AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF AZUS

REGULATING THE MOVEIIENT AND CARRYING OF HEAVY LOADS OVER OR UPON
4
CERTAIN STREETS OR CERTAIN OTHER PUBLIC HIGHPrAYS OF THE CITY OF

AZUSA:

The Board of Trustees of the City of Azusa do ordain as
7
follows:

SECTION 1. For the purpose of this ordinance, the word
9
"vehicle" shall be held to include traction engines, motors,
10
agricultural implements and everything on wheels used or designed
11
for use in transporting freight, merchandise or passengers,
12
whether self-propelled or drawn. excepting vehicles running ex-
13
clusively on rails or tracks.

Section 2. For the purpose of this ordinance the word

"load" shall be held to include vehicular loads, self-propelled

or drawn machiner and buildings, whether moved on wheels or

rollers.

Section 3. For the purposes of this ordinance the words
19
"an improved highway" and the words "an improved public highway"
20
shall be defined as being any street, alley or public way in the
21
City of Azusa, which is paved with cement or asphaltic concrete
22
not less than four (4) inches thick.

For the purposes of this ordinance all other streets,
24
avenues, highways, alleys or public ways in the City of Azusa
25
are referred to and defined as "Semi-improved highways".

Section 4. No vehicle shall be moved or operated over an
27
street or other public way of the City, having a tire which has
28
on its periphery any block, stud, cleat, ridge, bead or any pro-
29
tuberance of metal which projects more than one-fourth (1/4) inch
30
beyond the tread or traction sut%ce of the tire, provided, how-
31
ever, that the Board of Trustees may issue permits for the move-
32
ment of such vehicles, over certain streets specially designated

in the permit. The Street Superintendent shall have authority to
prescribe the precautions to be observed in moving such vehicle,
and may require a cash deposit in such amount as he may deem
necessary, but not to exceed one hundred fifty (150) dollars, to
cover repairs to any street pavement that may be injured by said
vehicle. This Section shall not be construed so as to prohibit
the use of tire chains of reasonable proportions on motor vehicle
when required for safety because of wet pavement surface, mud
or other conditions tending to cause such vehicles to slide or
skid, nor to prevent the use of traction engines with cleats on
streets which have not been macadamized or paved.
Section 5. No load of any character whatever in excess
of 6 0 o D pounds weight, including the wbight of the
vehicle, if used, shall be moved over any semi -improved highway
of the City of Azusa, provided, however, that the Board of Trus-
tees may issue permits for the movement of heavier loads over
certain semi -improved highways specifically designated in the
permit. The Street Superintendent shall have authority to pre-

may require a cash deposit in such amount as he may deem neces-
sary, but not to exceed one hundred fifty ($150.00) Dollars, to
cover repairs to the street pavement or other public structures
thereon that may be injured thereby.
Section 6. No vehicle shall be operated over any semi -
improved highway in the City of Azusa, the weight of which, in -
eluding the load resting on the surface of said street, exceeds
44"<&.,(.pounds per linear inch width of tire, or roller,
wheel or other object supported upon the su2ftce thereof.
Section 7. The following streets, avenues and highways
within the City of Azusa, which are hereby designated as "semi -
improved highways" are all those portions of the following named
streets which are not inaluded within the intersections of said

streets with either Azusa Avenue or Center Street and are enumer-
ated as follows:
Section S. No vehicle shall be operated over any street
of the City with more than one (1) trailer attached, when the
combined weight of any such additional trailer and its load exceed
one thousand (1000) pounds, and in no case shall the total weight
of trailers in one train, including the weight of the Vehicles
exceed twenty (20) tons, nor shall the total length of the train
exceed fifty-five (55) feet.
Section 9. No vehicle used for the transportation of
crude oil or any of its products in tanks shall be allowed in or
upon any of the highways of the City of Azusa. unless such vehicl
are provided with drip pans under the faucets of such tanks to pre
vent the leakage of the contents of the tank upon the highway,
and such tanks must be in all cases so arranged and handled that n
leakage of any kind can occur.
Section 10. No vehicle used for the purpose of carrying
sand, gravel, earth. rock or any loose or liquid substance liable
to sift or spill out shall be allowed on any of the highways of
the City ofAzusa, unless the same is made tight and so constructed
as to prevent the sifting or spilling of any of its contents upon
the street over which it is passing.
Section 11. Any police officer of the City shall have
the right to require any load which appears to him to be in viola-
tion of any of the provisions of this Ordinance, to be taken to

the nearest public scale and there be Weighed, the weighing

charge to be paid by the City, or such officer may employ any
3
other means at his discretion to determine the load carried. All
4
vehicles shall have net weight plainly and permanently marked
5
thereon at some place readily visible, as an aid in determining
6
the total load.

Section 12. Any person violating any of the provisions

of this Ordinance shall be deemed guilty of a misdemeanor, and,
9
upon conviction thereof, shall be punished by a fine not exceed -
10
ing Fifty ($50.00) Dollars, or by imprisonment not exceeding
11
thirty (30) days, or by both such fine and imprisonment.

Section 13. All ordinances or parts of ordinances, in
13
conflict with the provisions of this Ordinance, are hereby re -

Section 14. The City Clerk shall certify to the passage

and adoption of this ordinance, and shall cause the same to be

published once in the Pomotropic, a weekly newspaper of general

circulation printed, published and circulated within the said

City of Azusa, California, and hereby designated for that purpose,

This ordinance shall take effect and be in full force
21
from and after thirty days after its final passage and adoption.
