HomeMy WebLinkAboutOrdinance No. 399ORDINANCE N0. 399 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA, LOS ANGELES COUNTY, CALIFORNIA, AMENDING ORDINANCE NO. 342 KNOWN AS THE ZONING ORDINANCE OF SAID CITY, AND RECLASSIFING LOTS 5 and 6, BLOCK 84, CITY OF AZUSA, ON THE APPLICATION OF NICK FEIDER. The City Council of the City of Azusa does ordain as follows: SECTION 1. (A) Ordinance No. 342 of the City of Azusa, and the Zoning I...iap accompanying same, adopted by the City Council thereof February 21, 19399 shall be and the same are hereby amended so as to set forth and provide that the following des- cribed lands shall be and,the same are hereby classified and zoned as Zone R-4 - Apartment House Districts, said land being described as follows: Lots 5 and 6, Block 84, City of Azusa, County of Los Angeles, State of California, as per map recorded in Book 15, Pages 93 et seq., Miscellaneous Records, in the office of the County Recorder of said County. (B) In consideration of the granting of the reclassi- fication herein provided for, the owner of said property does hereby agree that in the event Eighth Street in said City of Azusa, be at any time extended Easterly beyond the Easterly line of Pasadena Avenue in said City, in such case one-half of the width of Eighth Street, viz., 30 feet, shall be dedicated and conveyed for street purposes, by the then owner or owners of the South 30 feet of aforesaid Lot 6, which said dedication and con- veyance shall be for the purpose of extending Eighth Street as aforesaid for the use of the public as a street or highway, shall be free of any charge to theiCity of Azusa for the said public use of said 30 feet, and shall apply to the South 30 feet of aforesaid Lot 6, paving of said 30 foot strip to be paid for by `'- the then owner or owners of said land, aforesaid covenant to run with and bind said land. SECTION .2. - It is hereby found and determined by said City Council that the amendment and reclassification set forth in this Ordinance has been made upon the verified written application of Nick Feider, the owner of'the property herein reclassified and zohed, which said application was filed with the City Clerk, the filing fee paid, and contained the allegations required by Ordinance No. 342; was accompanied by a map and list of names as required by said Ordinance, was referred to the Secretary of the City Planning Commission, which Commission, due notice as required by Ordinance having been given and after investigation of the matter involved, duly and regularly considered and heard said application, found that the reclassification and zoning herein ordered is necessary for the preservation and enjoyment of the substantial property rights of the petitioner and is not materially detrimental to the public welfare or to the property of other persons locat- ed in the vicinity and will not violate or defeat the spirit of said Ordinance No. 342 and amendments thereof, whereupon said Commission made report to this Council that such appli- cation be granted in the respects herein set forth, it being hereby found and determined by said City Council that in all respects the requirements sat forth in said Ordinance No. 342 and in all amendments thereof, and especially as set forth in Section 17 of said Ordinance No. 342, have in all respects been fully complied with. SECTION 3. The Mayor shall sign this Ordinance and the City Clerk shall attest same and certify to the passage, adoption and publication thereof, and shall cause same to be published once, within fifteen days after its passage, in the Azusa Herald and.Pomotropie, a weekly newspaper of general -2- 0 circulation published and circulated in said City of Azusa, which said newspaper is hereby designated.for__wthat.purpose, ;MSA and thereupon and thereafter thirty days after itis passage this Ordinance shall take effect and be in force.
