AN ORDINANCE OF THE CITY OF AZUSA REGULATING
THE DISTRIBUTION OF HANDBILLS AND PROVIDING
THE PENALTY FOR VIOLATION OF THIS ORDINANCE
AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINAIXES IN CONFLICT HEREWITH.
The City Council of the City of Azusa does ordain
as follows: -
SECTION 1. Definitions.
The following words, terms and phrases when
used in this ordinance have the meanings ascribed
to them in this section, except where the context
clearly indicates a different meaning:
(a) "Person" includes any person, firm, part-
nership, association, corporation, company, or
organization of any kind.
(b) "Handbill" includes any printed or written
advertising matter, any sample or device, dodger,
circular, leaflet, pamphlet, newspaper, paper, book-
let, or any other printed matter or'literature,(but
excludes any such matter which pertains exclusively to
expressions of opinion on purely political matters)
SECTION 2. Distributing on Public Property.
It shall be unlawful for any person, either
directly or indirectly, to deposit, place, throw,
scatter, or cast, any handbill in or on any public
thoroughfare, park, ground or other public place
within the City of Azusa; the provisions of this
section shall not be deemed to prohibit the handl:lg,
transmitting or distributing of any handbill to any
person willing :to accept such handbill.
SECTION 3. Placing in Vehicles.
It shall be unlawful for any person, either
directly or indirectly, to distribute, deposit, place,
throw, scatter or cast, any handbill in or upon any
automobile or other vehicle; the provisions of this
section shall not be deemed to prohibit the handing,
transmitting or distributing of any handbill to the
owner or other occupant of any automobile or other
vehicle who is willing to accept such handbill.

SECTIOIT 4. Distributing on Private Property.
It shall be unlawful for any person, either directly
or indirectly, to distribute, deposit, place, throw,
scatter, or cast; any handbill in or upon any private
yard, grounds, walk, porch, steps, mailbox, vestibule,
house, residence, building, or any other private
property; the provisions of this section shall not be
deemed to prohibit the handing, transmitting or distribu-
ting of any handbill to the owner or other occupant
of said Drivate.yard, grounds, calk, porch, steps, mail-
box, vestibule, house, residence, building or other
private property, who is willing to accept such handbill.
SECTION 5. Posting Property Permitted.
It shall be lawful for the owner or the occupant
of any property to place a sign in a conspicuous place near
the entrance thereof indicating that no handbills are
desired; and it shall be unlawful for any person, to dis-
tribute,deposit, place, throw, scatter, or cast, any
handbill upon said premises so posted.
SECTION 6. Hours of Distribution Limited.
It shall be unlawful for any person to distribute
any handbill between the hours of 9;00 P.Pi. of any day
and 5:00 A.M. of the following day.
SECTIO;' 7. Exemptions.
The provisions of this ordinance shall not be deemed
to apply to messenger service or to the distribution of
the United States mail or telegrams, nor to the delivery
of any handbill to any person who has requested delivery
of same.
SECTION 8.
Ordinance No. 298 of the City of Azusa adopted and
approved on the 17th day of October, 1932, and all
ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTIO174 9. Severability.
If any provision of this ordinance, or its applica-
tion to any person or circumstance, is held invalid,
the remainder of the ordinance, or the application of
the provision to other persons or circumstances is
not affected. '

SECTION 10. Penalty.
Any person who shall violate any provision of this
ordinance shall be guilt* of a misdemeanor and upon
conviction thereof shall be punished by a fine of not
more than Two Hundred Dollars ($200.00). or by Imprison-
ment in the City Jail or in the.County Jail of th6
County of Los Angeles for not exceeding Two (2).months,
or by both such fine and imprisonment.
SECTION -11. Approval, Attestation & Publication.
The Mayor shall sign this ordinance and the City
Clerk shall attest the same and certify to the passage,
adoption and publication of the same and shall cause
the same to be published once within 15 days after its
passage, in the Azusa Herald & Pomotropic, a weekly
newspaper of general circulation published and circulated
in the City of Azusa, which said newspaper is hereby
designated for that purpose and thereupon and thereafter
30.days after its passage this ordinance shall take
effect and be in. force.

was duly and regularly passed and adopted by said Council, signed
and approved by the E:iayor, and attested by the City Clerk of said
City, at a regular meeting of said. Council so held in the regular
Council Chambers of said City Council at the next regular meeting

was then passed and adopted by the following vote of the Coundil:-
