HomeMy WebLinkAboutOrdinance No. 506ORDINANCE NO. 5o6 *• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA REGULATING THE SPLITTING OF LOTS AND THE SUBDIVISION OF LAND INTO FEWER THAN FIVE PARCELS. The City Council of the City of Azusa does ordain as follows: lotSECTION 1. Compliance Required. Any person dividing any , piece or parcel of land into two or more portions for the purpose of sale of one or more of such portions shall comply with the pro- visions of Ordinance No. 410 of the City of Azusa as the same may be amended from time to time, this ordinance and the provisions of the Subdivision Map Act of the State of California relating to subdivisions, except as hereinafter in this ordinance expressly provided. SECTION 2, Same. Exceptions, Compliance with the.pro- visions of this ordinance and said Ordinance No. 410 and of the Sub- division Map Act of the State of California relating to subdivisions are not required when all of the following conditions are present: (a) A Record of Survey Map of the entire lot, piece or Parcel of land to be divided is filed in triplicate with the City Engineer accompanied by a filing fee of $5,00. (b) The said lot, piece or parcel of land is to be divided into not more than four parcels or lots, and all such parcels or,lots abut upon a dedicated and improved public street and comply with4`all minimum requirements of this City, widenin (c) No dedication or improvement for street opening or g is proposed in connection with the division of such lot, piece or parcel of land. or on widening within the area cisirequiredpunder ethefor Mastereet Planpng ofiStreets and Highways. Record ofSurvey�Map,tthe City ies of nEngineer shallcheckthe same as soon as practicable and if he finds that all of the con- ditions set forth in Section 2 have been met, except approval, he shall then endorse his approval thereon in writing. Otherwise he shall notify the person filing the map in writing of his failure to approve and the reasons therefor. SECTION 5. Same, Same. Appeal. Any person aggrieved by the failure of the City Engineer to approve any such Record of Survey Map may, within fifteen days after receipt of written notification of the lack of such approval, file a written appeal with the Planning Commission from the determination of the City Engineer. As soon as practicable the Planning Commission shall review the Record of Survey Map, and all matters pertaining thereto, and if it finds that all of the conditions set forth in Section 2 have been. met, except approval, it shall then endorse its approval and advise the person filing such map of its denial = approval. The action of the Planning Commission shall be final, or SECTION 6. Same. Same. Recording Map. After any such Record of Survey Map has been approved, the person filing the same shall deposit with the City Engineer funds sufficient to pay the cost of recording such map in the office of the County Recorder, and there- upon the City Engineer shall cause said Record of Survey Map to be recorded. Approval shall not be deemed to be complete within the meaning of Section 2 until such map is recorded. An additional copy of said Record of Survey Map shall be retained on file in the office of the City Engineer. SECTION 7. Same. Splitting of Lot. No lot shall be separated in ownership or reduced in size except in conformity with this Section and with any subdivision.requirements of this City that may be applicable thereto. Subject to any such applicable subdivision requirements, a lot may be divided into two or more parcels provided an accurate map or plat showing such division is first filed with the City Engineer by the owner of such lot and provided further that each resulting parcel has an area and front lot line not less than the average area and front lot line of the lots in the same block having front lot lines on the same street as such parcel, if there are any lots in such block facing such street, and if none, then not less than the average area and front lot line of the lots in the same block and facing.the same street as the lot to be so divided, but in no event shall the area of any such parcel be less than six thousand square feet or the front lot line less than fifty feet. This Section shall not apply to any subdivision filed under the provisions of the Subdivision Map Act of the State of California. SECTION 8. Penalties for Violation. Any person who violates any of the provisions or fails to comply with any of the mandatory requirements of this ordinance is guilty of a misdemeanor, and upon conviction thereof shallbe punishable by a fine of not to exceed Five Hundred Dollars ($500.00) or by imprisonment in the City Jail for a period of not to exceed one hundred and eighty (180) days, or by both such fine and imprisonment.
