HomeMy WebLinkAboutOrdinance No. 281ir yi • +" 4 ORDINANCE No. 281 ti AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, PROHIBITING THE DESTRUCTION OR USE OF ANY FLOOD CONTROL LEVEES, EMBANKMENTS, CHANNELS, DAPS, RESERVOIRS OR ANY OTHER PROPERTY OL7NED OR USED FOR FLOOD CONTROL PURPOSES BY ANY PUBLIC AGENCY WITHOUT A PERMIT THEREFOR AND PROHIBITING THE DUMPING OF ANY RUB'3ISH OR PLACING OF ANY OBSTRUCTION IN THE STR�.AEI BED OF ANY RIVER, STREAM, WASH, ARROYO OR FLOOD CONTROL CHANNEL IN THE CITY OF AZUSA. The City Council of the City of Azusa do ordain as follows: Section 1: It shall be unlawful for any person, firm, corporation, municipality or district to interfere with., destroy or use in any manner whatsoever any levee, embankment, channel, dam, reservoir, rain or stream gages, telephone line, piling, fence or other stream protection work constructed by or on behalf of any public agency without a written permit therefor from the City Council of the City of Azusa, which permit shall be revocable w�,enever in the opinion of said City Council the public interest and welfare require the revocation thereof. No permit to use any flood control protection work or rights of way owned or constructed by the Los Angeles County Flood Control District shall be effective unless written permit to so do has also been obtained from the Board of Supervisors of said District. Section 2: It shall be unlawful for any person, firm, corporation, municipalityor district to place or cause to be placed ;.n the channel or bed of any river, stream, wash or arroyo or upon any property over which the Los Angeles County Flood Control District has an easement for flood control purposes duly recorded in the office of the county recorder of Los Angeles County, any wires, fence, building or other structure, or any refuse, rubbish, tin cans, or other matter that may impede, retard or change the direction of the flow of water in such river, stream, wash or arroyo, or that will catch or collect debris carried by such water, or that is placed where the natural flow of the storm and flood waters would carry the same down- stream to the damage and detriment of either private or public property adjacent to said river, stream, wash, arroyo or channel. Section 3: Any person, firm, corroration, municipality or district or any officer or agent of any firm, corporation, municipality or District violating any of the provisions of this ordinance shall be guilty of a misdemeanor,' and upon conviction thereof shall be punished by a fine not exceeding $500.00 or by imprisonment in the city jail for a term not exceeding sixty days, or by both such fine and imprisonment. Section 4: That the City Clerk shall certify to the passage of this ordinance and shall cause the same to be pub- lished in one regular issue of the Azusa Herald, a weekly newspaper of general circulation, established, printed and published in the City of Azusa.
