HomeMy WebLinkAboutOrdinance No. 279W 4 • , 1 O R D I IvT A It C E N 0. 2 %:71 i 2 AN ORDINANCE OF THE CIT`i COUNCIL OF THE CITY OF AZUSA REGULAT- 3 IUG TRAFFIC UPON AND USES OF STREETS AND PROVIDING A PENALTY FOR 4 VIOLATION THEREOF. 6 The City Council of the City of Azusa does ordain as follows: 6 Section I. DEFIVITIORS: lbonever in this ordinance the follow - 7 ing terms are used, they shall have the meanings respectively ascrib 8 ed to them in this section: 9 STREET: Every way set apart for public travel except alleyways, 10 bridle paths and footpaths. 11 RO"WAY: That portion of a street between the regularly es- 13 tablished curb lines. 13 IIITMECTION: The area embraced within the prolongation of the 14 property lines of two or more streets which ,loin at an angle, whethe 16 or not one such street crosses the other. 16 17 WICLA: Every device or animal by which any person or.property 18 is or may be transported or drawn upon a street, excepting devices 19 moved by human power or used exclusively upon rails. 20 HEAVILY LADEN VEHICLE: Every device or animal by which any 21 person or property is or may be transported or drawn upon a street 22 excepting devices moved b human y power or used exclusively upon -rail+ 23 which together with its load.exeeeds in weight s / 24 tons. 26 OPERATOR: Any person who is in actual physical control of a 28 vehicle or street car. 27 Section 2: HEAVY TRAFFIC PROHIBITED Ott CARTAIN STREETS. 28 It shall be unlawful for any person to drive or propel any 29 "Heavily Laden Vehicle" or any vehicle employed in carrying ice, hay. 30 coal, manure, lumber, brick, buildingmaterial sand earth gravel, 31 natural oil or crude petroleum or regularly employed in carrying -1_ I 11 2 3 4 6 6 7 8 9 10 11 12 13 14 16 16 17 18 19 20 21 22 23 24 26 26 27 28 29 30 31 SII ` goods or merchandize, alone or upon any street in the City of Azusa, except Azusa Avenue and Foothill Blvd., except on the street inter- sections of such streets with Foothill Blvd. or Azusa Avenue, pro- vided hovaever, that this section shall not apply to the use of said streets by vehicles carrying goods and merchandize or materis.,l to or from premises situated upon said streets so far as necessary for such purpose nor to the use of said streets in the care thereof. Section 3; It shall be unlawful for any person, firm or corpora tion to operate, drive, propel, or draw or cause or permit to be operated, driven, propelled or drawn upon, along or over any newly improved street, avenue, place or alley within a period of ninety days after the acceptance of such improved street, avenue, place or alley by the City, or of the completion of such improvement by the City, any vehicle which has steel tires; or any vehicle which has rubber or rubber covered tires which alone, or together with its load weighs more than 400 pounds per inch of tire width upon the sux face of the road, provided, that application may be made to the Sup- erintendent up-erintendent of Streets for a permit, and such Superintendent may in his discretion, i:;sue a scecial permit to the owner or operator of any vehicle allowing heavier loads than that herein above prescribed to be operated, driven or drawn upon, along, or over any such public highway. Any such permit must be in writing and limit the time of use and operation over the particular street, avenue, place or Salley and shall contain such special conditions and provisions and require such undert;_king or other security as said Superintendent of Streets Shall deem necessary to protect the said streets, avenues, place or alleys from injury resulting from such operation z_nd to repaid and restore such highway to its original condition after the permitted use. Any person, firm or corporation that shall violate or cause or permit to be violated any of the provisions of this Ordinance shall be liable to the City of :lzuso for all of the damage done, or cause by such violation, and such city shall have the right to enforce such claim in the manner provided by law. Section 4: HAULING OF STEM SHOVELS. It shall be unlawful for any person, firm or corporation, to drive, haul or convey over any street in the City of Azusa, a shovel operated by steam or other mechanical power without first obtaining a permit therefor in writ- ing from the Superintendent of Streets, or to drive, haul or convey the :name otherwise than over the route specified in such permit or, without havinp deposited raith the Superintendent of Streets the sum of One hundred ($100.00) dollars in cash to cover;, any damage which may be done to any street or streets as the result of driving hauling or otherwise conveying such shovel. Upon demand in writing made by the person, firm or corporation making such deposit the Street Superintendent shall within forty-eight (48) hours inspect the strees traversed by such shovel, and shall ret rn to the person firm or corporation malting such deposit any portion of such deposit which shall not be necessary to repair any damage done by such shoe Section 5: FOLLUMM FIRS APPARATUS PROHIBIT It shall be unlawful for the oper for of any vehicle, other than one on offi- cial business, to follow any fire apparatus traveling in response to a fire alarm closer than one block or to park any vehicle within the block where fire apparatus hi.s stopped in answer to a fire alarm. Section 6: CROSSING FIRE HOSE: No street car or vehicle shall be driven over any unprotected ho. --c of the Fire Department when lai down on any street, private driveway or street car tract, to be use -3- i 1 at any fire or alarm of fire, without the cons:;nt of the .Fire Mar - 2 shall, or the assistant in command. 3 Section 7: IUTALTIE+S: Any person, firm or corporation as 4 principal, officer, agent, clerk or employee, whether actin- for h 6 I soli or for another person, firm or corporation who or which shall 6 violate any provision of this ordinance, shall be guilty of a mis- 1 demeanor, and, upon conviction thereof shall be punished by a fine 8 not exceeding Three hundred (0300.00) dollars, or by imprisonment in 9 the City Jail not exceeding two (2) months, or by both such fine and 10 Iiimprisonment. 11 Section 8: That the City Clerk shall certify to the passage of 12 this Ordinance and shall cause the same to be publiLhed in one regu- 13 lar issue of the Azusa Journal, a weekly new!3pa.per of the general 14 circulLztion, established, printed and published in the City of Azusa. 16 16 I hereby certify that the foregoing Ordinance was duly passed 17 by the City Councilofthe City of Azusa, at a rogular meeting hely 18 the l4' day of Xel-e- , A.
