and each
12 license shall authorize the party obtaining it to carry on, pursue
13 or conduct only that trade, calling profession or occupation des -
14 cribed in such license, and only at the location or place of busines

is Section 5. The monthly license in this ordinance provid-
17 d, shall be due and payable to the city on the first of each month
18 in advance, from all persons who have for the previous month been
is Licensed to carry on the same trade, calling profession or occupa-
20 ion, and from all persons who have not been previously licensed
21 or the same trade, calling; profession or occupation, the license
22 shall be due and payable, and must be procured. by such persons be -
23 fore commencing to carry on such trade, calling, profession or
24 occupation.
25 The quarterly license in this ordinance provided shall be
26 due and payable to the city on the first days of January, April,
27 July and October and all such licenses shall expire with the last
26 days of Furth, June, September and December of each year, but the
29 first quarterly license issued to any person, as herein provided,
30 shall be issued for the unexpired portion of such quarter, and a
31 proportionate amount shall be charged for the same for such unex-
32 oired portion of such quarter.

A penalty of twenty-five (25) cents shall .b e added to

Section 6. Every person, firm or corporation having a

license under the provisions of this Ordinance and carrying on a

business trade, calling, profession or occupation, at a particular
18
place of business, shall keep such license posted and exhibited
19
while in force in some conspicuous part of said place of business.

Everypeddler of goods, wares or merchandise shall carry his lic-
21
ense with him at all times while engaged in peddling. Every person
22
driving or having control of any vehicle which is required by this
23
Ordinance to be licensed, shall procure from the City Clerk a tick -
24
et or plate bearing a number, which shall at all times be attached.

All persons, firms or corporations having a license, shall

roduce or exhibit the same when applying for a renewal and when -

ever requested to do so by the City Tax and License Collector or

any police officer of said City.

Section 7. The City Tax and License Collector and. all

1 police officers of said City shall have and exercise the power,
2 first, to make arrests for the violation of any of the provisions
3 of this Ordinance; second, to enter, free of charge, any place
4 of business for which a license jp required and provided, and to
6 demand the exhibition of such license for the current term for
6 any person engaged or employed in the transaction of such business;
ry and if any person shall then and there fail to exhibit such li-
b cense, such person shall be liable to the penalty provided in
s Section 1 of this Ordinance.

11 Collector to cause complaints to be filed against all persons
12 violating any of the provisions of this Ordinance.
13 Section 8. The conviction and punishment of any person
14 for transacting any business, trade, calling, profession or occupa-

16 tion without license shall not .excuse or exempt such person from

qe&< 16 the payment of any license due or unpaid at the time of such con -
2 17 viction, and nothing contained herein shall prevent a criminal
18 prosecution for any violation of the provisions of this Ordinance.
19 Section 9. When the word "person", or the word "per -
20 sons" is used in this Ordinance, referring to those liable to pay
21 Ilicense or tax, the same are, and each is, intended and shall be
22 onstrued to mean and include every person, firm, association
23 or corporation conducting or carrying on the business, trade,
24 alling or occupation :for which such license must be procured.
26 Section 10. The rates of licenses for the businesses,
26 Lrades, callings, professions and occupations hereinafter named,
try 3hall be, and the same are, hereby fixed and established for and
28 vithin the City of Azusa according to the following schedule, and
29 he same shall be paid by all persons, engaged in such businesses,
3o rades, callings, professions or occupations, as follows, to -wit;
31 Section 11. For every person engaged in conducting or
32 ianaging any place of amusement., moving picture show, entertain-

ment or exhibition other than a circus or tent show, $3.00 per

quarter, or $2.00 per day, provided that whenever the receipts for
3
any exhibition, concert, lecture or entertainment are to be or
4
will be appropriated to any church or school, or to any religious,
5
benevolent, patriotic or civic purpose within the City of Azusa

there shall be no license charged to the person or persons about

Section 12. For every person carrying on the business

of advertising by postinrr, sticking, tacking, affixing or paint -
18
ing bills or signs to or upon posts, fences, bill boards, adver-
19
tising sign boards, buildings or other structures, or the business
20
of advertising by distributing posters, dodgers or printed adver-
21
tisements of any kind, $100.00 per year or $1.00 per day.

For the purposes of this section the expression "carrying
23
on the business" is defined to be, and is construed to mean the
24
doing or performing of any, act or series of acts of advertising
26
by any means or in any manner in this 54�otion specified, or the
26
doing or performing of any act or series of acts of posting, stick -
27
ing, tacking, affixing or painting bills or signs to or upon posts .

ences, bill boards, advertising sign boards, buildings or other
29structures;
or of displaying advertising thereon.

Section 13. For every person who sells any goods, wares

r merchandise by public auction, $3.00 per day.

on the business of soliciting orders for paintings, pictures,
portraits, photographs, or orders for advertising, or for books,
magazines, or for selling or distributing coupons or certificates
purporting to be of commercial value, or orders for the sale of any
kind of goods, wares or merchandise when not in conjunction with
carrying on any store or fixed place of business in the City of
Azusa, $5.00 per day, provided that no license shall be required
from any person whose business is limited to the sale of goods,
wares or merchandise at wholesale or to the soliciting of orders
for the same at wholesale.
Section 15. For every person conducting, managing or
carrying on a circus or a tent show or performance ofy kind

under canvas, or a trained animal show or exhibition/in a build-

Section 16, For every person carrying on the business
of dealing in medicine other than in a regularly established drug
store, or peddling the same, or treating diseases of the human
body, who calls attention to his wares or method of treatment or
advertises the same by the use of music, entertainment, speech or
other device, the sum of $10.00 per day.
Section 17. For conducting any street stand for the
selling of any goods,wares or merchandise on any portion of the
public streets within the City of Azusa, $1.00 per month, pro-
vided that no license shall be issued for any such stand until a
permit has first been obtained from the Board of Trustees, and
that the application for such permit must be accompanied by the
written consent of the owner or occupant of the premises abutt-
ing immediately upon that portion of the street which the appli-
cant desires to use; and further provided that the said Board of
Trustees shall have the right to grant or refuse such permit under
this Section, in its discretion.
Section 18. For every person, firm, or corporation

managing or carrying on a bowling alley, boxball alley or a simi-
lar business, $1.00 per quarter for each alley, provided that
such bowling alley or box�ball alley shall be kept closed from
12 o'clock P.M. until 6 o'clock A.M. of the next day and on Sundays
as hereinafter provided, and provided further that no license
shall be issued under this section until the Board of Trustees
shall have first issued a permit therefor, and that the said
Board of Trustees shall have the right to grant or refuse such
permit under this section in its-discretion.,'and that said per-
mit or license shall not be transferred without the consent of
said Board of Trustees first obtained.
Section 19. For every person engaged in carrying on
the business of a ring thrower or knife throwing rack, or ball
throwing exhibition, $2,00 per day.
Section 20. For every person in the Qity of Azusa run-
ning any cart, dray, express wagon, automobileor vehicle for the
transportation or delivery of freight or goods for hire, a quart-
erly license for each cart, dray, express wagon, automobile or
other vehicle in accordance with the following schedule:
For each automobile truck not to exceed 2 tons capacity
1$3.00.
For each automobile truck exceeding 2 tons capacity and
not exceeding 4 tons capacity, $4.00.
For each automobile truck exceeding 4 tons capacity,
1$6.00.
For each horse drawn vehicle so engaged, $4.00 per annum.
Section 21. For everyperson, firm or corporation con—
ducting or carrying on a merry -g6 -round, shooting gallery, skat-
ing rink or any similar enterprise for furnishing amusement not
otherwise mentioned herein, $10.00 per month provided that none
of said businesses mentioned herein shall be licensed until the
Board of Trustees shall have issued a permit therefor, and that

3 Section 22. -L"or every person who carries on, practices
4 or professes to practice the business or art of astrology, palm -
6 istry, phrenology, card reading, fortune telling, cartomacy,
6 clairvoyance, clairaudience, crystal gazing, hypnotism, medium -
7 ship, prophecy, augury, divination, magic or necromancy, and who
8 demands or receives a fee for the practice, exercise or exhibi-
9 tion of his art therein or who gives an exhibition thereof at
to any place where an admission fee is charged, $10.00 per day.
11 Section 23. .Por every person conducting or carrying
12 on the business of peddling any kind of goods, wares or merchan-
13 dise, afoot when not in conjunction with a fixed place of business
14 in the City of Azusa, $5.00 per day.

16 Section 24. i"br every person conducting or carrying

16 on the business of peddling fruit, vegetables or any kind of
w m 17 goods, wares or merchandise not otherwise specified herein, or
18 peddling, selling and delivering gasoline, kerosene, refined oil
19 or petroleum products of any kind, from a wagon or vehicle on a
20 regular route and. at fixed intervals, when not in conjunction with
21 a fixed place of .business in the '%ity of Azusa, for each wagon,
22 $12.00 per annum and when not on a regular route and at fixed in -
23 tervals, $2.00 per day, provided that each of such Wagons or ve-
24 hicles shall be designated by a number to be furnished by the
26 City Clerk and placed thereon in the manner above specified; pro -
26 vided further that a person holding a license under this section
27 shall not be permitted to remain in or permanently occupy anyone
28 place upon the public streets, but shall only have the right under
29 such license to travel along the street in the usual and customary
30 manner in order to carry on such business.
31 Section 25. xor every person doing business as a tran-
32 sient merchant therein, which shall include all merchants doing

business at fixed place of business for a period of less than
thirty (30) consecutive days, $5.00 per day.
Section 26. For every person conducting, managing or
carrying on the business of junk dealer or the business of junk
collector for himself or any other person, $25.00 per year or
$5.00 per day.
\ Section 27. For every person conducting or carrying on
the business of plumbing, gas fitting or tinning or electric wir-
ing, or doing any plumbing, gas fitting, tinning or electric wir-
ing for compensation or hire in the City of Azusa, the license
shall be $3.00 per quarter, payable quarterly in advance, provided,
however, that this section shall not apply to a plumber or tinner
or electrician who is employed to do work for a wage or salary
either by the day or week or month, in conjunction with a fixed

place of business in the City of Azusa #ho does not furnish any
materials or supplies in the performance of any such work. The
license required by this section must be paid in addition to any
other license.
Section 28. For every person conducting, managing or
carrying on a carnival, street fair or fiesta, the license shall
be $25.00 per day, provided that the same shall be granted only
upon written application therefor to the Board of Trustees of the
City of Azusa, which application shall specify the length of time,
locations and whether upon public or private property, purposes
for which the funds derived from the same are to be used, and full
particulars concerning such enterprise, and said Board of Trustees
may grant or deny said application in its discretion, and upon
(granting the same, may impose such conditions as it may deem best
for the public welfare.
Section 29. For every person, firm or corporation con-
ducting, managing or carrying on any billiard hall or pool room,
or both, the sum of $3.00 per quarter for each billiard or pool

table; provided that such billiard hall or pool room shall be
kept closed from 12 otclock midnight until 6 o'clock B.M. of
each day, and that minors under 18 years of age shall not be
allowed to be present or frequent any such billiard hall or pool
room; and provided further that no license shall be issued un-
der this Section until the Board of Trustees shall have first
issued a permit therefor, and that the said Board of Trustees
shall have the right tb grant or refuse such permit under this
Section in its discretion, and that said permit or license shall
not be transferred without the consent of said Board of Trustees
first obtained. '
No gambling or betting of any kind shall be allowed or
permitted in any billiard hall or pool room licensed hereunder.
In fixing the amount of license to be paid by any billiard
hall or pool room, it shall be the duty of the City Clerk to count
and charge a license for each and every table standingin said hall
or room, whether the same is in use or not.
Section 30. For every person, firm, association,company
or corporation conducting or carrying on the business of running
a laundry wagon or vehicle or a laundry route in said city,
the license tax shall be for each wagon or vehicle $72.00 per
year, payable annually in advance, provided that each of such
wagons or vehicles shall be designated by a number to be fur-
nished by the City Clerk and placed thereon as herein provided.
For every person, firm, association, company or corpora-
tion conducting or carrying on a laundry business in said city,
other than by means of a laundry wagon or vehicle, licensed as
above provided in this section, for each agent, solicitor, re-
presentative or employee, the license tax shall be $72.00 per
annum, payable annually in advance.
Provided that this section shall not apply to any per-
son, firm, association, company or corporation having.an estab-

lished place of business in the city of Azusa where laundry work
is done.
Section 31. For every erson, firm or corporation run-
ning any hack, coach, omnibus,/, carriage or"automobile used for
carrying passengers for hire, __
,other than a street car,#4. .00 per year
for each such hack, coach, omnibus, carriage or automobile;
provided, that each such hack,coach „omnibus, carriage or auto—
mobile so used shall be designated by a number to be furnished
by the City Clerk, as hereinbefore provided.
Section 32. Any moving picture show, place of amusement,
circus or tent show, bowling alley, box -ball alley, billiard hall
pool hall, shooting gallery, merry-go-round, skating rink or
similar amusement enterprise, shall be kept closed during the
period between twelve o'clock P.M of Saturday of each week and
six otclock A.M. of the next succeeding Monday.
Section 33. Nothing in this Ordinance shall be construed
as imposing.a license tax on, or otherwise regulating or restrict-
ing foreign or interstate commerce, and any business or portion
thereof which is embraced in the term "Interstate Commerce" or
in the term "Foreign Commerce", is not made subject to a license
by this Ordinance; and provided, further, that this Ordinance
shall not be deemed to apply to the delivery of goods, wares or
merchandise purchased elsewhere and delivered in said City of
Azusa, if no orders are taken or soliciting of any kind is done
in conjunction with making suchdelivery.
Section 34. All licenses issued under this Ordinance,
or any section thereof, are granted and accepted by all parties
receiving licenses, with the express understanding that the
Board of Trustees may revoke the same at any time if satisfied
that any of the conditions of the license or terms of this Or-
dinance have been violated, or that the license was obtained by

fraudulent representations, or that the holder of any such license
is an unfit person to be trusted with the privilege granted by
said license; provided, however, that no license shall be revoked
without first giving the holder an opportunity to appear before
the Board in his own behalf. On the revocation of.the license,
no part of the money in the hands of the City shall be returned,
but such license fee shall be forfeited to the City. When
a license of. any person is revoked for any cause, no new or
other license shall be granted to the same person within six
months from the date of such revocation.
Section 35. Any person taking out a license under this
Ordinance, and holding any unexpired license heretofore issued
by the City Clerk for the same business, shall upon surrender of
such former license to the City Clerk be entitled to credit on
such new license issued hereunder, for the pro rata amount paid
for the unexpired portion of such former license.
Section 36. That Ordinance No. 180 of this City of Azusa
entitled, "An Ordinance of. the Board of Trustees of the City of
Azusa providing for licensing and regulating the carrying on of
certain businesses, trades, callings and occupations carried on
within the limits of said City of Azusa, and repealing Ordinances
number 129,160 and 168, and repealing all. other ordinances and
parts of Ordinances in conflict herewith," adopted June 5th,
1916; and also that Ordinance No. 130 of the City of Azusa, en-
titled "An Ordinance providing for the licensing and regulating
the carrying on of billiard, bagatelle or pool rooms in the City
)f Azusa, and fixing a penalty for the violation thereof, and re-
?ealing all ordinances or parts of ordinances in conflict herewith,"
adopted July 8, 1912; and all other Ordinances and parts of Or-
linances in conflict herewith, be and -.the same are hereby re-
)ealed.

3 in the Pomotropic, a weekly newspaper of general circulation,
4 published and circulated in said city and thereupon and there
