HomeMy WebLinkAboutOrdinance No. 338. o- as follows; r ORDINANCE NO. t-18 9 AN ORDINANCE OF THE CITY COU14CIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, CONSENTING TO THE ESTABLISIUAVN^1 OF THAT PART OF FIRST STREET SPHERE SAID FIRST STREET IN THE CITY OF AZUSA CROSSES LITTLE DALTON 'NASH, AS A PART OF THE COUNTY SYSTEM OF HIGMVAYS, AND CONSENTING TO THE IMPROVEMENT THEREOF BY THE COUNTY AS AN 041ERGENCY MEASURE AND MATTER OF URQENCt POR THE IMMEDIATE PRESERVATION OF THE PUBLIC PEACE, HEALTH AND SAFETY. The City Council of the City of Azusa does ordain SECTION 1. Pursuant to and in furtherance of a resolution of the Board of Supervisors of Los Angeles County, California, adopted October 11,1938, in which said resolution said Board declares its intention to improve that portion of First Street in the City of Azusa which crosses Little Dalton Wash, provided the City Council of the City of Azusa consents thereto, it is hereby declared and determined by the City Council of the City of Azusa, Los Angeles County, California, in accordance with the terms of this ordinance, that the said city shall,and the same does hereby, consent that that part of First Street within said City of Azusa and hereinafter particularly described, be establish- ed and included as a part of the County System of Highways, and that the governing body of said city, viz, the City Council, shall,and the same does hereby, consent to the establishment of such included portion of First Street as a part of the County System of Highways under the provisions of Sections 1700 and 1702 inclusive of Chapter 29 of the Statutes of 1935 of the State of California, and further, that said city shall, and the same does hereby, consent to the improvement, by the county, to be paid for out of County funds, by the construction of a concrete dip,grading and repaving with rock and oil, of said included portion of said First Street, said included portion slbeing as follows: All that portion of First Street within the City of Azusa, Los Angeles County, California, from a line 200 feet westerly of and parallel with the westerly line of Pasadena Avenue in said city, to a line 500 feet westerly of and parallel with the said westerly line of said Pasadena Avenue. SECTION 2. This ordinance is an emergency measure and is urgently required for the immediate preservation of the public peace, health and safety of the City of Azusa and its environs for the reasons and upon the grounds that the little Dalton wash where said wash Intersects First Street in the City of Azusa carries a large volume of water in the rainy season; that said intersection of little Dalton wash and First Street has bmm dammed b!E the waters of little Dalton wash to such an extent that said intersection as it now stands is impassible during the rainy season and extremely dangerous; that due:.to the present condition of said intersection, waters coming down the little Dalton wash are liable to be impeded and backed up and rendered uncontrollable; that there is a large amount of traffic on First Street, a public thoroughfare of the City of Azusa, which traffic must needs cross the intersection of little Dalton wash or else be shut off from access to points reached on First Street by crossing little Dalton wash; dig the dry season is now coming to an end in the vicinity of Azusa and heavy rains may be expected at any time, rains which have come in prior years and which will undoubtedly come during the current year and in the present season of such intensity as to so fill the little Dalton wash with rapidly flowing water; that unless the improvement contemplated by this ordinance is immediately made, said First Street will be entirely cut off to traffic and rendered dangerous at the point of said intersection, and further, that the public health and safety of the City of Azusa cannot be preserved and safeguarded unless the improvement contemplated by this ordinance be immediately made. SECTION 3. The Mayor shall sign this ordinance and the City Clerk shall attest the same and certify to the passage,adoption and publication thereof, and shall cause same to be published once within fifteen days after its passage in the Azusa Herald and Pomotropic, a weekly newspaper of general circulation published and circulated in the City of Azusa, which said newspaper is hereby designated for that purpose and thereupon and immediately upon said publication this ordinance shall take effect and be in force. HYNES, City Clerk of the City of Azusa, Los Angeles County, California, do hereby certify that the foregoing Ordinance was duly introduced and placed upon its first reading at an adjourned regular meeting of the City Council of the City of Azusa held on October 18,1938, in the regular Council Lhambers of said City Council in said City, said adjourned meeting having been so held October 18,1938, pursuant to the adjournment of said council taken at its regular meeting October 17,1938; that said Ordinance, including the matters of urgency set forth therein, was duly and regularly read, con— sidered, passed and adopted by said Council, signed and approved by the I,,4ayor and attested by the City Clerk of said city at a subsequent adjourned regular meeting of said regular meeting of October 17,1938, of said Council, so held in the regular Council Chambers of said City Council on October 27,1938 pursuant to adjournment taken at its adjourned regular meeting October 18,1938, and that the same was passed and adopted at said adjourned regular meeting of October 27,1938, by the unanimous vote of the council, as follows: Ayes: Councilmen-,?/�i Noes; Councilmen:/(ri�n_ Absent: Councilmen.
