AN ORDINANCE OF THE CITY OF AZUSA REGULATING TRE BUSINESS OR OCCUPATION OF PLUMBING IN SAID CITY, PROVIDING FOR THE CREATION AND APPOII:TMrNT OF A BOARD OF EXAMINERS OF PLUMBYRS, PRESCRIBING ITS P0111ERS AND DUTIES, PROVIDING FOR TIE COLLECTION OF CERTAIN FEES IN CON13ECTION THERE!lITH AND THE ISSUANCE OF C'�;RTIFICATES, PROVIDING FOR THE REGISTRATION OF PERSONS, FIRMS AND CORPORATIONS ENGAGED IN THE BUSINESS OF PLTJBING, AND PROVIDING PENALTIES FOR THE VIOLATION OF SAID ORDINANCE, AND REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE. The City Council of the City of Azusa, California, do ordain as follows: SECTION 1. Examination. No person, as principal, agent, manager, or employee, shall conduct, manage or carry on the trade, business, or calling bC a master plumber, or -work as a journeyman plumber, or do any plumbing work of any kind or description in the City of Azusa, for which a plumbing permit is required, without first having submitted to a practical examination before, and obtaining from, the Examining Board of Plumbers of the City of Azusa a certificate of competency showing such person to have sufficient practical experience and sufficient knowledge to do plumbing viork. Any master plumber or journeyman plumber, who fails to p -ss the examina- tion, will not be a;lowed to appear before the board for further examination until the expiration of the period of thirty days from the date of such examination. SECTION 2. Examining Board. A Board. of Examiners of Plumbers for the City of Azusa is hereby created to consist of the Building Inspector of the City of Azusa, one Master Plumber and one Journeyman Plumber. Said Board shall be appointed by the City Council of the City of Azusa and shall hold office for a term of One (1) year from and after the date of their appointment and until their successors or appointees have qualified, except that the Building Inspector shall ex officio be a member of said Board. at all times, without appointment. The Master Plumber to be appointed for the year shall be any person engaged in the plumbing business with an established place of business in the City of Azusa, and the Joutneyman Plumber to be appointed for the first year shall be any person who has been engaged in the practical installation of plumbing fixtures in the City of Azusa for a period of six (6) months prior to his appointment. Thereafter these appointees shall be holders of Certificates, as hereinafter provided.. SECTION 3. Examination fee. The fee for examination by said Examining Board of Plumbers shall be X5.00 for each. Master Plumber and ;;,5.00 for each Journeyman Plumber for the first examination, payable in advance to the Secretary of the Board and no fee shall be charged for renewal of Cer- tificates and said fees collected by the Exami.ninR Board shall. be paid to the City Treasurer of the City of Azusa. on the first of each calendar month. SECTION 4. Master Plumber. For the purpose of this Ordinance, a Master Plumber shall. be deemed to be a person engaged in or carrying on. the business of plumbing or doing plumbing work, including the laying of cast iron sewers. 1. SECTION 5. Journeymen Plumbers. For the purpose of this Ordinance a Journeyman Plumber shall be deemed to be any person who is employed to do plumbing work for wages or salary, but who does not furnish any material or supplies in the execution or performance of plumbing work_. SECTION 6. For the purpose of this Ordinance an Apprentice shall be deemed to be any person doing plumbing work under the direct supervision and in the presence of a certified master Plumber of a certified Journeyman Plumber and such Apprentice is required to have a permit from said Examining Board of Plumbers to do such plumbing work. SECTION 7. Certificates. The Examining Board of Plumbers shall give an examination to every applicant for. a Certifi- cate to do plumbing work in the City of Azusa within two weeks after the filing of the application therefor, and the payment of the fee incident thereto, and every applicant passing such examination to the satisfaction of such Examin- ing Board shall receive from said Board a Certificate of Competency as a Master Plumber or Journeyman Plumber or Apprentice, in accordance with his application, and such Certificate of Competency shall authorize the holder thereof to do plumbing vork or apprentice work, as the case may be, in the City of Azusa, until the first of January next succeed- ing the date thereof. SECTION 8. Certificate Renewals. All Certificates issued by the Examining Board of Plumbers shall. expire on the last day of December of each year, unless sooner revoked. Every Master or Journeyman Plumber holding a Certificate of Competency issued by said Examining ?card of Plumbers may during the month of December of each year, make application to the Examining Board of Plumbers for an exten- sion of such Certificate of Competency for an additional year and said Examining Board of Plumbers if satisfied that the holder of such Certificate of Competency is competent to do plumbing work, shall grant an extension of such Cer- tificate of Competency for an additional. year, without examination. No plumber failing to make such application and to obtain such extended Certificate of Competency shall do any plumbing work in the City of Azusa after the expira- tion of the Certificate of Competency then held, without taking the examination and paying the full fee herein provid- ed for persons originally desiring to do plumbing work in the City of Azusa.. SECTION 9. Age Limit. No person shall receive a Certificate of Competency as a Master Plumber who has not attained the age of twenty-one (21) years or who has not established a place of business in the City of Azusa. SECTION 10. Registration. The Bri.lding Inspector of the City of Azusa shall act as Secretary of said Examining Board. of Plumbers and shall prepare and keep the Register showing the name and address of every person, firm or corporation, together with the names of the members of such firm and the officers of such corporation carrying on the business of Merchant plumber of a plumbing business in the City of Azusa, showing the name and address of every Master Plumber, every Journeyman Plumber, and every Plumber's 2. Section 10, Registration Apprentice licensed or permitted to do plumbing work in the City of Azusa, and shall keep said Register up to date by the endorsement of all. changes thereon and additions thereto. SECTION 11. Penalties. Every person, firm, or corporation violating any of the provisions of this Ordinance shall. be deemed quilty of a misdemeanor, and upon conviction thereof shallbe punishable by a fine of not more than Two Hundred Dollars ($200.00), or by imprisonment in the City jail for a period not more than Sixty (60) Days, or by both such fine and imprisonment. Every such person, firm or corporation shall be deemed quilty of a separate offense for every day during any portion of which any violation of any provision of this ordinance is committed, continued, or permitted, by such person, firm or corporation, and shall be punishable therefor as herein provided. SECTION 12. If any section, sub -section, clause, or phrase of this ordinance is for any reason held to be invalid or un- constitutional, such decision shall not effect the validity of the remaining portions of the Ordinance. The City Council of the City of Azusa hereby declares that it would have passed this ordinance by section, sub -section, sentance, clause and phrase thereof, irrespective of the fact that any one or more other sections, sub -sections, sentences, clauses or phrases be declared. invalid or uncon- stitutional. SECTION 13. That all other ordinances or portions of or- dinances in conflict herewith. are hereby repealed. SECTION 14. That the City Clerl: shall certify to the passage and adoption of this ordinance by a unanimous vote of all the members of the City Council of said City of. Azusa, Calif- ornia, present and shall cause the same to be published once in the Azusa Herald, a weekly newspaper printed, published and circulated within said City of Azusa and which is here- by designated for that purpose.
