HomeMy WebLinkAboutOrdinance No. 50400 ORDINANCE NO. 504 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA PROHIBITING THE DISCHARGE OF FIREARMS., SIMULATED FIRE- ARMS,.REVOLVERS,.PISTOLS, AIR GUNS,.AIR RIFLES, -SPRING GUNS, SLINGS, SLING SHOTS OR ANY_DEVICE DESIGNED OR, INTENDED TO.DISCHARGE,ANY DANGEROUS MISSILE-* AND THE POSSESSION, CUSTODY,OR_CONTROL_OF-SUCH NAMED WEAPONS OR FIREARMS BY ANY MINOR,PERSON UNDER.THE AGE. OF, EIGHTEEN (18).YEARS; PROVIDING.A PENALTY FOR THE VIOLATION THEREOF; AND REPEALING ORDINANCES_NUMBERED.426.,.453, 461 AND.480. The City Council of the City of Azusa does hereby ordain as follows: . SECTION 1. Except as otherwise provided for in this ordinance it shall be unlawful for any person to fire, discharge,i;shoot, or operate, or to allow, assist or participate in the firing, discharging, shooting or operating of any gun, revolver, pistol, firearm, simulated firearm, spring gun, air gun, air rifle, sling, sling shot, or device designed or intended to discharge, or capable of discharging, any dangerous missile, or cartridge, shell, ammunition, or device containing any explosive sub- stance designed or intended to be used in or fired from any gun, revolver, pistol, firearm or simulated firearm. SECTION 2. Except as otherwise provided for in this ordinance it shall be unlawful for any person under the age of eighteen (18) years to have in his or her possession, or under his or her control, care, or custody, any gun, revolver, pistol, firearm, simulated firearm, spring gun, air gun, air rifle, sling, sling shot or device designed or Intend- ed to discharge or capable of discharging any dangerous missile or any cartridge, firearm or device containing any explosive substance designed or intended to be used in or fired from any gun, pistol, revolver or firearm or simulated firearm. SECTION 3. Except as otherwise provided for in this ordinance it shall be unlawful for any person, firm or corporation, to sell, give, loan or in any way furnish, or to cause or permit to be sold, given, or loaned, or in any way furnished, to any minor person under the age of eighteen (18) years, any gun, revolver, pistol, firearm, simulated fire- arm, spring gun, air gun, air rifle, sling, sling shot, or device designed or intended to discharge or capable of discharging any dangerous missile or explosive substance. Provided, however, that the provisions of this section shall not apply to or include any person who.shall loan, give or furnish to any minor person under the age of eighteen (18) years. arty firearm or weapon or device named i0this ordinance when and only when it is so loaned, given or furnished to comply with and when such minor person under eighteen years of age actually participates in shooting at any of the designated target ranges named in Section 5 of this ordinance, or while going to and returning from such target ranges SECTION 4. The provisions of Section 1 hereof shall not include or apply to Peace Officers, Auxiliary Peace Officers, including Auxiliary or Reserve Policemen when acting in the line of duty. Nor shall Section 2 have any application to or include any member of the Azusa Police De- partment or Azusa Auxiliary or Reserve Officers while in the line of -duty or -while shooting or discharging any type of revolver, pistol or rifle at any target range established by the City of Azusa. SECTION 5. The provisions of Sections 1 and 2 hereof shall not include or apply to any minor person under the age of eighteen (18) years who is lawfully enrolled in or is a member of a lawfully established revolver, pistol or rifle shooting club or association when going to and returning from or engaged in shooting at any inanimate target or trap- shooting device at any lawfully established target, pistol, revolver or 00 op rifle range. Nor shall said Sections 1 and 2 apply to or include any person shooting atany.revolver, pistol or rifle range established and operated by the Parks and Recreation Commission of the City of Azusa, when such range or ranges are approved by and conducted under regulations adopted by the said Commission and approved by the City Council of the City of Azusa. Whenever any minor person under the age of eighteen (18) years possesses, has custody, care and control of any firearm or weapon named in this ordinance,or discharges or shoots,cthe same at any target range named herein, or while going to or returning from said target ranges, said minor person shall carry in his immediate possession a signed written authorization from a parent or guardian so to do. SECTION 6. Ordinances numbered 426, 453, 461 and 480; and all other ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed. SECTION 7. Any person, firm or corporation violating any pro- vision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed five hundred ($500.00) dollars or by imprisonment in the City and/or County Jail for not to exceed six (6) months, or by both such fine and imprison- ment. SECTION 8. The Mayor shall sign this ordinance and the City Clerk shall attest the.same and certify to the passage, adoption and Publication of the same and cause the same to be published once within fifteen days after its passage, in the Azusa Herald and Pomotropic, a weekly newspaper of general circulation, published and circulated in the City of -Azusa and thirty days after its passage the same shall be in full,force!and effect. ayor STATE OF CALIFORNIA COUNTY OF LOS.ANGELES SS.
