AN ORDINANCE OF THE CITY OF AZUSA, LOS ANGELES COUNTY,
CALIFORNIA,.AMENDING SECTION 1 OF ORDINANCE NO. 255
OF SAID CITY OF AZUSA, RELATING TO WATER RATES AIdD WATER
CONNECTIONS.
The City Council of the City of Azusa does ordain as follows:
Section 1'. That Section 1 of Ordinance No. 255 of
the City of Azusa, without disturbing, changing or
amending any of the other sections or provisions
of said ordinance, shall be, and the same is hereby,
amended to read as follows:
Section 1. The furnishing of water service by
the City of Azusa, and tla rates to be charged and
collected by the City of Azusa for water furnished
by it, from and through its water system to con-
sumers, shall be in accordance with the provisions
of this section, wherever such provisions are
applicable.
(A) DOMESTIC RATE WITHIN THE CITY
For each separate tenement occupied by a single
family, where no meter is installed, there shall be
charged a flat monthly rate of . . . . . .$k1.00
(A tenement shall be construed to mean any
premises occupied by any person or persons or
family who are living together under the same
roof and boarding at one and the same table.)
The City of Azusa shall have the right and
option of installing a water meter for any
consumer,whereupon meter rates for domestic
water shall be charged as follows:
For the first 1400 cubic feet or less
supplied per month . . . . . . $1.00
For the next 700 cubic feet supplied
per month, $.08 per hundred cubic feet.
For the next 3,000 cubic feet supplied
per month, $A per hundred cubic feet.
For all over 5,100 cubic feet supplied
per month, $.05 per hundred cubic feet.
The minimum monthly charges shall be as
follows:
For water served through a meter
smaller than 1 inch . . . .$1.00
For water served through a meter
of 1 inch . . . . . . . . . $1.25
For water served through a meter
of lz inches . . . . . . . .$1.50
For water served through a meter
of 2 inches . . . . . . . . $2.00
For domestic water served through
each, every and all meters of a
larger size than 2 inches, the
minimum monthly charge shall be
$2.00 plus $1.00 additional for each
additional inch over two inches.
In all instances where a main is tapped for
domestic water purposes or service lines are run
for such purposes from the main to the point of
delivery or a meter or meters are set to measure
such water furnished or to be furnished by the city,
the tap or taps at the main as well as the service
line or lines to the point of delivery and also the
meter or meters set by the city, shall be and remain
at all times the property of the city and not the
property of the private owner, regardless of any
charges made by the city for tapping the main or
running the service lines or setting meters.
The charges of the city for tapping the main
for domestic water purposes, for running its
service line to the point of delivery and for
setting its meter, shall be as follows:

(B) IRRIGATING AND WHOLESALE RATE WITHIN
THE CITY
Any person desiring to use water for irrigating,
industrial or agricultural purposes in the City of
Azusa shall make application to the City Council
of said city for a permit therefor, specifying the
place and nature of said intended use and said
City Council, if satisfied that such is for such
purposesand that such permit may be granted with—
out detriment to said city, may, in its discretion,
grant a permit therefor, and the rate for such
water so supplied is hereby fixed as follows:
For the first 1000 cubic feet per
month, $.10 per hundred cubic feet.
For all in excess of 1000 cubic feet
per month, $.04 per hundred cubic feet.
All water sold under this irrigating and
wholesale rate shall be supplied through a
separate meter. No mater for domestic purposes
shall be used through said separate meter.
The right to at any time revoke or rescind any
permit for irrigating and wholesale rate water is
hereby reserved to the City Council of the City
of Azusa.
The minimum monthly charges for service under
such separate irrigating and wholesale rate meters
shall be as follows;
For water served through a one
Inch meter or -smaller $1.25
For water served through a
1� inch meter . . . . . . . $1.50
For water served through a
2 inch meter . . . . . . . . . $2.00
For all irrigating and wholesale rate water served
through each and every meter of a larger size
than 2 inches, the minimum monthly charge shall be
2.00 plus $1.00 additional for each additional
inch over 2 inches.
Said minimum charges shall be paid by the consumer
for each of the twelve months of the year whether
water is used or not.
In all instances where a main is tapped for irrigating,
Industrial or agricultural water purposes or service lines
are run for such purposes from the main to the point of
delivery or a meter or meters are set to measure such
water furnished or to be furnished by the city, the tap
or taps at the main as well as the service line or lines
to the point of delivery and also the meter or meters set by
the city, shall be and remain at all times the property
of the city and not the property of the private owner,
regardless of any charges made by the city for tapping
the main or running the service lines or setting meters.
The charges of the city for tapping the main
for irrigating, industrial or agricultural water
purposes, for running its service line to the
point of delivery and for setting its meter, shall
be time and materials plus -15%.
(C) GENERAL,PROVISIONS
The City of Azusa may from time to time rent the
use.of its water stock in water companies, or the
water it may be entitled to receive from any such
companies, on such terms and conditions as shall be
fixed by the City Council at the time of renting the
same, and such action shall be reported fully in the
minutes of said Council at the time of granting such
rental privilege; provided, however, that said City
of Azusa hereby declares that all water which it
now has or may hereafter acquire shall first be held
and used for the present and future domestic water
supply of the inhabitants of said City of Azusa, but
that said city may, in the manner hereinbefore pro-
vided, thus rent the use of any such water stock or
water which it may be entitled to receive from any
water company, for limited periods only, when not
required for its domestic water supply.
Whenever the amount of any billing of the City
of Azusa,for water service rendered by it, is not
an exact multiple of 5 cents, such billing shall
be reduced or increased to the nearest multiple of
five cents as the case may be.
Whenever a meter fails to register during any
period of water service furnished by the city, and
the reading from such meter would ordinarily be
required in order to determine the proper charge of
the city for the furnishing of such water service,
then and in that case a reasonable charge shall be
made by the city covering the period within which
the meter failed to register, which reasonable
charge may be based upon prior experience or prior
readings..
The City of Azusa reserves the right to meter or
to require the consumer to meter any and all water
furnished or supplied by said city.
The City of Azusa reserves the right to at any
time discontinue water service to any consumer upon
non-payment of the city's charges for such service.
Whenever and if ever water service is furnished
by the city to any consumer who uses or consumes
outside the city the water so supplied by the
city, the rates or charges for the rendering
of such water service and the supplying of such
water,shall be double the applicable rates and
charges established by said city for water or
water service within the city.
Section 2. All ordinances and parts of ordinances
(excepting Section 1 of Ordinance No. 255, which
Section 1 is amended by the provisions of this
ordinance) heretofore passed and adopted by the.City
of Azusa or by the City Council or Board of Trustees
thereof shall be, and the same are, hereby repealed
in so far only as said ordinances or parts of ordinances
conflict or are inconsistent with the provisions of this
ordinance, which said repeal of said ordinances or
parts thereof in so far only as same conflict or are
inconsistent with the provisions of this ordinance,shall
be effective as of the effective date of this ordinance.
Section 3. This ordinance shall take effect and be in
force on November 19,1938 and from that date thence forth.
Section 4, The Mayor shall sign this Ordinance and the
City Clerk shall attest and certify to the gaassage, adoption
and publication of the same, and shall cause the same
to be published once, within fifteen days after its passage,
in the Azusa Herald and Pomotropic, a weekly newspaper
of general circulation published and circulated in the said
City, which newspaper is hereby designated for that purpose,
and thereupon and thereafter more than thirty days after
its passage viz on November 19,1938 said ordinance shall
take effect and be in force.

the, City of Azusa, County of Los Angeles, State of California,
duly and regularly held on the 19th day of September,1938,
in the regular Council Chambers in said City of Azusa, Los
Angeles County, California; that said Ordinance was regularly
passed and adopted by said City Council, signed by the Mayor
and attested by the City Clerk of said City at a regular
meeting of said Council so held in the regular Council
Chambers on the 3rd day of OCt6ber,1938, and that the
same was passed and adopted by the following vote of the
Council:
