HomeMy WebLinkAboutOrdinance No. 3671 2 3 4 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 follows: L ORDINANCE NO. 367 All ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA ESTABLISHING All AIR RAID 17ARDEN SERVICE A'..'D PROVI=.G FOR ITS CONTROL. The City Council of the City of Azusa does ordain as SECTION 1, An Air Raid Warden Service is hereby established, the same to be a volunteer organization separate and distinct from the Police Department of this city, but headed by the Chief of Police. SECTION 2 The Chief of Police of this city shall have complete authority, control and command over the Air Raid Warden Service subject to the provisions of this ordinance and to any other lawful directions of the City Council or of the Azusa Defense Council or of the Co-ordinator The Chief of Police may ,appoint such members of said fir, Raid Warden Service as he may deem to be qualified and may provide for their training. SECTION �), No person shall be deemed a member of the Air Raid harden Service until heh s been registered as such in a roster to be kept by thethief of Police, and until he has taken his oath that he will observe and obey the Constitution of the United States, the Con- stitution of this State, and the laws of this Nation, this State and this City, and that he will carry out the duties of a, member of the Air Raid Warden Service of this City to the best of his ability. Each person so registered and sworn shall be deemed an Air Raid Warden within the meaning of this ordinance. SECTION 4. The Chief of Police shall by order establish rules andregulations governiig the Air Raid Warden Service and fixing the duties of its members. He may change such rules and regulations from time to time and he may command Air Raid Wardens to obey the instructions of regular police officers in carrying out their duties. SECTION 5. An identification card and such other insignia or evidence of identity as the Chief of Police may prescribe shall be issued to each member of the Air Raid Warden Service, whomuEFt carry the card and other identification at all times while on duty, and he must surrender them upon the termination of his membership. -I- 1 2 3 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 SECTION 6. The Chief of Police may by order diminish or expand the membership of the Air Raid Warden Service as exigency may require, within how- ever any limits prescribed by the Azusa City Council. 3ECTIONsg, in addition to the penalties provided by law, any violation of law under color of the performance of his duties as a member of the Air Raid Warden Service, and any breach of the Rules and Regulations established by the Chief of Police shall subject any member thereof to summary expulsion and the fact thereof may be published at the order of the Chief. SECTION 9, It shall be a misdemeanor punish- able by a fine of not to exceed '1300.00 or by imprisonment in the City Jail or in the County Jail not exceeding three months, or by both such fine and imprisonment, for any person to wear, carry or display an Air Raid Warden Service identification card or insignia or otherwise to lxlma-17. represent himself to be a member of that 5ervicet unless he is at that time actually a member thereof. SECTION 10. This ordinance is declared to be an emergency measure necessary for the immediate preser- vation of the public peace, health and safety and shall take effect and be in force from and after its passage and publication as required by law. A declara- tion of and the facts constituting the urgency of this measure is that the United States is at war and this city is in great and continuing danger of attack by the enemy, that the exigencies of war and the immi- nence of great public peril have thrown unprecedented burdens upon the employees of this city and the danger to the city is such as to admit of no delay in providing the volunteer support and aid of the citizenry in the maintenance of public health and safety. SECTION 11, The Mayor shall sign this ordinance and the City Clerk shall attest the same and certify to the passage, adoption and publication thereof and shall cause the same to be published once, within 15 -2- oil 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 days after its passage, in the Azusa Herald & Ponotropic, a weekly newspaper of general circu- lation printed, published and circulated in the City of Azusa, which said newspaper is hereby desig- nated for that purpose and thenceforth and there- after this ordinance shall be in full force and effect. Hynes, City Clerk of the City of Azusa, Los Angeles County, California, do hereby certify that the fore- going Ordinance was duly introduced,placed upon its first reading and fully read at a special meeting of the City Council of the City of Azusa held on April 3, 1942, in the regular Council Chambers of said City Council in said City; that thereafter said ordinance was duly and regularly passed and adopted by said. Council, signed and approved by the Mayor and attested by the City Clerk of said City, at a regular adjourned meeting of said Council so held in the regular Council Chambers of said City Council on April 9, 1942, and that the same was passed and adopted by the following vote of the Council: Ayes: Councilmen: Jumper, Malone, Arnold, Owens. Noes: None Absent: Councilman: Bradshaw I DO FURTHER CERTIFY that I caused said ordinance to be published prior to the expiration of fifteen days from the passage thereof in the Azusa Herald and Pomotropic on April 9, 1942, a newspaper of general circulation, printed, published and circulated in said City of Azusa, and that the same was published in accordance with law. _2E_ 11.
