HomeMy WebLinkAboutOrdinance No. 397ORDINANCE NO. 397 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AMENDING ORDINANCE NO. 342 KNOWN AS THE ZONING ORDINANCE OF SAID c, CITY RECLASSIFYING A PORTION OF LOTS 9.AN- lO,BLOCK "C" SUBDIVISION NO. 1 OF AZUSA LAND AND WArTER COMPANY. J The City Council of the City of Azusa does ordain as follows; SECTION 1. It is hereby declared that in accordance with the intent and purpose of this Ordinance, the north and south dimension of Lot 9 hereinafter referred to is 290 feet, and the east and west dimension of said Lot is 730 feet, said declaration being hereby made for greater certainty, inasmuch as Azusa Avenue and East First Street in said City of Azusa, intersecting at said Lot 9, are each of them 80 feet wide and the original north and south dimension of said Lot 9 formerly shown as 330 feet is for the purpose of this Ordinance reduced to 290 feet by deducting half of the 80 foot width of East First Street, and the original east and west dimension of said Lot 9 formerly shown as 770 feet is for the purpose of this Ordinance reduced to 730 feet by deducting half of the 80 foot width of Azusa Avenue. SECTION 2. (A) Ordinance No. 342 of the City of Azusa, and the Zoning Map accompanying same, adopted by the City Council thereof February.21, 1939, shall be and the same are hereby amended so as to set forth and provide that the following portion ofLot 9, Block "C" of Subdivision No. 1 of the lands of Azusa Land and Water - 1 - Company, in the City.of Azusa, County of Los Angeles, State of California, as per map recorded in Book 16 Pages 17 et seq., of Miscellaneous Records, in the office of the County Recorder of said County, shall be and the same is hereby classified and zoned as Zone C-2 - Neighborhood Business Districts, said portion being the west 340 feet of the north 100 feet of said Lot 9. (B) The construction of buildings in aforesaid portion of Lot 9 zoned herein C-2, shall conform to Fire Zone No. 2 requirement& SECTION 3. Aforesaid Ordinance No. 342 and the Zoning Map accompanying same, shall be and the same are hereby further amended so as to set forth and provide that all of aforesaid Lot 9 except the following portions thereof, shall be and the same is hereby classified and zoned as Zone R-4 - Apartment House Districts, said portions of said lot not being affected hereby and not classified as Zone R-4 being as follows, to -wit: Except the best 340 feet of the North 100 feet of said Lot 9, which said portion is classified herein as Zone 0-2. Also except that portion of aforesaid Lot 9 lying within boundary lines drawn and beginning at a point on the Azusa Avenue frontage of said Lot 92 100 feet South of the Northwest corner of said Lot 9, said Northwest corner being at the intersection of Azusa Avenue and East First Street in said City; thence South along the Azusa Avenue frontage 190 feet more or less to the South line of said lot; thence East along said South line 175 feet; thence North 190 feet more or - 2 - less to the South line of that portion of said Lot 9 hereinbefore classified and zoned C-2; thence West parallel with the North line of said Lot 175 feet more or less to the point of beginning, which said portion is already classified Zone R-1 and which classification is not here disturbed. SECTION 4. Aforesaid Ordinance No. 342 and the Zoning Map accompanying same shall be and the same are hereby further amended so as to set forth and provide that the North 47 feet of Lot 10, except the Westerly 175 feet thereof, shall be and the same is hereby classified and zoned as Zone R-4 — Apartment Nouse Districts, said lot being Lot 10, Block "C" of Subdivision No. 1 of lands of Azusa Land and Water Company, in said City of Azusa, County and State, as per map recorded in Book 16 Page 17 et seq., Miscellaneous Records of said Los Angeles County. SECTION 5. In the erection, construction or maintenance of any buildings or other structures on any of the lands fronting on Azusa Avenue and classified as Zone C-2 in Section 2 hereof and. as Zone R-4 in Section 3 hereof, a set—back of 10 feet shall be maintained from the Westerly line of said land running along Azusa Avenue. SECTION 6. In the event the land classified Zone R-4 in Sections 3 and 4 hereof, be subdivided, a dedicated street shall be run north and south through said land, which said street shall be dedicated and opened to the public and shall be an extension of - 3 - Alameda Avenue, shall have a width of 60 feet, shall be curbed and be paved with a 36 foot pavement. SECTION 7. It is hereby declared and said Council does hereby find that the amendments and reclassifications set forth in this Ordinance have been made upon written application of Clarence M. Coleman, the owner of the property herein re- classified, which said application was filed with the City Clerk, the filing fee paid, and contained the allegations required by Ordinance No. 342; was accompanied by a map and list of names as required,by said Ordinance, was referred to the secretary of the City Planning Commission which Commission, due notice as required by Ordinance having been given, and after investigation of the matters involved, duly and regularly considered and heard said application, found that the reclassification herein ordered is necessary for the preservation and enjoyment of substantial property rights of petitioner and is not materially detrimental to the public welfare or to the property of other persons located In the vicinity and will not violate or defeat the spirit of said Ordinance No. 342, whereupon said Commission made report to this council recommending that such application be granted in the respects hereinset forth. SECTION 8. The Mayor shall sign this Ordinance and the City Clerk shall attest same and certify to the passage, adoption and publication thereof, and shall cause same to be published once, within fifteen days after its passage, in the Azusa Herald and Pomotropic, a weekly newspaper of general circulation pub- lished and circulated in said City of Azusa, which said newspaper -- 4 - is hereby designated for that purpose, and thereupon and there- after thirty days after its passage this Ordinance shall take effect and be in force.
