HomeMy WebLinkAboutOrdinance No. 290ORDINANCE NO. 290 AN ORDINANCE OF THE CITY OF A7USA AMFNDING AND ADDING CERTAIN SECTIONS TO ORDINANCE NO. 284 OF THE CITY OF A7USA. The City Council. of the City of Azusa does ordain as follows: Section 1, That Section 1 of Ordinance No. 284 Of the City of Azusa is hereby- amended to read as follows: Section 1: It shall. be unlawful for any person or persons, firm or co -partnership or corporation, or for any person, servant, clerk or employee, or for himself or for any other person firm, co -partnership or corporation ^ithin the corporate limits of the City of Azusa to transact, engage in or carry on any pursuit, trade, occupation, avoca- tion, employment, business or calling herein specified until he, she they or it shall have first obtained a license therefor as in this Ordinance required. Each and every day or fractional part of a day that said pursuit, trade, occupation, avocation, employment, business or calling in this Ordinance specified is conducted or carried on-ithout such license, shall constitute a violation of this Ordinance, and any person who for himself, or for any other person, firm, co -partnership or corporation shall violate any of the provisions of this Ordinance shall, for each violation thereof, be deemed guilty of a misdemeanor and upon conviction by any Court having jurisdiction thereof, shall be fined therefor in a sum not in excess of ',8200.00, or shall be imprisoned in the City or County Jail not exceeding thirty(SO) days, or by both such fine and imprisonment; provided, however, that if any person shall furnish such -evidence as shall satisfy -the Chi6f of Police and the City Clerk that he was formerly a soldier in the United States Army, or a sailor in the United States Navy, from either of which he was honorably discharged, and who is physically unable to obtain a livelihood by manual labor and shall be a qualified elector of the State of California, a free license may be issued to such party for a limited time to be specified in such license, not in any event to exceed six months in any one one year, nor shall more than one such license be issued to or for the benefit of any one such person in one fisical ,year under this proviso. The term or duration of each license shall be annually, quarterly, monthly, weekly or daily, according to the terms of its Section of this Ordinance fixing the amount of each license. Annual licenses shall date from the first day of July: quarterly licenses shall. date the first day of July, October, January and April of the year in which they are issued. 111here licenses are issued hereunder for the unexpired part of the term, the amount of license fee re- quired shall be proportioned accordingly; provided that the minimum license fee for an unexpired annual term shall be one quarter of the annual license fee, and the minimum license fee for an unexpired quarterly term shall be one- third thereof. All licenses, shall be paid for in advance, and no rebate given for any unused portion of the term. All licenses issued under the provisions of this Ordinance shall be posted in the place of business of licensee named in such license and the said license shall be produced by the licensee whenever the same shall be required by the Chief of Police, or any other Officer of the City. It is hereby made the duty of the Chief of Police to enforce all the provisions of this Ordinance. Nor, per- sonal demands or notices by the Chief of Police to such Persons ging such license tax shall be necessary to incur he penal ies of this Ordinance. 0 0 Section 2. That Section 2.1 of Ordinance No. 284 of the City of Azusa is hereb- amended to read as follows: Section 21: The rate of license for conducting thebusiness of a barber shop is $12.00 per annum. I£ a manicurist is employed in connection with such barber shop, an additional license fee of $4.00 per annum. Section 3. That Section 22 of Ordinance No. 284 of the City of Azusa is hereby amended to,r ead as follows: Section 22: The rate of license for conducting a bakery, per annum $12.00. The rate of license for carrying on the business of peddling, selling or delivering; from a vehicle any baker's goods.or products when not done as a part of or incidental to the operation of a business for which license is held under this Ordinance for each vehicle, per annum $12.00. Section 4. That Section 31 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: er Section 31: Contractors are eith7general contractors or sub -contractors. A general contractor shall be con- strued to be a person natural or artificial who enters into contracts to construct buildings or structures df any kind in the City of Azusa for a contract price thereof or for a percentage of its cost, where the value of such structure when' -completed or the contract price thereof shall be more than .125.00. Asub-contractor shall be constued to be a person, natural or artificial, who shall enter into contracts with a general contractor to construct any portion of a building or structure, and which shall embrace roofing contractors, rig -builders, brick masons, tile setters, cement or concrete workers, or any other trade or craft, not including plumbers or electricians here otherewise licensed. The rate of license for either a general contractor or a sub -contractor shall be the sum of $12.00 per annum. Section 5. That Section 37 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 37: The rate of license for conducting or maintaining the business of cleaning or pressing clothes, or both, by any person having a permanent place of business in the City of Azusa, is hereby fixed at $12.00 per ,year. For carrying on the bu.sines^ of solicitng or collecting clothes to be cleaned or dyed ;,,hen not done as a part of and incidental to a busd:ness for which a license is held hereunder, per annum ?12.00. Section 6. That Section 38 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 38: The rate of license for managing, conducting or carrying on the business of a public dance hall is.hereby fixed at 82.00 per day. Section 7. That section 41 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 41: The rate of license for conducting, man -ging or carrying: on the business of electric wiring, or doing any work for which an electric permit is required, is hereby fixed at $12.00 per annum. This license shall include the right to sell electric fixtures, and appliances, materials, radio sets and parts, at retail. Section 8. That section 42 of Ordinance No. 284 of the City of Azusa. is hereby amended to read as follows: Section 42: The rate'of license for enndnrtina the business of employment agencey or bureau shall be $12.00 per annum. Section 9'. That section 43 of Ordinance No. 284 of the City of Azusa is hereby amended to read as 'follows: Section 43: The rate of license for conducting or maintaining a warehouse or storehouse in the City of Azusa, where fertilizer is stored and from -.,hich fertilizer is sold or distributed to consumers, ner annum, $12.00. Section 19. That Section 44 of Ordinance No. 284 of the City of Azusa is hereby amended to .read as follows: Section 44: The rate of license for conducting, managing, or carrying on the business of bo*1ing alley is hereby fixed at 812.00 r.er annum, or each alley, whether the same be used or not, and for carrying on the business of boxball game or alley for each such game or alley the sum of 112.00 per annum,whether same be used or not: and for carrying on the business of operating and conducting a minature golf course, the sum of $12.00 per annum for each course. Section 11. A new section numbered 49-A is hereby added. to Ordinance No. 2849 of the City of Azusa, as follo.ws : Section 49-A: That all fees paid to the Building Inspector for the permits provided for in Section 49 of Ordinance No. 284 of the City of Azusa, shall by the Building Inspector be paid to the City Treasurer for the benefit of the General Fund. Section 12. That Section 50 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows. Section 50: The rate of license for carrying on the, business of selling, peddling, or delivering ice from a wagon or otter vehicle for each such wagon or vehicle used in such biisiriessthe sum of 812.00 per annum is hereby fixed; Provided, that no person having a fixed and es- tablished ice business in the City of Azusa shall be re- quired to pay a separate license for the oporation of one or more wagons or vehicles used by 11im for the purpose of delivering 1de upon order received at his particular place of business. Section 13. That Section 51 of Ordinance No. 2.84 of the City of Azusa Is hereby amended to read as follows: Section 51: The rate of license for carrying on or conducting the business of manufacturing a:nd selling ice in the City of Azusa is hereby fixed at :12.00 per annum. Section 14. That Section 53 of Ordinance No. 284 of the City of Azusa is herby amended to read. as follows, Section 53:_ the rate of license for the business of ,junk collector sha.l.l. be 112.00 m r annum. The ::rate of license for the business of junk dealer shall be 512.00 per annum. Section 15. That Section 54 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 54: For every person, firm or corporation conducting, managing or carrying on the business of a steam laundry, the sum of X30.00 per quarter, payable in advance. For the purpose of this Ordinance the terms "conducting, managing or carrying on the business of a steam laundry" as used in this section is herebydefined to include besides the business of conducting or managing of a steam laundry in the usual popular and generally accepted meaning thereof, any pface where -clothes aro -3- washed or ironed or laundered for compensation and where power is used to overate machinery in connection with the washing, ironing or laundering of such clothes, and also the business of soliciting, collecting and delivering, or soliciting or collecting or delivering or receiving laundry for a ''steam laundry" as herein defined, for comnensation whether on a commission basis or otherwise. For every person, firm or coporation conducting, managing or carrying on a hand laundry the sum of ----- dollars per annum: provided that "hand launr9ry" is defined to be a place where clothes are washed or ironed, or are botho washed and ironed for compensation, but where -no power Is used to operate machinery in connection with the wpshing and ironing of such clothes, and the same shall hot be construed to include any place where such work is done by the members of one family and where no persons are employed for compensation. Section 1;6. That Section 56 of Ordinance No. -284 of the City of Azusa is hereby amended to read as follows: Section 56: The rate of license for conducting the business of lumber yard and planning mill shall be $12.00 per annum. Section 1.7. That Section 60 of Ordinance No. 284 of the City of A-usa is hereby amended to read as follows: Section 60: The rate of license for operating, managing, or carrying nn the business of machine shop is hereby fixed at -%2.00 per annum. Section 18. That Section -61 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 61: The rate of license for running, or operating a milk wagon or vehicle shall be $12.00 per_annum for each such wagon or vehicle. Section 19. That Section 6.4 of Ordinance No. 284 of the City of Azusa is hereby amended toread ad follows Section 64: Every individual peddling any goods, wares or merchandise not otherwise specified in this Ordinance shall pay a license 'tax of X3.00 per day or $25.00 per ,year, ,,rhich shall include the use of one vehicle and in addition thereto the sum of 52.00 per day or $125.00 per year for each additional vehicle used in such peddling. Section 20." That Section 68 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 68: The rate of license for conducting the business of a parking place or station and which is defined to be a place or station at which automobiles are received for the purpose of being parked shall be the sum of $12.00 per annum. Section 21. That Section 69 of Ordinance No. 284 of the Citi* of Azusa is hereby amended to read as follows: Section 69: The rate of license for engaging in, maintaining or cnrrying on the business of plumbing or house drainage affecting the sanitary condition of any house or building situated within the City of Azusa, is hereby fixed at x}12.00 per annum. Section 22. That Section 72 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: -4- Section 72: The rate of license for conducting, managing, or carrying on the business of wood, coal fuel„ feed, or milling is hereby fixed at $12:00 per annum. Section 23. That section 82 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 82: The rate of license for conducting, maintaining and operating an undertaking, enbalaming or funeral directing business is hereby fixed at $12.00 per annum. Section 24. Th -•t Section 83 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 83: The rate of license for conducting or -carrying on the business of accetylene or electrical welding is hereby fixed at 1l mo per annum. Every person, firm or corporation engaged in said business of accetyl.ene or electrical welding shall at all tines maintain adequate screens around and about and over any and all acetylene and hlectrical torches used by him, her, they or it, in the w6lding business, so as to obscure fro-, public view the flame of such acetylene or Electric torch or torches when in operation. Section 25. That Section 84 of Ordinance no. 284 of the City of Azusa is hereby amended to r dad as follows: Section 84: For every person, firm or corporation engaged in the business of running a tank wagon or other wagon or vehicle for hauling, peddling or delivering distillatey, gasoline, refined oil, the sum of 812:00 per,. annum, which hicense shall include the use of t-,vo such tank wagons or other vehicles so run or operated; provided for each additional wagon or vehicle an additional lioense of $3.00 per annum. Section 26. That Section 85 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 85: For every person, fir- or corporation op -rating any cart, dray wagon, automobile, truck or vehicle for the transportation of freight material, goods, wares or merchandise, for hire, when not incidental to a business for which a license is otherwise held, under this Ordinance, the sum of $12.00 per annum. Section 27. That Section 90-A of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 90-A: The rate of license for conducting, managing or carrying on the business of selling any kind of fruit, vegetables, goods, wares or merchandise from a vehicle, other than a peddler, and having no fixed place of business in the City of Azusa, for each vehicle per annum, $12.00. Section 28. That Section 96 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 96: The rate of license for managing, conducting, or carrying on the business of selling, offering for sale, dealing in, renting, leasing or otherwise h.and- lins second hand automobiles, trucks or other motor vehicles is hereby fixed at $12.00 per annum; provided that the provisions of this section shall not apply to auto dealers agencies or dealers engaged in the business. of selling, handling, or offering for sale new automobiles, trupks or other motor vehicles who take second hand motor vehicles in trade. -5- •• Section 29. That section 104 of Ordinance No. 284 of the City of Azusa. is hereby amended to read as follows: Section 104: The rate of license for carrying on the business of selling fish and meat. or either hereof, from a vehicle, for each such vehicle, per annum $12.00. Section 30, That Section 108 of Ordinance No. 284 of the City .of Azusa is hereby amended to read as follows: Section 108: The rate of license for conducting or operating a packing hoiz e where fruit is packed for sale or shipping, per annum $12.00. Section 31. That Section 111 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 111: The rate -of license for conducting or carrying on the business of Vaudeville or theatre, including moving picture theatre, per annum, 412.00. Section 32. That Section 120 of Ordinance No. 284 of the City of Azusa is hereby amended to read as follows: Section 120: The rate of license for conducting, managing or carrying on a loan business when not connected with a Bank holding a license under this Ordinance, is hereby fixed at 812.00 per annum. Section 33. The City Clerk shall certify to the passage of this Ordinance and shall cause the same -_ to -be published once -in the Azusa Herald, a weekly newspaper published in the City of Azusa, and the same shall be in -force and effect from and after its publication. Section 34. That all Ordinances or parts of Ordinances of the City of Azusa in conflict with this Or- dinance be, and the same are hereby repealed. That Section No. 54-A, 54-B and 54-C of Ordinance No. 284 are hereby specifically repealed. The above and foregoing Ordinance No. 290 was passed and adopted at a regular meeting of the City Council of the City of Azusa, on the 2nd day of September, 1930. by the affirmative vote ^f the following named members thereof: Ayes: Johnson, Williams, Muehe, Meier.
