AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF AZUSA, CALIFORNIA, RELATING TO
THE DEFINITION OF TMPORARY BUSINESS.
The City Council of the City.of Azusa does ordain
as follows:
Section 1. In the computation of license
fees payable on and after July 1, 1942, to the
City of Azusa under any ordinance fixing such
fees, the definition of a "Temporary Business"
shall not be held or construed to include any
business carried on in the City of Azusa which
business at the time it is carried on is not
competitive with any other business or busi-
nesses carried on at said timein said City.
Said non-competitive business immediately
hereinbefore described in this section, shall
be subject to the ordinances and other laws
applicable to a "Permanent Business" and
shall pay the license fees and be classified
as and subject to the regulations of a
permanent business.
Section 2. If any section, sub -section,
sentence, clause or phrase of this ordinance is,
for any reason, held to be invalid or unconsti-
tutional, such decision shall not affect the
validity of the remaining portions of this
ordinance nor shall such decision affect the
validity of any prior ordinances of the City
or portions thereof. The City Council of the
City of Azusa hereby declares that this
ordinance and the provisions thereof are and
shall be cumulative to the provisions of other
and prior ordinances, and that in the event
this ordinance shall be held to be invalid or
unconstitutional, all prior ordinances shall
be and remain =affected by the terms of
this ordinance.

Section 3. This ordinance is declared
to be ars emergency measure necessary for the
immediate preservation of the public peace,
health and safety and shall take effect and
be in force from and after its passage and
publication as required by law. A declara-
tion of and the facts constituting the urgency
of this measure is that the fiscal year of the
City of Azusa begins July 1, .1942, and.it is
necessary that in order to properly regulate
the businesses carried on in the City of
Azusa, that this ordinance take effect in the
month of July, 1942.
Section 4. The Mayor shall sign this
ordinance and the City Clerk shall attest the
same and certify to the passage, adoption and
publication thereof and shall cause the same
to be published once, within 15 days after its
passage, in the Azusa Herald & Pomotropic, a
weekly newspaper of general circulation printed,
published and circulated in the City of Azusa,
which said newspaper is hereby designated for
that purpose and thenceforth.and thereafter
this ordinance shall be in full force and
effect.

Los Angeles County, California, do hereby certify that the
foregoing ordinance was duly introduced, placed upon its
first reading and fully read at a regular meeting of the
City Council of the City of Azusa held on July 6, 1942,
in the regular Council Chambers of said City Council in
said City; that thereafter said ordinance was duly and
regularly passed and.adopted by said Council, signed and
approved by the Mayor and attested by the City Clerk
of said City, at a x°^. regular meeting of
said Council so held in the regular Council Chambers of
said City Council on July ?0 , 1942, and that
the same was passed and adopted by the following vote of
the Council:
Ayes: Councilmen: Owens, Malone, Bradshaw,
Morde, Jumper.
Noes: None
Absent: None
I DO FURTHER CERTIFY that I caused said ordinance
to be published prior to the expiration of fifteen days from
the passage thereof in the Azusa Herald & Pomotropic on
23rd day of Jules1942, a newspaper of general circulation,
printed, published and circulated in said City of Azusa, and
that the same was published in accordance with law.
