HomeMy WebLinkAboutOrdinance No. 358i r I r ORDINANCE NO. 3S$ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA LOS ANGELES COUNTY CALIF- ORNIA, PROHIBITING THE COERCION OA INTjIP.QI- DATION OF PERSONS IN THE STREETS, SIDEWALKS OR PUBLIC 'NAYS IN THE CITY OF AZUSA, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. The City Council of the City of Azusa does ordain as follows: - SECTION 1. It shall be unlawful for any person or persons in or upon any public street, sidewalk, alley, park, parkway or public way in the City of Azusa, to loiter, stand or patrol or to by word or act make threats of violence, or to throw or to by word or act threaten to throw missiles;; in front of, about or near any place of business or employment, residence, dwelling, garage, building or other structure, for the purpose or with the intent of deterring or preventing, by intimidation or coercion, any person from lawfully entering or seeking entrance to or from lawfully leaving or attempting to leave such place of business or employment, residence, dwell- ing, garage, building or other structure. 1. 0 iW SECTION 2. It shall be unlawful for any person or persons in or upon any public street, sidewalk, alley, park, parkway or public way in the City of Azusa, willfully to block, impede or obstruct Any entrance or approach to or exit or way from any place of business or employment, residence, dwell- ing, garage, building or other structure, for the purpose or with the intent of deterring, by intimida- tion or coercion, any person from lawfully entering or seeking entrance to or from lawfully leaving or attempting to leave said place of business or employ- ment, residence, dwelling, garage, building or other structure. SECTION `. It shall be unlawful for any person or persons to utter or proclaim to, or in the presence or hearing of, any other person or persons, in or upon any public street, sidewalk, alley, park, parkway or public way in the City of Azusa, any indecent, obscene, profane, opprobrious or insulting epithets, words or language, or to so utter or pro- claim to or within the hearing or presence of any other person or persons any threats of violence, for the purpose of threatening, coercing or intimidating such other person or persons. SECTION 4. The violation of any of the terms or provisions of this ordinance shall be deemed unlawful and a separate violation of this ordinance for each and every day within which this ordinance is Violated. - 2 - r SEBg_ .IOC_ Any person violating any of the provisions of this ordinance shall, for each violation thereof, be deemed guilty of a misdemeanor, and upon conviction by any court of competent jurisdiction, shall be punishable by a fine of not more than 0200.00 or by imprisonment in the Azusa City Jail or in the County Jail of the County of Los Angeles for a period of not exceeding 30 days, or by both such fine and imprisonment. SECTION 6. If any section, sub -section, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Azusa hereby declares that it would have enacted this ordinance and each section, sub -section, sentence, clause or phrase thereof, irrespective of the fact that any one or more other sections, sub -sections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 7. The Mayor shall sign this ordinance and the City Clerk shall attest same and certify to the Passage, adoption and publication of the same and shall cause the same to be published once, within 15 days after its passage, in the Azusa, Herald and Pomotropic, a weekly newspaper of general circulation published and circulated in the City of Azusa, which said newspaper is hereby desig- nated for that purpose, and thereupon and thereafter 30 days after its passage this ordinance shall take effect and be in force./,- Attest; -V.
