HomeMy WebLinkAboutOrdinance No. 400ORDINANCE N0. 400 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING ORDINANCE NO. 326 OF SAID CITY OF AZUSA ENTITLED, "AN ORDINANCE OF THE CITY OF AZUSA LICENSING FOR THE PURPOSE OF REVENUE AND REGULATION, ALL AND EACH KIND OF BUSINESS CARRIED ON IN SAID CITY; PRESCRIBING THE PENALTY FOR VIOLATIONS OF THIS ORDINANCE, AND REPEALING AS OF JULY 1, 1937, ORDINANCE I40. 284, ORDINANCE N0, 290, ORDINANCE. N0. 310, ORDINANCE NO. 315 AIM ALL OTHER ORDINANCES OR PARTS OF ORDINANCES, INSOFAR ONLY AS ANY OF THE PROVISIONS OF SAME CONFLICT HEREWITH. follows: The City Council of the City of Azusa does ordain as SECTION 1. That Subdivision "D" of Section 1 of Ordinance No. 326 of said City of Azusa entitled, "AN ORDINANCE OF THE CITY OF AZUSA LICENSING FOR THE PURPOSE OF REVENUE AND REGULATION, ALL AND EACH KIND OF BUSINESS CARRIED ON IN SAID CITY; PRESCRIBING THE PENALTY FOR VIOLATIONS OF THIS ORDINANCE, AND REPEALING AS OF JULY 1, 1937, ORDINANCE NO. 284, ORDINANCE NO. 2902 ORDINANCE N0. 310, ORDINANCE N0. 315 AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES, INSOFAR ONLY AS ANY OF THE PROVISIONS OF SAME CONFLICT HEREWITH" is amended to read as follows: SECTION 1 (D) "Solicitor" shall be construed to mean and include every person not having a fixed place of business in the City who travels from place to place,,or house to house, and makes demonstrations of, or solicits, takes orders or canvassesflDrosale of or who sells any goods,°wares, merchandise, subscriptions to periodicals or magazines, or things of value of any nature, kind or description. SECTION 2. That Section 9 of said_ Ordinance No. 326 shall be amended to read as follows: SECTION 9. RATE OF LICENSE FEE. (A) The rates of license fees for the businesses hereinaf ter named, carried on within the City of Azusa, shall be and the same are hereby fixed according to the following schedule, and the same shall be paid by any and all persons engaged in such business or businesses. Said rates are as follows, to -wit: - 1 - (1)PERMANENT BUSINESS: (Except any permanent business specifically mentioned in, and as to which a license fee is fixed by other terms of, this section) ---An annual license fee of $12.00. (2) TEMPORARY BUSINESS: (Except any temporary business specifically mentioned in, and as to which a license fee is fiXe(5 by other terms of, this section) --A semi-anual license fee of $150.00 or a daily license fee of $10.00. (3) Any person practicing or professing to practice the business or art of Astrology, Augury, Card -reading, Cartomancy, Clairvoyance, Crystal -gazing, Divination, Fortune-telling, Hypnotism, Magic, Mediumship, Necromancy, Palmistry, Phrenology or Prophecy, or any similar business or art, who either solicits or receives a gift or fee for such practice, or where admission is charged for such practice, shall pay a daily license fee of $10.00. (4) CARNIVAL: A daily license fee of $10.00. (5) CIRCUS: A daily license fee of $25.00. (6) PEDDLER: A daily license fee of $5.00. (7) SIDESHOW: A daily license fee of $10.00. (8) SOLICITOR: A solicitor shall pay a license fee of 010.00 per week if the application be for a week or less time, or 25.00'per month if the application granted be for a period of a month or the sum of $100,00 per year if the license applied for be for a period of a year. (9) STREET FAIR: A daily license fee of $10.00. (10) DISBRIBUTION OF HAND BILLS, samples or other advertising mediums, data or matter from house to house or from place to. place (except the distribution of .complete newspapers holding a Second Class Permit under United States Postal Regulations, provided such newspapers be distributed in such form as is set forth In said Second Class Permit), an annual license fee of $24.00, or a daily license fee of $5.00. (11) BILLIARD, POOL AND GAME TABLE: Where more than two tables are in place, whether used or not, and in addition to the license fee paid by the business of which said tables are a ?art, for each table in excess of two, an annual license fee of $2.50. (B) The provisions of this section are enacted in pursuance of a method of classification of businesses conducted in the City of Azusa, which businesses from their very nature require differing plans and methods of regulation. _ 2 - SECTION 3. That Ordinance No. 326 shall be amended by adding a new section thereto entitled Section 92 which shall read as follows: "Every person applying for a solicitor's license shall make written application to the City Clerk therefor, which application shall set forth the names and addresses of the applicant; the name and address of the employer of such applicant, if he has one; the nature of the business of such employer and the nature of the product for which the petitioner will solicit. The applicant shall also file with his application an affidavit setting forth his citizenship status; that he has not been convicted of a felony and the place of his or her residence showing the address thereof during a period of two years last prior to the date of the application. That after said application has been filed, the City Clerk investigate the applicant and the statements in said application contained, which investigation shall not exceed a period of one week. If, upon such investigation, it is found that the statements set forth in said application are true, license may be issued, and if, on the other hand, they are found to be untrue in any material manner, appli- cation for license may be denied. In the event the City Clerk shall refuse to issue a license to applicant, such applicant may appeal from the decision of the City Clerk to the City Council of the City of Azusa by filing a written notice of said appeal in the office of the City Clerk within five days after notification by the City Clerk that his application for license has been denied. It SECTION 4. The Mayor shall sign this Ordinance and the City Clerk shall attest same and certify to the passage of this Ordinance and shall cause the same to be published once in the Azusa Herald and Pomotropie, a weekly newspaper of general circulation, published and circulated in the City of Azusa, which newspaper is hereby designated for this purpose. &G� -1)-n 1[t /�%���+�t��C Mayor of the UltY of Azusa ATTEST: _City Clerk the City of Azusa.
