AN ORDINANCE PROHIBITING PERSONS
3 OWNING OR HAVING CHARGE, CARE,
CUSTODY OR CONTROL OF DOGS FROM
4 ALLOWING THEM TO RUN AT LARGE

7`1 The City Council of the City of Azusa, California, does

8 , ordain as follows:

SECTION 1: No person owning, harboring, having charge,
10
11 care, custody or control of any dog shall suffer, permit or allow
12 the same to be or to run at large upon any street, lane, alley,
13 court or other public place, or upon any private property or premises
14 other than those of the person owning, harboring or having charge,
15 care, custody or control of such dog in the City of Azusa, unless
16 such dog be restrained by a substantial chain or leash, not exceeding
17 six feet in length, and is in the charge, care, custody or control of
18 a competent person.
19 SECTION 2: The Office of City Pound Plaster is hereby
20 created. Such office may be held by any individual or may be filled
21I by contract between the City and any society or association organized
22 and existing under and by virtue of any law of the State of California
23 for the impounding, care, etc., of dogs.
24 SECTION 3: Any person finding any stray dog or any dog
25 which is running at large contrary to provisions of this ordinance or
26 any law of the State of California, may take up such animal if he
27 complies with the applicable provisions of this ordinance; every
28 person, except the pound master or pound keeper, taking up any stray
29 dog which is running at large contrary to the provisions of this
30 ordinance, or of any law of the State of California, shall within
31 four hours thereafter give notice to the pound master of:
32 (a) The fact that he has such a dog in his possession;

1 (b) Complete description of such dog;
2 (c) The license number of such dog, if any, and by what
3 County or municipal corporation issued. If such dog has no license,
4 he shall so state;
5 (d) The place at which such dog is confined.
6 SECTION 4. Any person taking up any stray dog found
7 running at large, contrary to the provisions of this ordinance or any
8 law of the State of California, shall surrender such dog to the pound
9 master or to his duly authorized representative upon demand.
10 SECTION 5: Every pound keeper with whom any dog is
11I impounded, pursuant to this ordinance, shall within eighteen working
12 hours after receiving such dog notify, either by telephone or post -
13 card, with postage fully prepaid thereon, the person to whom the
14 current license was issued of the whereabouts of such dog, providing
15 such license shows the name and address of the person to whom the
16 current license was issued.
17 SECTION 6: As used in this ordinance, working hours mean
18 hours during which the office or place of business of any pound
19 keeper is open for the business of receiving, impounding or caring fol
20 dogs, and does not include any time during which such office or place
21 of business is closed.
22 SECTION 7: Dogs impounded pursuant to this ordinance shall
23 not be destroyed or otherwise disposed of unless:
24 (a) The person to whom the current license belongs so
25 directs;
26 (b) Five full days have elapsed since such person was
27 notified of his dog's whereabouts by telephone, or six full days
28 have elapsed since a written notice, either by postcard or letter,
29 postage fully prepaid, addressed to such person at his last known
30 address and informing such person of the whereabouts of his dog, has
31 been deposited in the United States mail.

11 SECTION 8: Any dog found running at large or otherwise,
2 contrary to the provisions of this ordinance shall be impounded and
3 disposed of.
4 SECTION 9: Each person or association in charge of any
5 pound provided for herein shall collect and pay into the city treasury
6 the following fees:
71 For taking up and impounding any dog, one dollar and fifty
8 cents ($1.50); for feeding and caring for any such dog forty cents
9 ($.40); for each day or fraction thereof during whichsuch dog is
10 kept in such pound; for giving notice of the impounding of any such
11 dog, the actual cost of the publication of any notice published for
12 such dog; provided, however, that no fees whatsoever shall be charged
13 or collected for any dog which has been unlawfully taken up and
14 impounded, but such dog shall be immediately delivered upon demand
15 thereof to the owner or person entitled to the custody -thereof.
16 SECTION 10: Each pound keeper or person or association in
17 charge of any pound may, upon the impounding of any dog, cause to be
18 published in any newspaper published and circulated within the City of
19 Azusa, a notice of the impounding thereof, which notice shall contain
20 a general description of such dog, the date of such taking up and
21 impounding and the address of the pound wherein such dog is being
22 held.
23 SECTION 11: Not less than seven days after the taking up
24 and impounding of any dog as herein provided, unless it be sooner
25 redeemed, such person or association in charge of any such pound shall
26 destroy such dog or shall dispose of such dog to any person who will
27 pay the reasonable value of such dog, together with the pound fees
28 therefor, and the actual cost of publication of any notice or notices
29 of impounding which shall have been published, and who will procure
30 and pay for the required license for such dog for the current year.
31 SECTION 12: It shall be unlawful for any unauthorized perso
32 to remove from any dog any collar or harness or other device to which

1) is attached a license tag for the current year, or to remove such tag
2 therefrom.
3 SECTION 13: It shall be unlawful for any person to attach
4I to or keep upon, or to cause or permit to be attached to or kept upon
5�I any dog, any tag provided for in Ordinance No. 381 , and of the
6� ordinances amendatory thereof, or to attach to or keep upon or cause
7 or permit to be attached to or kept upon any dog or to make or to
8 cause or permit to be made or to have in possession, any counterfeit
9 or imitation of any tag provided for in this ordinance.
10 SECTION 14: It shall be unlawful for any person to inter -
11 fere with, oppose or resist any pound keeper or other person a.uthori-
12 zed under the provisions of this ordinance to take up and impound
13 dogs while such pound keeper or other person is engaged in the
14 performance of any act authorized by this ordinance.
15 SECTION 15: The City Council of said city may. --enter -
16 into a written agreement or agreements with any duly organized Humane
17 Society or societies which will undertake to carry out the provisions
18 of this ordinance and to maintain and operate a pound and to take up,
19 impound and dispose of unlicensed dogs, and any such Humane Society
20 which shall have entered into any such agreement shall have and is
21) hereby given full power and authority and it shall be its or their
22I duty to take up and impound each or any unlicensed dog in said city
23 in the manner herein prescribed.
24 SECTION 16: Any person, firm or corporation violating any
25 of the provisions of this ordinance shall be deemed guilty of a mis-
26 demeanor and upon conviction thereof shall be punishable by a fine of
27 not to exceed 925.00.
28 SECTION 17: Constitutionality:
29 If any provision of this ordinance, or the application there -
30 of to any person or circumstance is held invalid, the remainder of
31 this ordinance, or the application thereof to other persons or
32 circumstances shall not be affected thereby.

SECTION 18: Execution and Publication.
The City Clerk shall attest to the adoption of this
ordinance, and shall cause the same to be published once in the
Azusa Herald and Pomotropic, a weekly newspaper of general circulati
published, printed and circulated in the City of Azusa, within the
time and in the manner provided by law therefore, and the same shall
become effective at the expiration,of thirty days from the date of
adoption thereof.

of Azusa, held on May 17 , 1948, in the regular Council Chambers of
said City Council in said City; that said Ordinance was placed upon
its first reading at said regular meeting May 17 , 1948; that there-
after said Ordinance was duly and regularly passed and adopted by
said Council, signed and approved by the Mayor and attested by the
City Clerk of said City at a regular meeting of said Council so held
