HomeMy WebLinkAboutOrdinance No. 501ORDINANCE NO. 501 AN ORDINANCE OF THE CITY OF-AZUSA, DIRECTING THAT NO BUILDING PERMIT BE ISSUED FOR ANY BUILDING OR STRUCTURE IN CONFLICT WITH AND PROHIBITING ANY OTHER USE IN CONFLICT WITH THE PROPOSED NEW ZONING ORDINANCE. The City Council of the City of Azusa does ordain as follows: SECTION 1. The City Council hereby finds, determines and declares: (a) That for many months the Planning Commission has been preparing a new comprehensive zoning plan and regulations .for the City of Azusa, and that said comprehensive zoning plan and regulations are now set forth in a proposed new zoning ordi- nance which has been prepared at the direction of the City Plan- ning Commission and which is entitled' -"Proposed Zoning Ordinance, Azusa, California, October, 1955"; (b) That the terms of said proposed new zoning ordi- nance are available to the public in the Office of the City Clerk, but that the same will not be effective.for a period of thirty-four days or more because of the necessity of complying with the proce- dural requirements of the State law; (c) That prior to the time said ordinance becomes effective, a large number of persons, unless restrained, will ob- tain building permits and commence immediate construction of buildings and structures which will not conform to the comprehen- sive zoning plan or to the provisions of the said proposed ordinance; that the said buildings and structures will violate the comprehensive zoning plan provisions as to use, height, bulk and area, and if said buildings and structures are erected, they will irreparably damage neighboring properties; and the erection of a large number of build- ings or structures contrary to the provisions of said proposed ordi- nance and to the comprehensive zoning plan which it represents will constitute a permanent and irreparable injury to the City of Azusa and to the inhabitants of the districts in which such buildings and structures are erected, and will hamper the future growth of the City and will impair the welfare of its citizens and inhabitants. SECTION 2. No building permit shall be issued by any officer, official or employee of the City of Azusa for any building or structure not in conformity with the provisions of said proposed regulations therein contained until the said proposed ordinance shall have been adopted and shall becomeeffectiveor until proceedings for the adoption thereof shall have been dismissed. If any building per- mit shall hereafter be issued contrary to the provisions of this Section, such building permit shall be void. r SECTION 3. Any other use which would be or is in conflict with the provisions of said proposed zoning ordinance are hereby pro- hibited until the said proposed ordinance shall have been adopted and shall become effective or until proceedings for the adoption thereof shall have been dismissed. SECTION 4. This ordinance is hereby declared to be neces- sary for the immediate preservation of the public peace, health and safety. A declaration of the facts constituting its urgency is con- tained in Section I of this ordinance. SECTION 5. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published.in the manner required by law, and this ordinance shall take effect immediately upon its adoption.
