HomeMy WebLinkAboutOrdinance No. 236- 1 ORDINANCE N0.o23. 2 3 AN ORDINANCE OF THE CITY OF AZUSA, CALIFORNIA, ESTABLISHING A CITY PLANNING COM.IISSION FOR 4 SAID CITY, PROVIDING FOR THE APPOINTMENT THEREOF, AND PRESCRIBING ITS POWERS AND DUTIES. 5 6 The Board of Trustees of the City of Azusa do ordain 7 as follows: 8 SECTION 1. A City Planning Commission of the City of Azusa 9 California, is hereby established, pursuant to the provisions of 10 that certain act of the Legislature of the State of California, 11 entitled: "An Act to provide for the establishment, government 12 and maintenance of City Planning Commissions within Municipalities, 13 and prescribing their powers and duties," approved A%y 21, 1915. zo; 14 SECTION 2. The City Planning Commission shall be composed 3mum .0"W; 15 of five (5) members to be appointed by the President of the Board CO ZJz 3a Z 16 of Trustees. by and with the consent of the Board of Trustees, and Z 3, z TW3. 17 one of the members of such commission shall be a member of the 18 Board of Trustees. In addition thereto the City Attorney and the 19 City Engineer shall be ex -officio full members of said commission. 20 and also in addition thereto the President of the Board of 21 Trustees shall be an ex -officio member of said commission, but 22 without any right of vote in the deliberations thereof, except in 23 case of a tie. At the first meeting of the commission the five 24 (5) appointive members shall choose their terms of office by lot 25 as follows: One to serve until midnight of the 31st day of 26 December, 1925, two for one year thereafter, and the remaining 27 two for two years thereafter, and shall immediately thereafter 28 communicate such allotments to the Board of Trustees. Their 29 successors shall hold office for two (2) years. Vacancies for 30 any unexpired term shall be filled by appointment as in the first 31 instance. Non-residents shall be eligible to appointment on the 32 City Planning Commission. SECTION 3. The members of the City Planning Commission shall meet at least once a month, at such times and places as they may fix by resolution. Special meetings may be called at any time by the president or three members, by written notice served upon each member of the commission at least three hours before the time specified for the proposed meeting. SECTION 4. Immediately upon their appointment the membe shall organize the commission, and shall elect a president and secretary, both to serve for one year and until their successors are appointed; in case of their absence, the members of the com- mission shall elect a president or secretary pro tem, as the case may be. Four members of the commission shall constitute a quorum for the transaction of business, but a lesser number may adjourn from time to time for want of a quorum until a quorum can be obtained. The commission may make and alter all rules and regul tions for its organization and procedure, except those mentioned herein, consistent with the laws of the state and the ordinances of the City of Azusa. The commission shall keep an accurate record of all its proceedings and transactions, and shall make annually to the Board of Trustees a full report of the commission' transactions and recommendations. The commission shall also upon demand of the Board of Trustees make other reports upon subjects within its jurisdiction. SECTION 5. Subject to the approval of the Board of Trustees, the commission may employ any person, firm or corporati to aid it in the performance of the duties placed upon it by this ordinance, and may give or agree to give compensation for such employment from funds provided by the Board of Trustees. Provided, however, that neither the City of Azusa, nor any officer; commission or department thereof; other than the City Planning Commission, shall be held liable to pay for work contracted to be performed, or actually performed, for the City Planning Commission, unless the same shall have received the authorization of the said Board of Trustees. SECTION 6. The purpose of the establishment of this commission is to provide for and regulate the future growth, development and beautification of the City of Azusa in its public and private buildings, parks, streets, grounds, and vacant lots, and to provide plans consistent with the future growth and develop- ment of the City of Azusa, for securing to the City of Azusa and ii inhabitants sanitation, service of all public utilities, and accese to harbor, shipping and transportation facilities. All powers exercised by this commission shall be used to further these pur- poses and purposes incidental thereto. SECTION 7: The City Clerk shall,prior to the submission to the proper board or officer of the City of Azusa of any ordinan< or resolution relating to the location of any public building, or location, extension, widening, enlargement, ornamentation or park- ing of any street, boulevard, alley, parkway, park, playground or other public grounds, or the vacation of any street, or the location of any bridge,tunnel or subway, or of any surface, under- ground or elevated railway, or public utility, or of any ordinance; rdlating to housing, building requirements, codes or zones, give notice to the commission of the pendency before the office or department of such proceedings with reference to any of the above matters; and the City Clerk shall also. upon introduction thereof, 3. Y 1 furnish to the City Planning Commission, for its consideration, 2 a copy of all ordinances and resolutions which relate to any of 3 the matters within the jurisdiction of the commission. 4 SECTION 8. The said commission shall make or cause to be 5 made, at the direction of the Board of Trustees, a map or maps of 6 the City of Azusa, or any portion thereof, including adjacent 7 territory lying outside of the corporate boundaries thereof, show - 8 ing the streets, highways and other natural or artificial features 9 therein; also the location or re -location proposed for any new 10 public buildings, civic centers, streets, parkways, boulevards. 11 parks; playgrounds or other public grounds or improvements; also 12 any proposed widening, extension, closing or re -location of any 13 street or highway, oh y, or any change in the plan of the city that it u Z0j 14 may deem advisable, and may make recommendations in connection .g6 U W„; 15 therewith to the proper officers of the city having charge, super- �zwz = 16 intendence or control of the matters set forth in such recom- RNa. :ZH� w—oa = JJ 17 mendations. In all these matters said commission shall have due F 18 regard for the present conditions and future needs and growth of 19 the city, including the distribution and relative location of all 20 public buildings, grounds and open spaces devoted to public use, 21 also the planning and laying out for urban uses of all private 22 grounds brought into the market from time to time, and the divisic 23 of the city into zones or districts, for the purpose of conserving 24 androtecti the p ng public health, comfort and convenience; and 25 also the distribution and relative location of all the principal 26 and other streets and railways; waterways and all other means of 27 travel and business communications. 28 SECTION 9. SECTION 10. The City Planning Commission may, on its own' initiation, or shall on the request of the proper authorities make recommendations from time to time to the public authorities, and to public agencies of every kind, with reference to the location, architecture and use of any buildings. structures or works con- trolled by such authorities or agencies, or in course of erection, or to be erected by any of them; with reference also to the build- ing restrictions, ordinances and codes, and to the division of the city into residential, industrial, business and other zones; with reference also to the location, extension, widening or closing, ornamentation or parking of any street, boulevard, alley, parkway, path or other public way, or the reservation, purchase, location or enlargement of any park, playground, school or other public building site. The Board of Trustees shall refer all ordinances and resolutions relating to any of the matters within the terms of this section to the City Planning Commission for its siaggesti recommendations or approval thereof, before taking final action thereof, except in case such reference or procedure would conflict with the provisions or requirements of existing laws. SECTION 11. All plans, plots, divisions; subdivisions, re -plots or re -subdivisions of lands, building lots, and the streets, alleys or other portions of the same intended to be dedi- cated to public use, or for the use of purchasers or owners of lots fronting thereon or adjacent thereto, and located within the city limits shall be submitted to the City Planning Commission by the Board of Trustees, and the said commission shall report thereon in writing to the Board of Trustees before action is taken thereon by said Board of Trustees. SECTION 12. All proposed building and sanitary ordinances, and all proposed franchises for freight, passenger and street car lines, and for telephone. telegraph and electric light and power, 5. 1 1 2 3 4 5 6 7 8 9 10 11 12 13 = 14 2 QJ pmU'm 15 u%ZWi ;O 0. 16 <Ymz� Z�ao whoa 17 x;� j 18 19 20 21 22 23 24 25 26 27 28 29 3� 31 32 r C and for gas and water service, and any amendments to such existing ordinance or franchises, shall be referred by the Board of Trustee to the City Planning Commission for consideration and report befor action is taken thereon by the Board of Trustees, unless such reference or such procedure would conflict with the provisions or requirements of existing laws. SECTION 13. The Board of Trustees may, in making its annual tax levy, and as a part thereof, levy and collect a tax in the manner provided by law for the purpose of defraying the lawful expenses incurred by the City Planning Commission of the City of Azusa, but said tax shall never at any time exceed two mills on t dollar of assessed valuation; provided, however, that no expense of any kind shall be incurred by said commission unless first authorized and approved by the Board of Trustbes. SECTION 14. All ordinances, or parts of ordinances. in conflict with the provisions of this ordinance are hereby repealed. SECTION 15. The City Clerk shall certify to the passage and adoption of this ordinance, and shall cause the same to be published once in the Pomotropic, a weekly newspaper of general circulation printed, published and circulated within the said City of Azusa. California, and hereby designated for that purpose. This ordinance shall take effect and be in full force from and after thirty days after its final passage and adoption.
