That the use or maintenance of any water closet whether the same be located within a building or elsewhere which said water closet is not capable of being flushed through a flush pipe of not less than one and one-fourth inches inside mea- surement, and is used in connection with a tank containing not less than four gallons of water be and is hereby declared to con- stitute a• public nuisance; and it shall be unlawful for any per- son, firm or corporation to use the same or maintain the same for carrying sewage or house drainage or waste drainage on and after the first day of November, 1923. Section 2. No water c loset shall be put into or upon an property, house or building unless such water closet be flushed through a flush pipe of not less than one end one-fourth (14) inches inside diamete-r, and is used in connection with a tank containing not less than four (4) gallons of water. The instal- ling of Latrines or range closets is prohibited in all cases. All earthenware traps where set on tile or cement floors or walls shal have heavy brass floor plates bolted on the floors or walls with at lease four (4) brass expansion bolts and soldered to the lead bend or stub. No water closet shall discharge into a pipe of less than four (4) inches diameter. There shall be a lead connection at least six (6) inches in length between water closets and soil pipes. All closet bowls shall be of the vitreous type with trap in bowl. Section 3. That it shall be the daty of the City Clerk 1. 1 2 3 4 5 6 7 8 9 10 11 12 13 i 14 Z O j a 15 omo. m ;cZ„m 16 3a ¢ O i Soya; 17 Z Z N w -o IBJ 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Of the City of Azusa, immediately upon the passage of iris Ordi- nance to mail, postage prepaid, a written copy of this Ordinance to any person, firm or corporation using any such water closet, as defined in Section 1, of this Ordinance, for any purpose so far as known to the said City Clerk; provided, however, that any failure of the City Clerk so to do, or the non -receipt of such copy by any such person, firm or corporation, shall not constitute any defence for the violation of this ordinance. Section 4. That it shall be the duty of the Street Super - intendant of the City of Azusa, after the 1st day of November, 1923, to notify in writing any person, fizm or corporation using any such water closet, as defined in Section 1 of this Ordinance, for carrying sewage, house drainage or waste drainage, that such use is a nuisance and to immediately cesiee to use the same and th if such use be not immediately discontinued the nuisance caused thereby will be abated at the expense of the person, firm or cor- poration ceasing the same; and if any person, firm or corporation after being so notified shall continue such use after November let, 1923, it shall thereupon be the duty of the said Street Superintendent to abate the nuisance caused by such continued use by taking out and removing all such water closets from the premis where the same is located. He shall, after the abatement of such nuisance, file with the Board of Trustees an itemized statement of the expense of the abatement of such nuisance, and the amount of such expense shall be deemed a debt due to said City of Azusa, and such person, firm or corporation c ausirg such nuisance, so abated, shall be liable to an action in the name of the City of Azusa in any Court of competent jurisdiction for such amount with costs of suit, and in addition thereto a penalty of Twenty-five (25.00) Dollars must be added to the judgment as costs to be collected from the defen- dant or defendants in said action. 2. 1 2 3 4 5 6 7 8 9 10 i 14 Z O j a 15 o'm�m 98uw. ;aQo= 16 :o Z Z �17 Z Z N U - JO IB 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 _1 Section 5. Any person, firm or corporation who shall violate, neglect or refuse to corPly with any of the provisions Of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not more than One Hundred (100.00) Dollars, or be imprisoned in the City Jail of the City of Azusa for a period not exceeding thirty (30) days or be pun- ished by both such fine and imprisonment. Section 6. This Ordinatce is urgently required for the immediate preservation of the public peace, health and safety and the following is a specific statement showing the urgency of this Ordinance. That all such water closets described in Section 1 of this Ordinance constitute a serious menace to the health of the entire community and to the inhabitants of the City of Azuaa; and this Ordinance is therefore urgently required to prevent the continuance of such nuisance and to provide for the abatement of the nuisance caused by the use of such water closets. Section 7. It shall be unlawful for any person, firm or corporation to make any sewer connection, or to do any plumbing otherwise than in accordance with the terms of this ordinance. Section 8. All Ordinances or Sections or portions of or- dinances in conflict with this ordinance are hereby repealed. Section 9. The City Clerk shall certify to the passage of this Ordinance by a vote of four fifths of all the members of the Board of Trustees of said Ci*y of Azusa and its approval by the President of said Board, and shall cause the same to be published by one insertion in the Pomotropic, a weekly newspaper published and circulated in the said City of Azusa, and thereupon and thereafter the same shall be in full force and effect.
