HomeMy WebLinkAboutOrdinance No. 304Now I ORDINANCE NO. 30 2 3 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA IMPOSING A LICENSE TAX UPON DOGS AND REGULATING THE 5 RUNNING AT LARGE, LICENSING AND IMPOUNDING OF DOGS AND ALSO PROVIDING FOR THE CONTROL AND ERADICATION OF RABIES WITHIN 6 SAID CITY OF AZUSA- 7 THE CITY COUNCIL OF THE CITY OF AZUSA DOES 8 ORDAIN AS FOLLO`9S: - 9 Section 2. It shall be the duty of the Section 1. It shall be unlawful for any 10 person owning, having an interest in, harboring, or having the care, charge, control, custody or posses - 11 sion of any dog, to allow or permit such dog to go free or to run at large in or upon any street, public 12 way, square or other public place in said City of Azusa unless around the neck of said dog is a collar 13 to which is attached a tag bearing the number marked thereon by the City Tax Collector of said City of 14 Azusa, provided however, that this requirement shall not apply to any dog which accompanies its owner, such 15 owner not being a resident of said City of Azusa. 16 Section 2. It shall be the duty of the Pound Master, his deputies or any police officer of 17 said City of.Azusa, to take up all dogs found in any street, public way, public square or other pub - 18 lic place in said City of Azusa, or upon any vacant or unoccupied or uninclosed lots, lands or premises 19 within said City of Azusa, unless a tag be attached thereto as in this Ordinance provided. When such 20 dog is taken up by any Police Officer, same shall be impounded in the Public Pound. 21 Section 3. Said Pound Master shall keep 22 confinedinsaid Pound, properly provided with food and water, for three days, all dogs impounded by him 23 and until said dog or dogs be redeemed by the payment of $1.00 pound fee. Said Pound Master shall post a 24 description of all dogs impounded by him in three public places in said City of Azusa for a period 25 not less than three days and if any dog is not re- deemed within three days after the description has 26 been posted, said dog shall be killed by the Pound Master in some humane way. 27 Section 4. The word "doge whenever used 28 in this Ordinance shall be deemed to include female as well as male dogs. 29 Section 5. That it shall be unlawful for 30 any person, firm or corporation to imitate or counter- feit the tags in this Ordinance provided for or to 31 use any imitation or counterfeit of such tag. 32 Section 6. It shell be unlawful for any person to rescue or attempt to rescue any animal mentioned herein from the possession of the Pound - 1 - Ir, N 1 Section 11. All dogs so captured by said Master while engaged in conveying the same to the 2 21 City Pound, or after said animal is confined in said relating to public health within the City of Azusa, Pound. 3 Section 7. Said Pound Master shall pay over 4 certain whether or not such dog is afflicted with wee y o the City Treasurer all sums collected by rabies. Any dog found by said Health Officer upon 24 him as herein provided and make a monthly report to 5 killed by the person having possession thereof, and said City Council of his proceedings hereunder. 6 Section 8. The terms "uninclosed lot or premi- 26 tion thereof, shall be returned to the owner thereof ses" as used in this Ordinance, is hereby defined 7 27 as meaning any lot, land or premises not enclosed in per day. such manner as to prevent any dog confined therein 8 from escaping therefrom. 9 Section 9. All muzzles'or apparatus for the muzzling of dogs shall be securely strapled or fas- tened to the head of the dog and shall be so made and applied that the same completely surrounds the 11 jaw and nose of the dog on which the same is fastened and shall be so arranged as to prevent the dog from 12 biting any person or thing, but so as to permit the opening of the mouth of such animal, allowing it to 13 breathe and drink with freedom. 14 Section 10. The Chief of Police and his offi- cers and the Pound Master or any other person employed 15 for that purpose by said City Council shall be and they are hereby authorized and empowered to capture 16 every dog not muzzled as required by this Ordinance and found going free or running at large in or upon 17 any public road or highway or: -any other public place or in or upon any uninclosed lot or premises in said 18 City of Azusa, or in case such officer or person shall upon pursuit be unable to mpture such dog, such officer or person shall be authorized &nd em - 19 powered to kill such dog. 20 II Section 11. All dogs so captured by said officer or person shall be examined by such offi- 21 cial or officials who are performing the functions relating to public health within the City of Azusa, 22 and it shall be the duty of such health officials when called upon to examine any such dog, to as - 23 certain whether or not such dog is afflicted with rabies. Any dog found by said Health Officer upon 24 examination to be so afflicted shall be at once killed by the person having possession thereof, and 25 any dog found not tc be so afflicted upon examina- tion, and after sufficient time for proper observa- 26 tion thereof, shall be returned to the owner thereof upon the payment of the expenses incurred in im- 27 pounding such dog, which shall not exceed fifty cents per day. 28 The Chief of Police of the City 29 of Azusa is hereby authorized to provide for the care of the dogs captured and held pursuant to the 30 provisions of this Ordinance, and the expenses in- curred thereby shall, in cases where such dogs are 31 not reclaimed, be paid by the City of Azusa not ex - 32 ceeding fifty cents per day for each dog. - 2 - N 1 Every person who kills any dog, as 2 herein provided shall bury or destroy the same. 3 I£ any dog is found not to be afflicted with rabies and is not reclaimed by the owner thereof, 4 within ten (10) days afterthe capture thereof, such dog shall be killed by the person capturing the same, 5 or given to such person as will pay the expenses in- curred in impounding such dog. All dogs killed under 6 the provisions of this Ordinance shall be killed in 7 �/ some humane manner. Section 12. Whenever it is shown that any dog or other 8 animal has bitten any person, it shall be unlawful for the owner or person having the care, control, custody 9 or possession thereof, upon order of the said Health Officer, to fail, refuse or neglect to quarantine such 10 dog and keep it tied up or confined for a period of 1 / three weeks or to fail, refuse or neglect to allow 11 v the said Health Officer or his deputy to make an in- spection or examination thereof at any time during 12 said period. If it shall be established to the sat- isfaction of the said Health Officer that any such 13 dog or other animal has rabies, the said Health Officer shall cause such dog or other animal to be 14 humanely killed forthwith. 15 Section 15. Whenever any animal shall be bitten by another animal having rabies, it shall be unlawful 16 for the owner or person having the care, control, custohy or possession of the animal so bitten, upon 17 being informed thereof, to fail, refuse or neglect to either kill such animal or quarantine it, and 18 keep it confined or tied up for a period of six months, and the said Health Officer or his deputy shall have the power, in his discretion, to kill or quar- 19 antine the animal so bitten in Case the owner or person having the custody or possession thereof, shall fail to 20 do so immediately, or in case the owner or person hav- ing the care, control, custody or possession thereof 21 is not readily accessible. 22 Section 14. It shall be unlawful for any person to bring any 3og into the City of Azusa from any place 23 in which rabies shall be present or shall have been known to be present within six months, without per - 24 mission of the s9id Health Officer. 25 Section 15. Sections 9 to 14, both inclusive of this rdin� ance shall be operative only when rabies exist 26 in or near the City of Azusa. �t shall be the duty of the said Health Officer to determine when rabies exist 27 in or near the City of Azusa and has finding in the matter shall be final and conclusive. Notice of the 28 finding of the said Health Officer as to the existence of rabies and as to the termination of the existence 29 thereof, in and near said City of Azusa, shall be given by one publication in such newspaper published 30 and circulated within said City as said City Council 31 may designate. 32 11 - 3 - 0 N 00 %.41 1 1 Section 16. That any person.. firm or cor- poration violating any of the provisions of this 2 Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine 3 not exceeding $300.00 or by imprisonment in the City 4 Jail of said City of Azusa for a period not exceeding three monthsy or by both such fine and imprisonment. 5 Section 17. This Ordinance is urgently re - 6 quired for the immediate preservation of the public peace., health and safety as cases of rabies exist within portions of the County of Los Angeles and said 7 City of Azusa having no Ordinance in regard to the control and eradication of rabies.. such Ordinance is 8 immediately required for same. 9 Section 18. Ordinance No. 228 of the City 10 of Azusaaay being an Ordinance entitled "An Ordinance of the City of Azusa Requiring Dogs Running at Large 11 to be Muzzled; Providing for the Destroying of Un - muzzled Dogs; and Providing,a Penalty for the Viola - 12 tion of said Ordinance" is hereby repealed. 13 section 19.
