HomeMy WebLinkAboutOrdinance No. 99-O40 0 ORDINANCE NO. 99-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AZUSA AMENDING THE ZONING ORDINANCE (TITLE 88 OF THE AZUSA MUNICIPAL CODE) ARTICLE VI, "SPECIAL USE STANDARDS" ADDING DIVISION 5. "TATTOO PARLORS AND PERMANENT MAKE-UP ESTABLISHMENTS" CODE AMENDMENT #207 WHEREAS, The City is precluded by state law from regulating tattoo parlors based on their health impacts, and; WHEREAS, The City has become aware of the increasing popularity of tattoo parlors, and; WHEREAS, The City is aware that tattoo parlors can be perceived as centers for loitering, potentially leading to other illicit activities, and; WHEREAS, The City has determined that tattoo parlors are not desirable when located near businesses or other land uses that children and teenagers frequent, and; WHEREAS, On November 16, 1998 the City Council amended the Zoning Ordinance, allowing tattoo parlors as a conditionally permitted use within the M-1 and M-2 zones, and permanent make-up establishments as a permitted use when accessory to barber and beauty shops, and; WHEREAS, On November 16, 1998 the City Council directed staff to develop strengthened requirements to regulate these land uses. The City Council of the City of Azusa does ordain as follows: SECTION 1: Article VI, "Special Use, Standards" of Title 88 of the Azusa Municipal Code, is hereby amended as follows: Division 5. Tattoo Parlors and Permanent Make -Up Establishments Sec. 88-1475. Conditional Use Permit Approval Required A Conditional Use Permit, obtained pursuant to the provisions of Article III, Division 7 of this Chapter, shall be required for all proposed tattoo parlors and appendix A: Regulation of Uses by Zoning District indicates in which zoning districts such uses are permitted subject to Conditional Use Permit review and approval. Page -1- 0 0 Sec 88-1480. Locational Requirements. (a) As indicated in Appendix A: Regulation of Uses b Zoning oning District, tattoo parlors may only be located within the M-1 and M-2 zoning districts. Permanent make-up establishments may only be permitted as an accessory use to a barber or beauty shop, which are permitted within the C -l. C-2, C- 3. CBD. PID. M-1 and M-2 zoning districts. bb) For thepurposes ofthis Division, accessory shall be defined as a use which is incidentall, appropriateand subordinate to the main use of the building and does not alter or affect the principal use, as determined by the Community Development Director. (c1 No tattoo parlor shall be located within 300 feet of any residential zone, either within the City limits or in an adjacent jurisdiction. (dZ No tattoo parlor shall be located within 500' of any other tattoo parlor, school,ark, playground, recreational facifity�youth center, child care center or entertainment park. SECTION 2: The City Council hereby determines that this recommendation and adoption of the proposed ordinance pursuant to the City of Azusa implementing procedures and the State California Environmental Quality Act (CEQA) Guidelines (Article 19, Categorical Exemptions) will not have a significant impact on the environment, and is Categorically Exempt as a member of Class 8 of the CEQA Guidelines and Class 8 of the City Azusa Local Guidelines for Implementing CEQA. law. SECTION 3: This ordinance shall be in full force and effect thirty days after its passage.
